MINUTES
CITY COUNCIL & WPC AUTHORITY
JUNE 15, 2009

A   REGULAR  MEETING of the City Council & WPC Authority was held in the Senior Center Main Room on Monday, June 15, 2009.

Present were Mayor Ryan J. Bingham, Corporation Counsel Ernestine Yuille Weaver, City Councilors Rick Dalla Valle, Michael Colangelo, Elinor Carbone, Thomas Jerram, Marie Soliani and Drake Waldron, Public Works Director Gerald Rollett, Purchasing Agent Pennie Zucco, Fire Chief John Field, Fire Lt. Gary Brunoli, and Fleet Manager Emil Castro.

Mayor Bingham called the meeting to order at 6:30 p.m.

MINUTES #13
On a motion by Councilor Colangelo, seconded by Councilor Jerram, the Council voted unanimously to accept the minutes of the regular meeting and the minutes of the Public Hearing held May 18, 2009.

MINUTES #24
On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to accept the minutes of the special meeting held May 19, 2009. Councilor Waldron abstained.

On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted unanimously to accept the minutes of the special joint meeting with the Board of Finance held May 19, 2009. Councilor Waldron abstained.

On a motion by Councilor Colangelo, seconded by Councilor Dalla Valle, the Council voted unanimously to accept the minutes of the Public Hearing held May 19, 2009. Councilors Waldron, Dalla Valle and Colangelo abstained.

On a motion by Councilor Dalla Valle, seconded by Councilor Colangelo, the Council voted unanimously to accept the minutes of the special meeting held June 10, 2009. Councilor Carbone abstained.

OPEN TO THE PUBLIC #66
On a motion by Councilor Waldron, seconded by Councilor Dalla Valle, the Council voted unanimously to open the meeting to the public. There was no one who wished to speak.
RESOLUTION TO SIGN GRANT AWARD/POLICE DEPT #73
On a motion by Councilor Jerram, seconded by Councilor Waldron, the Council voted unanimously to adopt a resolution authorizing Police Chief Michael Maniago to sign a grant award from the State of Connecticut Office of Policy and Management Criminal Justice Policy and Planning Division, complying with all grant conditions.

MOTION TO TABLE: PLOW TRUCK CHASSIS #80
On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted to table the motion to consider waiving the bid process and accepting the State Bids for the purchase of two plow truck chassis and two dump bodies for fiscal year 2008-2009 out of Acct. #0309.5900.0105.  Councilor Dalla Valle was opposed.

DRAKEVILLE LAND USE LEASE #91
On a motion by Councilor Jerram, seconded by Councilor Soliani, the Council voted unanimously to accept a new lease agreement between the City of Torrington and Drakeville Volunteer Fire Department for the general use of the land across the street from the Drakeville Fire Station.

MUTUAL AID AGREEMENT: FIRE DEPT. #202
On a motion by Councilor Jerram, seconded by Councilor Waldron, the Council voted unanimously to accept a Mutual Aid Assistance Agreement between Waterbury, Danbury, Torrington, and Region #5 NW Regional Hazardous Materials Team as approved by the Board of Public Safety on June 10, 2009.

FIREFIGHTER TURNOUT GEAR #268
On a motion by Councilor Colangelo, seconded by Councilor Jerram, the Council voted unanimously to accept the Purchasing Agent's, the Fire Department’s, and the Board of Public Safety's recommendation to purchase 35 sets of Firefighter Turnout Gear from Shipman's Fire Equipment Co., Inc., for $1,554.65 per set with a total amount of $54,412.75 from the capital fund account.

WILLOW GARDENS PROJECT #305
On a motion by Councilor Dalla Valle, seconded by Councilor Colangelo, the Council voted unanimously to approve the following payments from Fund #0288 for the Willow Gardens Project:
A. $874.55 to Preiss Breismeister, PC  for Prof. Svcs. Inv. #9 Roof Replacement
B. $3266.25 to TO Design, LLC for Prof. Svcs. Drawdown #11

ADD TO AGENDA #313
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to consider business in Section B.

WILLOW GARDENS PROJECT #319
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to approve the following payments from fund #0288 for the Willow Gardens Project:
A. $1,785.67 to TO Design, LLC for Prof. Svcs. Drawdown #7
B. $73.30 to TO Design, LLC for Prof. Svcs.

MUNICIPAL RENOVATIONS #325
On a motion by Councilor Soliani, seconded by Councilor Jerram, the Council voted unanimously to approve the following payments from the Municipal Renovations Fund #0316:

OPEN SESSION #482
On a motion by Councilor Colangelo, seconded by Councilor Jerram, the Council voted unanimously to enter open session at 6:59 p.m.

A   PUBLIC HEARING of the Board of Councilmen was held in the Senior Center Main Room on Monday, June 15, 2009 review and discuss proposals for participation in the 2009 Neighborhood Assistance Act.
Mayor Bingham called the public hearing to order at 7:00 p.m.

HEARING CLOSED #524
Hearing and seeing no others who wished to speak, Mayor Bingham closed the Public Hearing at 7:02 p.m.

NEIGHBORHOOD ASSISTANCE ACT #427
On a motion by Councilor Waldron, seconded by Councilor Dalla Valle, the Board of Councilmen voted unanimously to accept the proposals submitted for participation in the 2009 Neighborhood Assistance Act.

ADJOURNMENT #533
On a motion by Councilor Dalla Valle, seconded by Councilor Colangelo, the Council voted unanimously to adjourn at 7:03 p.m.
