CITY COUNCIL & WPC AUTHORITY
DECEMBER 7, 2009

A   REGULAR  MEETING of the City Council & WPC Authority was held in the Senior Center Main Room on Monday, December 7, 2009.

Present were Mayor Ryan J. Bingham, Corporation Counsel Ernestine Yuille Weaver, City Councilors Richard Dalla Valle, Paul Samele, Elinor Carbone, Marie Soliani, Thomas Jerram and Drake Waldron, Purchasing Agent Pennie Zucco, City Clerk Joseph Quartiero, Data Processing Manager Rudy Pullano, Members of the Parks and Recreation Commission James Pescatore, Patricia Fairchild, Daniel Lovallo, Board of Finance Member Thomas Scoville, and Members of the Coe Memorial Park Subcommittee Susan Holbrook, Mary Zbell, Frank Pennington, and Margaret Keywan.

Mayor Bingham called the meeting to order at 6:30 p.m.

MINUTES: #31
On a motion by Councilor Jerram, seconded by Councilor Soliani, the Council voted             unanimously to accept the minutes of the Regular Meeting held November 16, 2009, and the Special Meeting held November 23, 2009. Councilor Samele abstained.

OPEN TO THE PUBLIC: #42
On a motion by Councilor Jerram, seconded by Councilor Soliani, the Council voted unanimously to open the meeting to the public.
Ms. Daline Dudley of Trotters Way inquired about the Coe Park situation and asked for a discussion on how the relationship works between the Parks and Recreation Committee and the Coe Park Committee.  Mayor Bingham offered to explain this, inviting her to call him personally.
Ms. Susan Coe Holbrook of P.O. Box 303 presented photographs of Coe Park's landscaping saying it should be sent out to bid.
Mrs. Pennie Zucco of Pershing Street spoke as a concerned citizen recommending Still River Gardens be given a contract extension since the high amount of rainfall this past year hasn't facilitated a fair assessment of the landscaping.

PRESENTATION: Municipal Renovations Project
Mr. Michael Clark, Chairman of the Municipal Renovations Committee, updated the Council on the project progress to date, saying it is 56% complete overall. He encouraged the Council to walk through the building on Wed. mornings at 8:00 a.m.

BOARD OF FINANCE APPT. - T. Scoville & L. Pesce: #801
On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to accept the appointments of Thomas Scoville and Laurene Pesce to the Board of Finance for a 6 year term expiring 12/15/2015.

PLANNING & ZONING COMM. APPT. - P. Summers: #818
On a motion by Councilor Waldron, seconded by Councilor Samele, the Council voted unanimously to accept the appointment of Paul Summers to the Planning and Zoning Commission for a 5 year term expiring 12/1/2014.

WESTERN CT TOURISM DISTRICT APPT. – S. Criss #825
On a motion by Councilor Carbone, seconded by Councilor Soliani, the Council voted unanimously to appoint Steve Criss as Western CT Tourism District Representative to the Board of Directors of the NW Convention and Visitors Bureau for a three year term expiring December 7, 2012, pending clarification of residency requirements.

FELICITY LANE PUMP STATION: #887
On a motion by Councilor Waldron, seconded by Councilor Dalla Valle, the Council, acting as the Water Pollution Control Authority, voted unanimously to authorize payment of $19,386.65 from Sanitary Sewer Capital Improvement Acct. #490 to W.W. Manchester Construction for Invoice #3 for construction services related to the Felicity Lane Pump Station.

WILLOW GARDENS: #896
On a motion by Councilor Carbone, seconded by Councilor Jerram, the Council voted unanimously to
authorize payment of $137,738.20 from fund #288 to Mastrobattisto, Inc. for the Willow Gardens Project, drawdown #19.

MUNICIPAL RENOVATIONS: #907
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted
unanimously to approve the following payments from the Municipal Renovations Fund #0316:

FUESSENICH PARK CONCESSIONS - KEZ: #914
On a motion by Councilor Carbone, seconded by Councilor Jerram, the Council voted unanimously to extend the concessions contract for Fuessenich Park to KEZ Concessions for 2010 season at same prices and terms as the current contract.

COE MEMORIAL PARK – HORITCULTURAL & RELATED SVCS.: #930
On a motion by Councilor Jerram, seconded by Councilor Waldron, the Council voted unanimously to consider the extension of the Still River Gardens contract for horticultural and related services for Coe Memorial Park as outlined in the Agreement of March 4, 2009. Councilor Dalla Valle asked that the selection committee be reconvened. Councilor Soliani said this matter should go out to bid again. Councilor Jerram pointed out that the weather has made it difficult to judge this objectively. Councilor Carbone added that there should be an evaluation instrument determining the City's expectations with clearly defined, predetermined benchmarks and ideas. Councilor Samele agreed that he is in favor of reactivating this committee.
Councilor Dalla Valle moved to table this matter to December 21, 2009, Councilor Samele seconded and the motion to table was unanimously approved.

FORENSIC VIDEO/AUDIO ANALYSIS SYSTEM FOR POLICE DEPT.: #1226
On a motion by Councilor Jerram, seconded by Councilor Dalla Valle, the Council voted unanimously to accept the Purchasing Agent's recommendation to award a bid for Forensic Video and Audio Analysis System to Dynamic Technologies Inc., d/b/a/ Ocean System, MD, in the amount of $24,995.00, pending Board of Public Safety Approval.

SERVER FOR POLICE DEPT.: #1236
On a motion by Councilor Carbone, seconded by Councilor Soliani, the Council voted unanimously to accept the recommendation of the Purchasing Agent and the IT Director to waive the bid process and execute an emergency purchase for the Police Department of a new Server from IBM in the amount of $13,084.00, pending Board of Public Safety Approval.

SMALL CITIES – EMERGENCY BOILER REPLACEMENT: #1244
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council moved to indefinitely table the approval of Small Cities Project emergency boiler replacement for 296 Hillside Ave in the amount of $4,500.00, which has not received the Small Cities Subcommittee's approval yet.

BUILDING DEPT. REPORT: #1262
On a motion by Councilor Jerram, seconded by Councilor Dalla Valle, the Council voted unanimously to accept the Building Department report for the month of October 2009.

OPEN TO THE PUBLIC, AGENDA ITEMS ONLY: #1269
On a motion by Councilor Waldron, seconded by Councilor Dalla Valle, the Council voted unanimously to open the meeting to the public on "agenda items" only.
No one wished to speak.

BUSINESS BY DEPT HEADS: #1279
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to consider business presented by Department Heads. City Clerk Quartiero discussed the electronic delivery of agenda packets.

BUSINESS BY MAYOR AND COUNCIL: #1347
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to consider business presented by the Mayor and City Council.  The Councilors and the Mayor all expressed their appreciation to Mr. Clark for his work on the MRC, thanked everyone who worked on the Inaugural Ceremony, congratulated the newly installed elected officials and welcomed Councilor Samele back to the Board of Councilmen. Mayor Bingham announced upcoming events.

ADJOURNMENT #1602
On a motion by Councilor Jerram, seconded by Councilor Waldron, the Council voted unanimously to adjourn at 7:17 p.m.
