                        SPECIAL MEETING OF THE
                         CITY COUNCIL & WPC AUTHORITY
                         APRIL 28, 2008               _________________________________________________________________________
              

A   SPECIAL  MEETING of the City Council & WPC Authority was held on Monday, April 28, 2008 in the Council Chambers.

Those in attendance included Mayor Ryan J. Bingham, City Councilors Elinor Carbone, Thomas C. Jerram, Marie P. Soliani, and Drake L. Waldron, Corp. Counsel Ernestine Yuille Weaver, Comptroller Alice Proulx, Public Works Director Gerald Rollett, Purchasing Agent Pennie Zucco, Zoning & Inland Wetlands Enforcement Officer Kimberly Barbieri, and Deputy Fire Chief Jaye Giampaolo.  Councilors Rick E. Dalla Valle and Michael Colangelo were absent.

Mayor Bingham called the meeting to order at  6:30 p.m.  

MINUTES #710
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council with the exception of Councilor Soliani who abstained, voted to accept the minutes of the special joint meeting with the Board of Safety held April 2.

On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to accept the minutes of the regular meeting held April 7.

On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council with the exception of Councilor Soliani who abstained, voted to accept the minutes of the special meeting held April 14 on budgets.

PUBLIC HEARING #740
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to schedule a public hearing for May 19, 2008 at 7:00 p.m. to set the Sewer User Fee for the period from July 1, 2008 and ending June 30, 2009.

DISPATCH & RADIO SYSTEM #745
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to accept the Board of Safety’s recommendation to waive the bid process and award the bid entitled “Centralize City’s Dispatch and Radio System” to Northwest Communications in the amount of $39,250.00.

COMMUNITY DEVELOPMENT ADMINISTRATOR #765
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to accept the Purchasing Agent’s recommendation to award the bid entitled “Small Cities’ Community Development Administrator” to L. Wagner & Asso.


SECTION 8-24: JOSEPH LEONI ESTATE #780
On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to accept the favorable Section 8-24 recommendation from the Planning & Zoning Commission to purchase 13 +/- acres of land currently part of the Joseph Leoni Estate located on Winsted Road.

Zoning & Inland Wetlands Enforcement Officer Kimberly Barbieri informed the Council that the Leoni property is directly adjacent to and south of the Torrington Machuga property.  The key component that the city is most interested in on the property is the long access section, a separate 40 feet of access way, that used to be the old trolley line.   By having access to the Harris Drive access, we would be able to access the Machuga Park from Machuga Drive through to Harris Drive, thereby creating a loop that could hook into the Stillriver Greenway.  The city would like to see the property as a preserved area.  Because it is zoned Industrial, there is a concern that a small business could develop the property.  If the city does not act on this matter, it will go out for open bid.  At this point, the estate has been very generous in working with the city and they are willing to sign an agreement with the city based on its ability to obtain an open space grant that is to be awarded sometime this fall.  The due date for the grant application is June 16, 2008 and they anticipate the acknowledgment of any award in late September or October.  

Mrs. Barbieri noted that she was also requesting the Council’s approval for  $5,750.00 to be submitted along with the grant application.

It was noted that no item may be added to the agenda because it’s a special meeting; therefore, that request will be handled at the next regularly scheduled Council meeting.
APPOINTMENTS:  EDC  #920
On a motion by Councilor Jerram, seconded by Councilor Waldron, the Council voted unanimously to approve the following appointments for the Economic Development Commission:
           Re-appoint William Battle to a 5 year term to expire in February 2013

           Appoint Cindy Donaldson to a 5 year term to fill a vacancy to expire in
            February 2013

           Appoint George Noujaim to a 5 year term to fill the remainder of a  
            vacancy to expire in February 2011.

SMALL CITIES:  CITY OF TORRINGTON #930
On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to authorize the payment of $500.00 from Small Cities Fund #0279 to the City of Torrington for the reimbursement of miscellaneous costs in regard to the 2005 Small Cities Grant for the Neighborhood Sidewalks and Pedestrian Safety Project.

SMALL CITIES:  CITY OF TORRINGTON #935
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to authorize the payment of $20.00 from Small Cities Fund #0250 to the City of Torrington as reimbursement for the Fair Housing Membership Fee.

SMALL CITIES:  RJB CONTRACTING #945
On a motion by Councilor Jerram, seconded by Councilor Soliani, the Council voted unanimously to authorize the payment of $24,290.46 from Small Cities Fund #0279 to RJB Contracting, Inc. for Payment Application #6 for work performed on the City’s Neighborhood Sidewalk Improvements Project.   To be paid upon receipt of funds from Drawdown #8. 

           SMALL CITIES:  RJB CONTRACTING #950
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to authorize the payment of $1,961.75 from Small Cities Fund #0279 to RJB Contracting, Inc. for Payment Application #7 for work performed on the City’s Neighborhood Sidewalk Improvements Project.

SMALL CITIES:  L WAGNER & ASSO. #960
On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to authorize the payment of $22,500.00 from Small Cities Grant #143-SC-05 to L. Wagner & Asso. for professional services rendered in the City’s 2005 Small Cities Grant for the Neighborhood Sidewalks & Pedestrian Safety Project.   To be paid upon receipt of funds from Drawdown #8.

SMALL CITIES:  REPUBLICAN AMERICAN #965
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to authorize the payment of $70.06 from Small Cities Fund #0250 to the Republican American for a Request for Proposal Ad placed for Small Cities Community Development Administrator for the 2008 Funding Round, Invoice #308171.

SMALL CITIES:  REGISTER CITIZEN #970
On a motion by Councilor Waldron, seconded by Councilor Carbone, the Council voted unanimously to authorize the payment of $398.00 from Small Cities Fund #0250 to the Register Citizen for the Legal Notices in regard to the Public Hearings concerning the 2008 Funding Round, Invoice #2265090.

SMALL CITIES:  NORTHEAST MINORITY NEWS #980
On a motion by Councilor Waldron, seconded by Councilor Jerram, the Council voted unanimously to authorize the payment of $144.00 from Small Cities Fund #0250 to Northeast Minority News, Inc. for Invoice #27284 for the Request for Proposal Ad for the Small Cities Community Development Administrator.

PROCLAMATION #985
On a motion by Councilor Waldron, seconded by Councilor Soliani, the Council voted unanimously to accept the Proclamation entitled Older Americans Month - May 2008.

ADJOURNMENT #1000
On a motion by Councilor Jerram, seconded by Councilor Carbone, the Council voted unanimously to adjourn at 6:48 p.m.
