MINUTES                                                                                             
REGULAR MEETING
CITY COUNCIL & WPC AUTHORITY  
September 9, 2013

A   REGULAR MEETING was held by the City Council & WPC Authority in the City Hall Auditorium on Monday, September 9, 2013, having been adjourned from September 3, 2013.

Those in attendance included Mayor Ryan Bingham, Corporation Counsel Raymond Rigat, City Councilors Drake Waldron, Elinor Carbone, Paul Samele, Gregg Cogswell, Gerald Zordan and Marie Soliani.    WPCA Administrator Raymond Drew, Purchasing Agent Pennie Zucco, and City Engineer Ed Fabbri were also in attendance.
 
Mayor Bingham called the meeting to order at 6:30 p.m.    

MINUTES
On a motion by Councilor Waldron, seconded by Councilor Zordan, the Council voted unanimously to accept the minutes of the Regular Meeting held August 19, 2013.  Councilor Soliani abstained.

On a motion by Councilor Carbone, seconded by Councilor Waldron, the Council voted unanimously to accept the corrected minutes of the Regular Meeting held August 12, 2013.

OPEN TO THE PUBLIC
On a motion by Councilor Carbone, seconded by Councilor Cogswell, the Council voted unanimously to open the meeting to the public.   There was no one present who wished to speak.

SCHEDULE PUBLIC HEARING  - Beer in Fuessenich Park      
On a motion by Councilor Zordan, seconded by Councilor Soliani, the Council voted unanimously to accept Ordinance Subcommittee's recommendation to schedule a public hearing on Monday, September 23, 2013 at 6:30 p.m. to consider amending Chapter 75, Section 3A, of the Torrington Code of Ordinances, Alcoholic Liquor, Exceptions, as follows:

Persons may possess beer and wine with the intent to sell, may sell beer and wine and may consume beer and wine purchased therein during any professional baseball game at Fuessenich Park only, without violating this article; provided, however, that (1) the person or persons selling said beer and wine has entered into a lease with the City of Torrington for use of Fuessenich Park for its professional baseball operation. (2) the person or persons selling said beer applies for and receives a permit from the City Council approving a detailed plan for the sale of beer during its normal operations which limits the vending areas to no more than two areas within Fuessenich Park; provides for ample security; does not allow the sale of beer to intoxicated patrons; and provides proof of insurance; and (3) any permit issued may be revoked for cause by the City Council.
Councilor Zordan confirmed that the amendment language can be altered after the Public Hearing.

TORR. AREA HEALTH DIST, BRD OF HEALTH:  J. Magda, R. Waselik
On a motion by Councilor Zordan, seconded by Councilor Samele, the Council voted unanimously to  appoint Dr. Jessica Magda, and re-appoint Robert Waselik, to the Torrington Area Health District Board of Health for the City of Torrington for a 3 year term to expire  Jan. 9, 2016.

TORR. AREA HEALTH DIST, BRD OF HEALTH:  J. Petricone
On a motion by Councilor Waldron, seconded by Councilor Cogswell, the Council voted unanimously to re-appoint Joseph Petricone, Jr., to the Torrington Area Health District Board of Health for the City of Torrington for a 3 year term to expire Jan. 9, 2015.

INLAND WETLANDS RE-APPOINTMENTS
On a motion by Councilor Cogswell, seconded by Councilor Carbone, the Council voted unanimously to approve the following re-appointments to the Inland Wetlands Commission for 3 year terms:

Thomas Telman, Christine Altman, Kathy Carlson
Term to expire September 5, 2016
John Bate, Jr., Nicole Fritch, Jane Bakker
Term to expire September 5, 2014

TORRINGTON HOUSING AUTHORITY
On a motion by Councilor Zordan, seconded by Councilor Soliani, the Council voted unanimously to  re-appoint Robert Raleigh to the Torrington Housing Authority Board of Commissioners for a five year term to expire September 1, 2018.

NUISANCE ACTION:  1059/1019 E. Main St.
On a motion by Councilor Zordan, seconded by Councilor Soliani, the Council voted unanimously to  
approve Corporation Counsel's request to bring a nuisance action against the owner of 1059 (aka 1019) East Main St. for failure to remediate discharge of water into a public street.

ZONING ENFORCEMENT ACTION: 2886 Winsted Rd.
On a motion by Councilor Soliani, seconded by Councilor Cogswell, the Council voted unanimously to  
approve Corporation Counsel's request to proceed with filing a zoning enforcement action against the owner of 2886 Winsted Rd., as approved by the Planning & Zoning Commission on August 14, 2013.

RESOLUTION:  Lease State Armory
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to
adopt the following resolution:
        RESOLVED, that Ryan J. Bingham as Mayor of the City of Torrington, is authorized and directed   to execute a lease between the          City of Torrington and the State of Connecticut for the use of  the Torrington Armory.

ZONING CITATION HEARING OFFICERS
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to
re-appoint James P. Steck, Esq. and Joel D. Perlotto, Esq. as Zoning Citation Hearing Officers under CGS 114-2i, for two year terms expiring September 30, 2015.      

OPEN TO THE PUBLIC, AGENDA ITEMS ONLY
On a motion by Councilor Cogswell, seconded by Councilor Waldron, the Council voted unanimously to open the meeting to the public on "agenda items" only.   There was no one who wished to speak.
BUSINESS BY DEPT. HEADS  
On a motion by Councilor Waldron, seconded by Councilor Zordan, the Council voted unanimously to consider business presented by Department Heads.  

Mr. Fabbri  reported  that the Planning & Zoning Commission issued an 8-24 referral for sidewalk improvements and a master sidewalk plan.  He suggested a committee be formed to brainstorm ideas and make recommendations to the Council, and that it be made of the City Planner, Public Works Director, a City Councilor, a Planning & Zoning Commissioner and the City Engineer.   Mayor Bingham added that a mayor should be included in the committee.

BUSINESS BY MAYOR AND COUNCIL
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to consider business presented by the Mayor and members of the City Council.  All members congratulated the Mayor on the birth of his son.  

Mayor Bingham announced the upcoming car show to benefit the Lions Club, and reported that the Main Street sidewalk repairs are moving along nicely.

ADJOURNMENT
On a motion by Councilor Cogswell, seconded by Councilor Waldron, the Council voted unanimously to adjourn at 6:44 p.m.
