PUBLIC HEARING
CITY COUNCIL & WPC AUTHORITY
April 17, 2017

A PUBLIC HEARING was held by the City Council & WPC Authority in the City Hall Auditorium on Monday, April 17, 2017 To consider the adoption of a proposed City Ordinance prohibiting vehicle repair in city streets.

Those in attendance included Mayor Elinor Carbone, Corporation Counsel Jaime LaMere and City Councilors Paul Cavagnero, Gregg Cogswell, Anne Ruwet, Daniel Farley, Luisa Noujaim and Drake Waldron.  Public Works Director Gerald Rollett was also present.

Mayor Carbone called the public hearing to order at 6:30 p.m.  

City Clerk Joseph Quartiero read the legal notice.

“NOTICE IS HEREBY GIVEN, that the Board of Councilmen of the City of Torrington will hold a public hearing on Monday, April 17, 2017, at 6:30 p.m. in the City Hall Auditorium, 140 Main St., Torrington, CT to solicit public comment regarding the proposed addition to City Ordinances Chapter §180, prohibiting vehicle repair in city streets.  All interested parties are invited to attend and be heard.  Dated at Torrington, Connecticut, this 11th day of April, 2017.”

There was no one present who wished to speak.

Mayor Carbone closed the public hearing at 6:32 p.m.

REGULAR MEETING
CITY COUNCIL & WPC AUTHORITY

A REGULAR MEETING was held by the City Council & WPC Authority in the City Hall Auditorium on Monday, April 17, 2017.

Mayor Carbone called the meeting to order at 6:35 p.m., starting with the Pledge of Allegiance.

Ordinance 180-19.1, Vehicle Repair in Street Prohibited
On an amended motion by Councilor Cogswell, seconded as amended by Councilor Ruwet, the Council voted unanimously by roll call vote to add the following to the Code of Ordinances Chapter 180, Streets and Sidewalks, Article IV, Obstructions, Section 19, Structures, materials or substances prohibited:

§180-19.1, Vehicle Repair in Street Prohibited

A.       No person shall disassemble, assemble, repair, maintain or alter, except in an emergency, any vehicle within the city on any road, street, public passway, parkway, highway or upon any area used for vehicular travel.
B.      Any person who violates this section shall receive a written verbal warning for the first offense and shall remove said vehicle within 24 hours of receipt of the written verbal warning.  
C.      Any person who subsequently violates this section shall be fined $45.00 for a second offense of this section and $90.00 for a third offense and each offense thereafter.
Minutes
On a motion by Councilor Waldron, seconded by Councilor Farley, the Council voted unanimously to accept the minutes of the Regular Meeting held April 3, 2017.

On a motion by Councilor Waldron, seconded by Councilor Noujaim, the Council voted unanimously to accept the minutes of the Special Meeting held April 5, 2017.

On a motion by Councilor Waldron, seconded by Councilor Cogswell, the Council voted unanimously to accept the minutes of the Special Meeting held jointly with the Board of Public Safety on April 5, 2017.

Open to Public  
On a motion by Councilor Ruwet, seconded by Councilor Farley, the Council voted unanimously to open the meeting to the public.  There was no one present who wished to speak.

Electrical Services
On a motion by Councilor Waldron, seconded by Councilor Farley, the Council voted unanimously to accept the Purchasing Agent’s recommendation and authorize the Mayor to extend the current bid contract for FY17/18 with Connole’s Electric, LLC of Torrington with the current pricing of $52 per hour for Journeymen and $34 per hour for Apprentice.

Downtown Garden Beds & Planters
On a motion by Councilor Waldron, seconded by Councilor Noujaim, the Council voted unanimously to accept the Purchasing Agent’s recommendation and authorize the Mayor to award, administer and execute a contract with Still River Gardens, LLC of Litchfield for the maintenance of downtown garden beds and planters for $10,467.

Municipal Refuse & Recyclable Collection
On a motion by Councilor Ruwet, seconded by Councilor Farley, the Council voted unanimously to authorize
the Mayor to execute a three-year contract extension of the Municipal Refuse and Recyclable Material Collection contract with USA Hauling & Recycling.  Mr. Rollett explained that this year’s savings would be $53,616, next year’s savings would be similar. He said they have provided very good service.

E. Sewer Basin Rehab. Project
Acting herein as the Water Pollution Control Authority, on a motion by Councilor Waldron, seconded by Councilor Cogswell, the Council voted unanimously to approve the following payments from Fund #490 Sanitary Sewer Capital Improvement for Capital Project D-2Ab East Sewer Basin Rehabilitation Project, Capital Project D-14 Capacity Management Operation and Management Plan (CMOM) and Capital Project D-1Aa Central Drainage Basin SSES.

Small Cities Invoices
On a motion by Councilor Waldron, seconded by Councilor Noujaim, the Council voted unanimously to approve a payment of $118.32 from Fund #250 to the Republican-American for a Program Income Amendment Notice placed for the Small Cities Program.

FY16/17 Budget Amendments/Transfers
On a motion by Councilor Waldron, seconded by Councilor Farley, the Council voted unanimously to approve the FY16/17 Budget Amendments and Transfers requested in the Comptroller’s Memo dated April 12, 2017, pending Board of Finance authorization on April 18, 2017.

Tax Collector Tax Refunds
On a motion by Councilor Waldron, seconded by Councilor Ruwet, the Council voted unanimously to accept the recommendation of the Tax Collector and authorize the eight tax refunds indicated on the list dated April 17, 2017.

Tax Collector Sewer Usage Fee Refunds
Herein acting as the Water Pollution Control Authority, on a motion by Councilor Farley, seconded by Councilor Cogswell, the Council voted unanimously to accept the recommendation of the Tax Collector and authorize the six sewer usage fee refunds indicated on the list dated April 17, 2017.

Building Dept. Report
On a motion by Councilor Waldron, seconded by Councilor Farley, the Council voted unanimously to accept the Building Department Report for March 2017.

Business by Dept. Heads
On a motion by Councilor Farley, seconded by Councilor Ruwet, the Council voted unanimously to consider business presented by Department Heads.  No business was presented.

Business:  Mayor & Members
On a motion by Councilor Waldron, seconded by Councilor Cogswell, the Council voted unanimously to consider business presented by the Mayor and members of the City Council.  Mayor Carbone reminded everyone about the upcoming Earth Day Cleanup, the Spring Yard Waste Pickup and the upcoming Board of Education Budget hearing.  She reported on a recently submitted application for another round of funding for the Housing Rehabilitation Program and urged all to look at Five Points Gallery’s partnership with the University of Hartford for studio/gallery space for postgraduate students.  Mayor Carbone also reported on two recent visits from the State Dept. of Economic and Community Development.

Open to Public: Agenda Items Only
On a motion by Councilor Ruwet, seconded by Councilor Waldron, the Council voted unanimously to open the meeting to the public to discuss agenda items only.  There was no one present who wished to speak.

Adjournment
On a motion by Councilor Waldron, seconded by Councilor Cogswell, the meeting adjourned at 6:52 p.m.
