CITY COUNCIL & WPC AUTHORITY
MAY 18, 2009

A   REGULAR MEETING of the City Council & WPC Authority was held in the Senior Center Main Room on Monday, May 18, 2009.

Present were Mayor Ryan J. Bingham, City Councilors Rick Dalla Valle, Michael   Colangelo, Elinor Carbone, Thomas Jerram, Marie Soliani and Drake Waldron,       Purchasing Agent Pennie Zucco, WPCA Administrator Raymond Drew,                Superintendant of Parks & Recreation Brett Simmons, Fleet Manager Emil Castro, Superintendant of Streets Robert Lizotte, and Director of Public Works Gerald Rollett.

Mayor Bingham called the meeting to order at 7:02 p.m.

WPCA #69
WPCA Administrator Raymond Drew presented the proposed WPCA Budget for the year beginning July 1, 2009 and ending June 30, 2010, which has as many cost-saving cuts as possible.

Mayor Bingham reminded the Council that there is zero tolerance for a fee increase.

SEWER USE FEE #391
Councilor Jerram made a motion, seconded by Councilor Colangelo, to set the sewer use charge for the year beginning July 1, 2009 and ending June 30, 2010 at $188.00 per residential dwelling unit or per 65,000 gallons of volume of flow for all other users.  The motion was denied 5/1.

Councilor Dalla Valle made a motion, seconded by Councilor Carbone to set the sewer use charge for the year beginning July 1, 2009 and ending June 30, 2010 at $194.00 per residential dwelling unit or per 65,000 gallons of volume of flow for all other users.  The motion was approved 5/1.

WPCA BUDGET #831
On a motion by Councilor Jerram, seconded by Councilor Waldron, the Council voted unanimously to approve WPCA Budget for the year beginning July 1, 2009 and ending June 30, 2010.

WPCA FIVE-YEAR CAPITAL IMPROVEMENT #876
On a motion by Councilor Waldron, seconded by Councilor Colangelo, the Council voted unanimously to approve WPCA Five-Year Capital Improvement Budget/Program for the year beginning July 1, 2009 and ending June 30, 2014.

WPCA TRUCKED WASTE FEE SCHEDULE #983
On a motion by Councilor Jerram, seconded by Councilor Carbone, the Council voted unanimously to approve WPCA Trucked Waste Fee Schedule for year beginning July 1, 2009 and ending June 30, 2010.

MINUTES #996
On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted unanimously to accept the minutes of the regular meeting held May 4, 2009.

MINUTES #1006
On a motion by Councilor Jerram, seconded by Councilor Soliani, the Council voted unanimously to accept the minutes of the special meeting held May 12, 2009.  Councilor Dalla Valle abstained.

OPEN TO THE PUBLIC #1014
On a motion by Councilor Dalla Valle, seconded by Councilor Waldron, the Council voted unanimously to open the meeting to the public.

PLOW TRUCK CHASSIS #1025
Councilor Dalla Valle made a motion to waive the bid process and accept the State Bids for the purchase of two plow truck chassis and two dump bodies for fiscal year 2008-2009 out of Acct. #0309.5900.0105, tabled by City Council on April 20, 2009.  It was seconded by Councilor Waldron.
Councilor Jerram made a motion to table this until June 1, 2009, Councilor Colangelo seconded, and the motion to table was passed 4/2.

APPT: ECON DEVEL COMM. #1345
On a motion by Councilor Colangelo, seconded by Councilor Carbone, the Council voted unanimously to appoint James A. Thibault of Torrington to the Economic Development Commission to fill a vacancy left by the resignation of William DeDominicis for a term expiring February 9, 2014.

WILLOW GARDENS #1382
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to approve payment from fund # 0288 to the Register Citizen for Invitation to Bid Ad placed for Site Improvements for the Willow Gardens Project in the amount of $200.00.

BLDG DEPT REPORT #1391
On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted unanimously to accept the Building Dept. Report for the month of April, 2009.

ROADWAY WORK AND MATERIALS #1398
On a motion by Councilor Dalla Valle, seconded by Councilor Waldron, the Council voted unanimously to waive the bid process and accept eight (8) state bids for roadway work and materials for fiscal year 2009-2010 per Director of Public Works Memo dated May 12, 2009.

CONFINED SPACE EQUIPMENT #1411
On a motion by Councilor Jerram, seconded by Councilor Soliani, the Council voted unanimously to waive the bid process and accept the Purchasing Agent's recommendation dated May 12, 2009, to purchase Confined Space Equipment for the Torrington Fire Department, from Shipman's Fire Equipment Co., Inc., Waterford, CT in the amount of $16,783.00, having already been approved by the Board of Public Safety on May 13, 2009.

SANITARY SEWER PUMP STATION, FELICITY LN #1423
On a motion by Councilor Waldron, seconded by Councilor Dalla Valle, the Council voted unanimously to accept the Purchasing Agent’s recommendation dated May 12, 2009, to award a contract for the Sanitary Sewer Pump Station at Felicity Lane to W.W. Manchester Construction Co., Inc. in the amount of $74,811, to be paid through the WPCA Sanitary Sewer Capital Improvement Account..

MUNICIPAL RENOVATIONS #1432
On a motion by Councilor Soliani, seconded by Councilor Jerram, the Council voted unanimously to approve the following payments from the Municipal Renovations Fund #0316:

OPEN TO THE PUBLIC: AGENDA ITEMS #1535
On a motion by Councilor Jerram, seconded by Councilor Waldron, the Council voted unanimously to open the meeting to the public on agenda items only.  No one spoke.

BUS:  DEPT HEADS #1542
On a motion by Councilor Waldron, seconded by Councilor Colangelo, the Council
voted unanimously to consider business presented by Department Heads.
Corporation Counsel Yuille Weaver requested an executive session under pending
Litigation, be added to the agenda by 2/3 vote.

ADD TO AGENDA #1564
On a motion by Councilor Jerram, seconded by Councilor Soliani, the Council voted unanimously to add an item to the agenda (Pool Heater).

BUS: MAYOR & MEMBERS #1575
On a motion by Councilor Waldron, seconded by Councilor Colangelo, the Council
voted unanimously to consider business by the Mayor and members of the Council.

Councilor Carbone informed the Council of the TDC Public Hearing to be held on
                               June 2nd.
Councilor Dalla Valle made a motion, seconded by Councilor Jerram, to add an item to the agenda by 2/3, was unanimously approved (Exec.Session).

POOL HEATER #1709
On a motion by Councilor Dalla Valle, seconded by Councilor Waldron, the Council
voted unanimously to waive the bid process and hire Liberty Plumbing & Heating of
Winsted, CT to replace a Hot Water Heater with the optional new jets at Besse Pond Pool House in the amount of $11,225.00 from Capital Project Funds.

Councilor Dalla Valle  continued with business by saying in these economic times, it would be prudent to reconsider holding the Fourth of July fireworks which will costapproximately $40,000.  Mayor Bingham said he would gather information on this for the Council's consideration.

EXEC SESSION: PENDING LITIGATION #1979
On a motion by Councilor Jerram, seconded by Councilor Carbone, the Council voted unanimously to enter an executive session under pending litigation at 7:55 p.m. Corporation Counsel Yuille Weaver was invited.

OPEN SESSION
On a motion by Councilor Colangelo, seconded by Councilor Dalla Valle, the Council voted unanimously to an enter open session at 8:05 p.m.

ADJOURNMENT
On a motion by Councilor Dalla Valle, seconded by Councilor Waldron, the Council
voted unanimously to adjourn at 8:05 p.m.
