PUBLIC HEARING
CITY COUNCIL & WPC AUTHORITY
JUNE 5, 2017

A PUBLIC HEARING to review and discuss proposals for participation in the 2017 Neighborhood Assistance Act was held by the City Council & WPC Authority in the City Hall Auditorium on Monday, June 5, 2017.  Present were Mayor Elinor Carbone, City Councilors Paul Cavagnero, Gregg Cogswell, Daniel Farley, and Luisa Noujaim. City Councilors Anne Ruwet and Drake Waldron were absent.  Also present were Superintendent of Parks and Recreation Brett Simmons, Zoning Enforcement Officer Rista Malanca, Water Pollution Control Administrator Raymond Drew, Deputy Police Chief Christopher Smedick and Deputy Fire Chief Christopher Pepler, along with Forester Andrew J. Bosse.

Mayor Carbone called the public hearing to order at 6:36 p.m. starting with the Pledge of Allegiance.  City Clerk Joseph Quartiero read the legal notice.  There was no one present who wished to speak.  Mayor Carbone closed the public hearing at 6:38 p.m.

REGULAR MEETING

A REGULAR MEETING of the City Council & WPC Authority was held immediately after the Public Hearing.

Mayor Carbone called the meeting to order at 6:38 p.m.

Neighborhood Assistance Act
On a motion by Councilor Farley, seconded by Councilor Cogswell, the Council voted unanimously by roll call vote to accept the proposals for the participation in the 2017 Neighborhood Assistance Act.

Minutes
On a motion by Councilor Farley, seconded by Councilor Noujaim, the Council voted unanimously to accept the minutes for the Special Joint Meeting with the Board of Finance and the Board of Public Safety held May 15, 2017.

On a motion by Councilor Cogswell, seconded by Councilor Farley, the Council voted unanimously to accept the minutes for the Public Hearing to set the Sewer Use Fee held May 15, 2017.

On a motion by Councilor Cogswell, seconded by Councilor Noujaim, the Council voted unanimously to accept the minutes for the Regular Meeting held May 15, 2017.

Open To Public  
On a motion by Councilor Farley, seconded by Councilor Cogswell, the Council voted unanimously to open the meeting to the public.  There was no one present who wished to speak.

East Sewer Basin Rehab Project - Payments
Acting Herein as the Water Pollution Control Authority, on an amended motion by Councilor Cogswell, seconded as amended by Councilor Farley, the Council voted unanimously to approve the following payments from Fund #490 Sanitary Sewer Capital Improvement for Capital Project D-2Ab East Sewer Basin Rehabilitation Project, Capital Project D-14 Capacity Management Operation and Management Plan (CMOM).

Community Sewerage System
Acting Herein as the Water Pollution Control Authority, on a motion by Councilor Farley, seconded by Councilor Cogswell, the Council voted unanimously to authorize the Mayor to execute the “Maintenance Agreement By and Between the City of Torrington Water Pollution Control Authority and The Hemlocks Manufactured Housing Community” to ensure the effective operation and management of the Community Sewerage System.  

Mr. Drew explained that this agreement allows the City to comply with CGS Chapter 103, which requires the WPCA to abate pollution in any community sewerage system, should that community fail to do so.  He said it includes a mechanism that allows the City to recover any costs.  

Councilor Cavagnero requested that any future motions of this type have very precise language regarding the City’s obligations.

Presentation & Discussion – Draft Forest Management Plan
Ms. Malanca, Mr. Simmons and Mr. Bosse reviewed the Charlene Susan Besse Park plan.

Resolution – Torrington Youth and TPD
On a motion by Councilor Cogswell, seconded by Councilor Farley, the Council voted unanimously to adopt Resolution #143-17-11 authorizing the Mayor or Chief of Police to sign a Police and Youth Program grant award, as follows:
RESOLVED, that either Elinor Carbone, Mayor, or Michael Maniago, Chief of Police, are hereby authorized to sign and execute, on behalf of the Torrington Police Department, a grant for the Torrington Police and Youth on a Mission Program from the Connecticut Office of Policy and Management, in the amount of $10,000, complying with all attached Grant Conditions.

Fire Dept. Testing Svcs.
Pending Board of Public Safety Approval on June 7, 2017, on a motion by Councilor Cogswell, seconded by Councilor Farley, the Council voted unanimously to accept the Fire Chief’s, Deputy Fire Chief’s and Purchasing Agent’s recommendation and authorize the Mayor to award, execute and administer a contract with Resource Management Associates, Inc. of Tinley Park, IL, for Promotion Testing Services for the Fire Department for the amount of $19,950.00.

Police Dept. Protective Gear
Pending Board of Public Safety Approval on June 7, 2017, on a motion by Councilor Farley, seconded by Councilor Noujaim, the Council voted unanimously to accept Lt. Rouleau’s and the Purchasing Agent’s recommendation and authorize the Mayor to award by line item, and execute and administer a contract for Protective Police Gear, as follows:
Keisler Police Supply of Jeffersonville, IN, for the annualized estimate of $16,385.10
Connecticut Police Supply of Newington, CT, for the annualized estimate of $3,502.50

Release Tax Liens
On a motion by Councilor Cogswell, seconded by Councilor Farley, the Council voted unanimously to accept Corporation Counsel’s recommendation and authorize the Mayor, pursuant to CGS §12-179, to release the sewer use lien liens described in Atty. LaMere’s Revised Memo dated June 5, 2017.

Tax Collector Tax Refunds
On a motion by Councilor Farley, seconded by Councilor Noujaim, the Council voted unanimously to accept the recommendation of the Tax Collector and authorize the 17 tax refunds indicated on the list dated June 5, 2017.

Tax Collector Sewer Usage Fee Refunds
Herein acting as the Water Pollution Control Authority, on a motion by Councilor Cogswell, seconded by Councilor Farley, the Council voted unanimously to accept the recommendation of the Tax Collector and authorize the seven sewer usage fee refunds indicated on the list dated June 5, 2017.

Small Cities
On a motion by Councilor Cogswell, seconded by Councilor Farley, the Council voted unanimously to approve the following payments from Small Cities Fund #272:

Building Dept.
On a motion by Councilor Cogswell, seconded by Councilor Farley, the Council voted unanimously to accept the Building Department Report for April, 2017.

Business by Dept. Heads
On a motion by Councilor Farley, seconded by Councilor Cogswell, the Council voted unanimously to consider business presented by Department Heads.  No business was presented.

Fire Dept. Radio Communication Equip.
Pending Board of Public Safety Approval on June 7, 2017, on a motion by Councilor Farley, seconded by Councilor Noujaim, the Council voted unanimously to accept the Fire Chief’s, Deputy Fire Chief’s and Purchasing Agent’s recommendation to waive the bid process and authorize the Mayor to award, execute and administer a contract for the purchase of Radio Communication Equipment to replace 17 units, from Marcus Communications of Manchester, CT, off State Contract #14PSX0073 for a total cost of $14,878.40.

Business:  Mayor & Members
On a motion by Councilor Cogswell, seconded by Councilor Noujaim, the Council voted unanimously to consider business presented by the Mayor and members of the City Council.  Councilor Farley commended the Torrington/Winsted Pet Parade.

Open to Public: Agenda Items Only
On a motion by Councilor Cogswell, seconded by Councilor Farley, the Council voted unanimously to open the meeting to the public to discuss agenda items only.  Sharon Wagner noted that the Latino Women’s Assn. recognized Officer Tony Pietrafesa and Denise Linden from NW Community College for their service to the community.

Adjournment
On a motion by Councilor Cogswell, seconded by Councilor Farley, the Council voted unanimously to adjourn at 7:37 p.m.
