CITY COUNCIL & WPC AUTHORITY
MAY 4, 2009

A   REGULAR  MEETING of the City Council & WPC Authority was held in the Senior Center Main Room on Monday, May 4, 2009.

Present were Mayor Ryan J. Bingham, Corporation Counsel Ernestine Yuille Weaver, City Councilors Rick Dalla Valle, Michael Colangelo, Elinor Carbone, Thomas Jerram, Marie Soliani and Drake Waldron, WPCA Administrator Raymond Drew, Public Works Director Gerald Rollett, Purchasing Agent Pennie Zucco, and Deputy Fire Chief Jaye Giampaolo.

Mayor Bingham called the meeting to order at 6:30 p.m.

MINUTES #15
On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to accept the minutes of the regular meeting held April 20, 2009.

OPEN TO THE PUBLIC #20
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to open the meeting to the public. There was no one who wished to speak.

ADD SECTION B TO AGENDA #27
On a motion by Councilor Jerram, seconded by Councilor Dalla Valle, the Council voted unanimously to consider business Section B.

ELECTRICAL SERVICES CONTRACT #31
On a motion by Councilor Jerram, seconded by Councilor Dalla Valle, the Council voted unanimously to award Electrical Installation and Repair Services Contract to Connole's Electric, LLC for FY 09/10 in the amount of $44.50/hour for Journeymen per the Purchasing Agent's recommendation dated April 30, 2009.

FAIR HOUSING CONFERENCE & MEMBERSHIP DUES #59
On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to approve payment from fund # 0250 to The Fair Housing Assn. of CT for the 4/23/09 Fair Housing Conference Registration Fee and the Annual Membership Dues for Stephen Nocera, in the amount of $80.00.

BITUMINOUS CONCRETE  #64
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to waive the bid process and purchase off the State Approved Bid Contract #09PSX0025 from O & G Industries for Bituminous Concrete Materials for the 2009 paving season per the Purchasing Agent's recommendation dated May 4, 2009. The prices are as follows:

Class 2     $75.72/ton±ESC.Net
Curb         $ 3.20/LF Net
Tack         $  4.95/GAL Net

SEWER CAPITAL IMPROVEMENT #72
On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council and Water Pollution Control Authority voted unanimously to authorize payment of $500.00 from Sanitary Sewer Capital Improvement Acct. #490 to Wright Pierce for Inv. #63272 dated April 21, 2009 for Final Design of Felicity Lane Pump Station.

PUBLIC HEARING SCHED. #78
On a motion by Councilor Dalla Valle, seconded by Councilor Waldron, the Council voted unanimously to schedule a Public Hearing for May 18, 2009 at 7:00 p.m. to set the Sewer User Fee for the period from July 1, 2009 and ending June 30, 2010.

HISTORICAL PRESERVATION GRANT #85
On a motion by Councilor Dalla Valle, seconded by Councilor Jerram, the Council voted unanimously to adopt a resolution authorizing the Mayor to enter into and sign a contract with the CT State Library for an Historical Preservation Grant, as amended from the agenda item of "Historical Preservation Grant Request".

On a motion by Councilor Soliani, seconded by Councilor Waldron, the Council voted unanimously to approve the following payments from the Municipal Renovations Fund #0316.

HOUSING REHAB. LOAN PROGRAM #108
On a motion by Councilor Colangelo, seconded by Councilor Waldron, the Council voted unanimously to approve payment from fund # 0250 to L. Wagner & Assocs. for professional services rendered for the period of 1/1/09 through 3/31/09 regarding the City's Housing Rehabilitation Loan Program in the amount of $2,437.50.

CITY HALL ADA RENOV. #114
On a motion by Councilor Jerram, seconded by Councilor Soliani, the Council voted unanimously to approve payment from fund # 0317 to L. Wagner & Associates for professional services rendered for the period of 1/1/09 through 3/31/09 regarding the 2008 Small Cities Block Grant for the City Hall ADA Renovations Project in the amount of $8,100.00.

On a motion by Councilor Waldron, seconded by Councilor Dalla Valle, the Council voted unanimously to open the meeting to the public on Agenda Items only. No one wished to speak.

BUSINESS BY DEPARTMENT HEADS #129
On a motion by Councilor Waldron, seconded by Councilor Dalla Valle, the Council voted unanimously to consider business by Department Heads.

Deputy Chief Giampaolo informed the Council of his reasons for choosing a local vendor for the purchase of 5-11 polo shirts.

BUSINESS BY MAYOR & CITY COUNCIL  #616
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to consider business by the Mayor and members of the City Council.

Councilor Colangelo inquired about Revaluation Progress. Mayor Bingham explained that we are waiting for OPM's response to a series of letters, the Board of Assessment Appeals are holding a significant amount of hearings everyday, and asked for volunteers to serve on that Board.

Councilor Dalla Valle said he was saddened by the accident on Mountain Rd that ruined the Senior Center Gardens Sign and some of the property as well.  He is looking forward to a banquet at the Elks & commended the Fishing Derby success.

Councilor Jerram said 92 children attended the Fishing Derby; David Kissel won the First Fish and Largest Fish award.

Mayor Bingham commended Councilor Carbone for her success with the Mayor's Committee on Youth.

EXECUTIVE SESSION: PENDING LITIGATION #821
On a motion by Councilor Jerram, seconded by Councilor Colangelo, the Council voted unanimously to enter executive session with Corporation Counsel Yuille Weaver under pending litigation at 6:55 p.m.

OPEN SESSION #842
On a motion by Councilor Waldron, seconded by Councilor Colangelo, the Council voted unanimously to enter open session at 7:20 p.m.

ADJOURNMENT #843
On a motion by Councilor Dalla Valle, seconded by Councilor Jerram, the Council voted unanimously to adjourn at 7:21 p.m.
