CITY COUNCIL & WPC AUTHORITY
DECEMBER 1, 2008
A REGULAR MEETING of the City Council & WPC Authority was held on Monday, December 1, 2008 in the Council Chambers.
Those in attendance included Mayor Ryan J. Bingham, City Councilors Michael Colangelo, Elinor Carbone, Marie P. Soliani, and Drake L. Waldron, Corp. Counsel Ernestine Yuille Weaver, and Superintendent of Parks & Recreation Brett Simmons. Councilors Rick E. Dalla Valle and Thomas C. Jerram were absent.
Mayor Bingham called the meeting to order at 6:30 p.m.
MINUTES #020
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to accept the minutes of the regular meeting held November 17, 2008.
OPEN TO THE PUBLIC #025
On a motion by Councilor Waldron, seconded by Councilor Colangelo, the board voted unanimously to open the meeting to the public. There was no public participation.
DESIGNATE THE USE OF MACHUGA PROPERTY #030
On a motion by Councilor Colangelo, seconded by Councilor Carbone, a discussion took place in regard to designating the use of the Machuga property as a park for the purposes of promoting recreational activities under the authority of the Park & Recreation Commission (Tabled on 11/17/2008).
Councilor Soliani suggested adding to the motion that the use of the Machuga property include passive, as well as active, activities, so that part of the property can be left open for walks, etc. instead of all the property being used as playing fields, etc.
AMEND MOTION #055
Councilor Colangelo amended his motion to include that the Machuga property be used for passive, as well as active, activities.
Councilor Waldron inquired whether the city was definitely acquiring the Leone property, and whether it would be included as part of this matter.
Mayor Bingham stated that it would most likely be a separate matter and that it was still up in the air because the city only received approximately $46,000.00 in grant funds from their request of $100,000.00.
The superintendent of Parks & Recreation Brett Simmons stated that they still have some work to do with some of the houses, which they plan to address as soon as possible.

The Council voted unanimously to designate the use of the Machuga property as a park for the purposes of promoting passive as well as active recreational activities under the authority of the Park & Recreation Commission.
WRIGHT-PIERCE #105
On a motion by Councilor Waldron, seconded by Councilor Colangelo, the Council, acting as the Water Pollution Control Authority, voted unanimously to authorize the payment of $2,000.00 from Sanitary Sewer Capital Improvement Account #490 to Wright Pierce for Invoice #60516 for 90% Design of Felicity Lane Pump Station.
APPOINTMENTS: BOARD OF ASSESSMENT APPEALS #110
On a motion by Councilor Soliani, seconded by Councilor Waldron, the Council voted unanimously to appoint the following members and alternates to the Board of Assessment Appeals:
A. Reappoint Kathleen Waltos for a 3-year term to expire in December 2011
B. Appoint Charles A. Hyres to replace Justin Giampaolo for a term to expire in December 2010.
C. Appoint Jo-Ann P. Fenty an as alternate
D. Appoint Gregg G. Cogswell as an alternate
APPOINTMENT: CONSTABLE #120
On a motion by Councilor Soliani, seconded by Councilor Colangelo, the Council voted unanimously to accept the recommendation from the Republican Town Committee to appoint Gerard Carbone to replace James Reginatto as Constable for a term to expire on 12/07/09.
APPOINTMENT: CONSTABLE #135
On a motion by Councilor Carbone, seconded by Councilor Waldron, the Council voted unanimously to accept the recommendation from the Democratic Town Committee to appoint Jeremy Kincaid to replace Joseph “Lefty” Silano as Constable for a term to expire on 12/07/09.
SMALL CITIES: TO DESIGN #145
On a motion by Councilor Waldron, seconded by Councilor Colangelo, the Council voted unanimously to authorize the payment of $2,625.00 from Small Cities Fund #0288 to To Design, LLC for Invoice # 2704 for professional services in regard to the Willow Gardens Senior Housing Project (Payment to be issued upon receipt of Drawdown #3).
SMALL CITIES: GM2 #150
On a motion by Councilor Soliani, seconded by Councilor Carbone, the Council voted unanimously to authorize the payment of $6,800.00 from Small Cities Fund #0288 to GM2 Associates, Inc. for Class A-2 & T-2 Improvement Location Survey and Map in regard to the Willow Gardens Senior Housing Project (Payment to be issued upon receipt of Drawdown #4).
SMALL CITIES: PREISS/BREISMEISTER #160
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to authorize the payment of $5,467.94 from Small Cities Fund #0288 to Preiss/Breismeister, P.C. for Invoice #02 for professional services in regard to the roof replacement at the Willow Gardens Senior Housing Project.
PUBLIC PORTION #165
On a motion by Councilor Waldron, seconded by Councilor Colangelo, the Council voted unanimously to open the meeting to the public on “agenda items” only. There was none.
BUS: DEPT. HEADS #170
On a motion by Councilor Colangelo, seconded by Councilor Waldron, the Council voted unanimously to consider business presented by Department Heads. There was none.
BUS: MAYOR & MEMBERS #175
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to consider business presented by Mayor Bingham and members of the City Council.
Mayor Bingham asked the Council to review the draft and proposed lease agreement between the City of Torrington and the Twisters which they were given a copy of, and to refer any questions or concerns to either himself or Corporation Counsel Weaver prior to their vote at the next City Council meeting scheduled for December 15th. He noted that the Parks & Recreation Commission will be furnishing them with a recommendation prior to their vote.
Mayor Bingham stated that the Christmas Tree lighting event in downtown Torrington on Friday evening was awesome.

On a motion by Councilor Colangelo, seconded by Councilor Waldron, the Council voted unanimously to adjourn at 6:45 p.m.
