CITY COUNCIL & WPC AUTHORITY
JANUARY 3, 2005
On Monday, January 3, 2005, a REGULAR MEETING of the City Council & WPC Authority was held in the Council Chambers.
Those in attendance included Councilor Marie P. Soliani, Acting Mayor in Mayor Quinn’s absence, City Councilors Thomas C. Jerram, Paul F. Samele, Jr., James F. McKenna, Paul W. Summers, and Drake L. Waldron, Corp. Counsel Albert Vasko, Director of Elderly Services Nancy Gyurko, and Personnel Director Thomas Gritt.
Councilor Soliani called the meeting to order at 6:34 p.m.
MINUTES #010
On a motion by Councilor Jerram, seconded by Councilor McKenna, the Council voted unanimously to approve the minutes of the regular meeting held December 20, 2004.
OPEN TO THE PUBLIC #020
On a motion by Councilor Jerram, seconded by Councilor Waldron, the Council voted unanimously to open the meeting to the public. There was no public participation.
SMALL CITIES: PROJECT #143-208 #040
On a motion by Councilor Jerram, seconded by Councilor McKenna, the Council voted unanimously to authorize a 3% Direct Loan in the amount of $47,960.00 from Small Cities SC2002 to Project #143-208 for roofing, siding, carpentry, and window work. (Tabled on 12/6 & 12/20.) Councilman Jerram stated he was assured that the property had equity to sustain the loan.
SMALL CITIES: PROJECT #143-212 #080
On a motion by Councilor Jerram, seconded by Councilor Summers, the Council voted unanimously to authorize a 0% deferred loan in the amount of $11,885.00 from Small Cities SC2002 to Project #143-212 for roofing and electrical work. (Tabled on 12/6 & 12/20.)
SMALL CITIES: PROJECT #143-215 #090
On a motion by Councilor Jerram, seconded by Councilor McKenna, the Council voted unanimously to authorize a 0% deferred loan in the amount of $37,550.00 from Small Cities SC2002 to Project #143-215 for roofing, windows, electrical, doors, carpentry, and masonry work. (Tabled on 12/6 & 12/20.)
COMPLETE CONST. CO. #100
On a motion by Councilor McKenna, seconded by Councilor Jerram, the Council voted unanimously to authorize the payment of $29,107.74 from Sanitary Sewer Capital Improvement Fund #490 to Complete Construction Co. for work performed on the East Main Street Sanitary Sewer Project and referred it to the Board of Finance.
RESOLUTION: SENIOR CENTER #105
On a motion by Councilor Jerram, seconded by Councilor McKenna, the Council voted unanimously to adopt a resolution and agreement between the State of Connecticut and the City of Torrington - Sullivan Senior Center for a cash grant toward the purchase of a wheelchair accessible motor vehicle for Services to the Elderly and/or Disabled persons. FTA Grant # CT-16-0030.
AGREEMENT BETWEEN THE STATE OF CONNECTICUT
AND THE CITY OF TORRINGTON / SULLIVAN SENIOR CENTER FOR A CASH GRANT TOWARD THE PURCHASE OF WHEELCHAIR ACCESSIBLE MOTOR VEHICLE(S) FOR SERVICES THE ELDERLY AND/OR DISABLED PERSONS
FTA GRANT NO. CT-16-0030 - STATE PROJECT NO. 170-2582
RESOLUTION
Resolved that Owen J. Quinn, be and hereby is, authorized to sign the agreement entitled Agreement Between the State of Connecticut and the City of Torrington / Sullivan Senior Center for a Cash Grant Toward the Purchase of Wheelchair Accessible Motor Vehicle(s) for Services to Elderly and/or Disabled Persons. Said Mayor is hereby further authorized to execute any and all amendments or addendums to said agreement.
Adopted by the Board of Councilmen of the City of Torrington this 3rd day of January, 2005.

SMALL CITIES: RECORD JOURNAL #110
On a motion by Councilor McKenna, seconded by Councilor Jerram, the Council voted unanimously to authorize the payment of $357.12 to The Record Journal of Wallingford, CT. from Small Cities account 0275.5910.0000, for two invitation to bid ads for 12 Chestnut Ave and 111 Yale Ave.
SMALL CITIES: SAFE HOMES INC. #120
On a motion by Councilor Jerram, seconded by Councilor Waldron, the Council voted unanimously to authorize the payment of $750.00 to Safe Homes Inc. of Waterbury, CT from Small Cities account 0275.5910.0000, for three risk assessments done with regard to 63 Hoffman Street.
SMALL CITIES: SAFE HOMES INC. #200
On a motion by Councilor Jerram, seconded by Councilor McKenna, the Council voted unanimously to authorize the payment of $750.00 to Safe Homes Inc. of Waterbury, CT from Small Cities account 0275.5910.0000 for 1 risk assessment, 7 soil samples, 1 fed-ex charge and 1 abatement plan with regard to 267 Patterson Street.
GORDON, MUIR & FOLEY #200
On a motion by Councilor McKenna, seconded by Councilor Jerram, the Council voted unanimously to authorize the payment of $330.00 from Contingency to Gordon, Muir & Foley, LLP for professional services rendered in the Southwest School matter and referred it to the Board of Finance.
BOGUE ROAD BRIDGE #215
On a motion by Councilor Jerram, seconded by Councilor McKenna, the Council voted unanimously to authorize Mayor Quinn to execute the agreement with the town of Harwinton for the restoration and repair of the Bogue Road Bridge. Each town will pay for its share according to a formula set up by the state.
GRIEVANCE #250
On a motion by Councilor Waldron, seconded by Councilor McKenna, the Council voted unanimously to table until February 7th, the Public Works Grievance #04-07 until they were able to get more information from the Superintendent of Streets, who was unable to attend the Personnel Committee meeting.
BUS: DEPT. HEADS #290
On a motion by Councilor Jerram, seconded by Councilor McKenna, the Council voted unanimously to consider business presented by Department Heads. There was none.
BUS: MAYOR & MEMBERS #310
On a motion by Councilor McKenna, seconded by Councilor Jerram, the Council voted unanimously to consider business presented by the Acting Mayor and members of the City Council.
Councilor Jerram reminded the public to shovel their sidewalks within the allotted time after the end of a storm. He thought perhaps the ordinance could be reviewed during the next meeting.
Councilor Soliani commended the Magnificent Seven properties whose owners were awarded a plaque by Mayor Quinn.
EXECUTIVE SESSION: PENDING LITIGATION #515
On a motion by Councilor Jerram, seconded by Councilor McKenna, the Council voted unanimously to go into executive session under pending ligation at 6:50 p.m.

OPEN SESSION
On a motion by Tom Jerram, seconded by James McKenna, the board reconvened into Open Session at 7:00 p.m.
BISMARK LAWSUIT
On a motion by James McKenna, seconded by Tom Jerram, the Board authorized the Corporation Counsel to settle the Bismark Construction Company vs. City of Torrington lawsuit as follows: a payment of the $20,000.00 retainer owed to Bismark on the project and $95,000.00 in full and final settlement of its claims against the city, and referred it to the Board of Finance for approval.
On a motion by Tom Jerram, seconded by James McKenna, the Board adjourned at 7:01 p.m.
