MINUTES CITY COUNCIL & WPC AUTHORITY NOVEMBER 16, 2009

A REGULAR MEETING of the City Council & WPC Authority was held in the Senior Center Main Room on Monday, November 16, 2009. |
Present were Acting Mayor Elinor Carbone, Corporation Counsel Ernestine Yuille Weaver, City Councilors Richard Dalla Valle, Michael Colangelo, Marie Soliani, Thomas Jerram and Drake Waldron, Deputy Fire Chief Brunoli, Drakeville Fire Chief Maccalous, Purchasing Agent Pennie Zucco, Comptroller Alice Proulx, Building Official Brett Zuraitis, Board of Public Safety Commissioner James Potter, Torrington Child Care Center Executive Director Mary Cecchinato and Members of the Coe Memorial Park Subcommittee Susan Holbrook, Mary Zbell, and Margaret Keywan. |
Acting Mayor Carbone called the meeting to order at 6:30 p.m. |
MINUTES: #18 On a motion by Councilor Waldron, seconded by Councilor Colangelo, the Council voted unanimously to accept the minutes of the Regular Meeting held November 2, 2009. |
OPEN TO THE PUBLIC: #24 On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to open the meeting to the public. No one wished to speak. |
REFUND ELEC. PERMIT FEE: #35 On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted unanimously against refunding an electrical permit fee to Sunlight Solar Energy in the amount of $498.02 for homeowner Bernardino Kocovic who cancelled the project. Building Official Zuraitis explained that permits are the property of the homeowner, regardless of who paid for it. Homeowners may authorize anyone to act as their agent applying for permits. Atty. Weaver recommended the refund be made to the homeowner since they own the permit.
Councilor Jerram said the homeowner should request this refund, not the electrician. Councilor Waldron suggested a service charge be considered and Mr. Zuraitis said he will draft a more definitive refund policy for the future. Councilor Colangelo clarified the Council's position that the homeowner be the one requesting the refund. |
RESOLUTION - Torrington Child Care Ctr. 2-yr contract: #398 On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted unanimously to adopt the following Resolution authorizing the Mayor to execute the Torrington Child Care Center Two-Year Contract #143-CDC-31 for the period 2010 through 2011 in the amount of $481,500.00:
RESOLVED, that the Mayor, Ryan J. Bingham, is empowered to enter into and amend contractual instruments in the name and on behalf of this Contractor with the Department of Social Services of the State of Connecticut for a Child Day Care Program, and to affix the corporate seal. RESOLVED, that the City of Torrington hereby adopts as its policy to support the nondiscrimination agreements and warranties required under Connecticut General Statutes 4a-60 (a) (1) and 4a-60a (a)(1), as amended in State of Connecticut Public Act 07-245 and section 9 (a) (1) and 10 (a) (1) of Public Act 07-142 as those statutes may be amended from time to time. |
TANKER/PUMPER TRUCK-DRAKEVILLE VFD: #413 On a motion by Councilor Dalla Valle, seconded by Councilor Jerram, the Council voted unanimously to approve acquisition of Tanker/Pumper truck for Drakeville VFD, having been approved by the Board of Public Safety on November 9, 2009, pending Board of Finance Approval. Fire Chief Maccalous explained some of their plans to pay for the building addition required to house this truck. Commissioner Potter pointed
out that this truck will be owned by the City of Torrington.
BUDGET TRANSFERS/Fleet Chargeback Allocations: #663 On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted unanimously to authorize budget transfers for Fleet Chargeback Allocations for fiscal year 2008/2009 per a memo from the City Comptroller dated November 10, 2009.
BUDGET AMENDMENTS/Fleet Chargeback: #663 On a motion by Councilor Waldron, seconded by Councilor Dalla Valle, the Council voted unanimously to authorize budget amendments for reclassifications and updated allocations for the fleet chargeback program fiscal year 2009/2010 per memo from City Comptroller dated November 10, 2009. |
SMALL CITIES: #562 On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted unanimously to approve payments from fund #250 for Small Cities Grant program to the City of Torrington Corporation Counsel for Invoice HRLR-153 in the amount of $75.00 for a title search performed and to L. Wagner & Assocs. for Invoice HRLR-152 in the amount of $3030.00 for professional services from July 1, 2009 through September 30, 2009.
MUNICIPAL RENOVATIONS: #574 On a motion by Councilor Soliani, seconded by Councilor Waldron, the Council voted unanimously to approve the following payments from the Municipal Renovations Fund #0316: |

ADD SECTION B TO AGENDA: #583 On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to add Section B to the agenda.
SECTION B - RESOLUTION: NONDISCRIMINATION CERT. #592 On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted unanimously to adopt a resolution authorizing the Mayor to sign a Nondiscrimination Certification for Contracts valued at $50,000 or more, as follows:
RESOLVED: That the policies of the City of Torrington comply with the nondiscrimination agreements and warranties of Connecticut General Statutes §§ 4a-60(a)(1) and 4a-60a(a)(1), as amended.
BUDGET TRANSFERS: #617 On a motion by Councilor Colangelo, seconded by Councilor Jerram, the Council voted unanimously to authorize six budget transfers per a memo from the City Comptroller dated November 12, 2009.
BUDGET INCREASES/STATE MANDATED FEES: #626 On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to authorize budget increases for state mandated fees per a memo from the City Comptroller dated November 10, 2009.
BUDGET TRANSFERS: #640 On a motion by Councilor Soliani, seconded by Councilor Colangelo, the Council voted unanimously to authorize budget transfers for the period 7/1/08 through 6/30/09 per a memo from the City Comptroller dated October 13, 2009.
BUDGET TRANSFERS/Local 1579: #648 On a motion by Councilor Jerram, seconded by Councilor Soliani, the Council voted unanimously to authorize budget transfers for Local 1579 City Hall Contract Approved by City Council on 5/12/09 per a memo from the City Comptroller dated October 13, 2009.
BUDGET TRANSFERS/Local 1567: #653 On a motion by Councilor Dalla Valle, seconded by Councilor Waldron, the Council voted unanimously to authorize budget transfers for Local 1567 Fire Contract Approved by City Council on 3/16/09 per a memo from the City Comptroller dated October 13, 2009.
RESOLUTION – Extend Electric Contract #681 On a motion by Councilor Colangelo, seconded by Councilor Jerram, the Council voted to adopt a Resolution as follows, authorizing the Mayor to execute an extension of electric contract due to end January 2012, through cooperative purchasing via CCM Energy Purchasing Program. |
BE IT RESOLVED, the City of Torrington hereby approves the cooperative purchasing of electric procurement for the extension of the Electric Contract ending January 2012 through the CCM Energy Purchasing Program to take advantage of increased purchasing power of a collective purchasing group. BE IT FURTHER RESOLVED, upon the recommendation of City Council, the Mayor, in his sole discretion is authorized to execute, on behalf of the City of Torrington, an extension of the electric contract. Where
practical, the Mayor shall submit the agreement to the City Council for review; however if time does not permit such a review by the City Council, the Mayor is authorized to execute the agreement, in which case the Mayor shall provide the City Council with a copy of the executed agreement at the City Council's next regularly scheduled meeting; BE IT FURTHER RESOLVED, any agreement executed pursuant to this resolution may be of duration of more than twelve months but shall not exceed sixty months.
Mrs. Zucco explained this will lock in this year's pricing rates and we are under no future purchasing obligations under this contract. Councilor Jerram pointed out that this also gives the Mayor the authorization to act on this matter if Council doesn't have a regularly scheduled meeting at that time. The motion was passed 4/1 with Councilor Colangelo opposed.
OPEN TO THE PUBLIC, AGENDA ITEMS ONLY: #743 On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to open the meeting to the public on "agenda items" only. No one wished to speak.
BUSINESS BY DEPT HEADS: #752 On a motion by Councilor Dalla Valle, seconded by Councilor Colangelo, the Council voted unanimously to consider business presented by Department Heads. No business was presented.
BUSINESS BY MAYOR AND COUNCIL: #764 On a motion by Councilor Waldron, seconded by Councilor Dalla Valle, the Council voted unanimously to consider business presented by the Mayor and City Council. Councilor Colangelo thanked everyone for his two years on the Council. Councilor Dalla Valle asked that a plaque be sent to both Councilor
Colangelo and Treasurer Richard Friday for their service to the City. Councilor Jerram thanked Councilor Colangelo for his service to the City, and congratulated all the newly elected officials. He announced the Inauguration Ceremony will be held at 1:00 p.m. on December 7, 2009 at the Warner Theater, with the public invited. Councilor Soliani and Councilor Waldron also thanked Councilor Colangelo. Acting Mayor Carbone expressed her
appreciation to Councilor Colangelo for his service to the City of Torrington.

ADJOURNMENT #905 On a motion by Councilor Waldron, seconded by Councilor Colangelo, the Council voted unanimously to adjourn at 6:56 p.m.
