                  CITY COUNCIL & WPC AUTHORITY
                  OCTOBER 24, 2002

A   SPECIAL  MEETING  of the City Council & WPC Authority was held on Thursday, October 24, 2002, in the Council Chambers.

Present were Mayor Owen J. Quinn, Jr., City Councilors Anne L. Ruwet, Paul F. Samele, Jr., Marie P. Soliani, David M. Bascetta, Richard E. Dalla Valle, and James D. Reginatto; Corp. Counsel Albert Vasko, and City Engineer Edward Fabbri.

\       Mayor Quinn called the meeting to order at 7:09 p.m.

EAST MAIN STREET SEWER PROJECT #030

City Engineer Ed Fabbri stated that all bids for the lower East Main Street Sewer Project were rejected and that he and Mr. Rollett had since met with W. W. Manchester Construction Co. to value engineer the project in order to reduce the dollar amount.

Based on new ideas from W. W. Manchester, Mr. Fabbri and Mr. Rollett recommended the acceptance of the new proposal at a cost of $158,450.75.   Mr. Fabbri indicated that the project was not going to be easy and that he and Mr. Rollett were confident that W. W. Manchester would do quality work and complete it in a timely manner.     

On a motion by Councilor Bascetta, seconded by Councilor Dalla Valle, the Council voted unanimously to award the contract for the Lower East Main Street Sewer Project to W. W. Manchester at a cost of $158,450.75.

D’ANDREA  MATTER #180

Mayor Quinn noted that the D’Andrea matter was on this agenda because he failed to request that this item be included on the October 21, 2002 agenda and because the motion to add it to the October 21 agenda failed to get a 2/3rds majority vote.

Mayor Quinn noted that the Council had heard much testimony from area residents, Robert D’Andrea and Atty. McHugh, the city’s attorney in this matter.   

Councilor Dalla Valle made a motion to go into Executive Session under Pending Litigation, inviting both, Atty. McHugh and Mr. D’Andrea to attend.  Councilor Soliani seconded the motion.   The Council voted in favor of the motion, with the exception of Councilors Bascetta and Ruwet who opposed.  On a 4-2 vote, the motion carried.

The Board went into Executive Session at 7:17 p.m.

OPEN SESSION #315

On a motion by Councilor Dalla Valle, seconded by Councilor Ruwet, the Council voted unanimously to reconvene into Open Session at 8:04 p.m.

Mayor Quinn told those in attendance that the Council had the opportunity to talk to the attorney representing the city, Randall McHugh, as well as Atty. D’andrea who represented his own interest as a developer.   City Attorney Albert Vasko was present at all times.

        Councilor Ruwet made a motion for the City of Torrington to appeal the 3-2 decision of the Supreme Court on the D’Andrea matter and petition the Supreme Court to hear that case by its full membership.   Councilor Bascetta seconded the motion.  Councilors Ruwet, Samele and Bascetta voted in favor of the motion.  Councilors Soliani, Dalla Valle and Reginatto opposed the motion.  On a 3-3 tie vote, Mayor Quinn voted in favor of the motion.   Motion carried.

ADJOURNMENT #410

On a motion by Councilor Dalla Valle, seconded by Councilor Ruwet, the Council voted unanimously to adjourn at 8:08 p.m.
