REGULAR MEETING
CITY COUNCIL & WPC AUTHORITY
January 17, 2017

A REGULAR MEETING was held by the City Council & WPC Authority in the City Hall Auditorium on Tuesday, January 17, 2017.

Those in attendance included Mayor Elinor Carbone and City Councilors Gregg Cogswell, Anne Ruwet, Drake Waldron, Luisa Noujaim and Daniel Farley.  City Councilor Paul Cavagnero was absent. Also present were Mayoral Aide Timothy Waldron, WPC Administrator Ray Drew and City Engineer Ed Fabbri.

Mayor Carbone called the meeting to order at 6:30 p.m. starting with the Pledge of Allegiance.

MINUTES
On a motion by Councilor Noujaim, seconded by Councilor Cogswell, the Council voted unanimously to accept the minutes of the Regular Meeting held December 19, 2016.

On a motion by Councilor Waldron, seconded by Councilor Noujaim, the Council voted unanimously to accept the minutes of the Special and Telephonic Meeting held January 5, 2017.  Councilors Farley and Ruwet abstained.

OPEN TO PUBLIC  
On a motion by Councilor Waldron, seconded by Councilor Ruwet, the Council voted unanimously to open the meeting to the public.  There was no one present to wished to speak.

EAST SEWER BASIN REHABILITATION PROJECT
Herein acting as the Water Pollution Control Authority, on a motion by Councilor Waldron, seconded by Councilor Noujaim, the Council voted unanimously to approve a payment of $6100.00 from Fund #490 Sanitary Sewer Capital Improvement for Capital Project D-2Ab East Sewer Basin Rehabilitation Project, Inspection Services, to Walter Combes for Payment Requisition #2.

PURCHASE ULTRAVIOLET DISINFECTION SYSTEM
Herein acting as the Water Pollution Control Authority, on a motion by Councilor Cogswell, seconded by Councilor Ruwet, the Council voted unanimously to accept the recommendation of the WPCA Administrator, and Wright-Pierce to award the purchase of the Ultraviolet Disinfection System as part of the comprehensive upgrade of the WPCF to Suez Treatment Solutions Inc. as approved by CTDEEP.

PURCHASE BALLASTED FLOCCULATION TERTIARY TREATMENT SYSTEM
Herein acting as the Water Pollution Control Authority, on a motion by Councilor Ruwet, seconded by Councilor Farley, the Council voted unanimously to accept the recommendation of the WPCA Administrator, and Wright-Pierce to award the purchase of the Ballasted Flocculation Tertiary Treatment System as part of the comprehensive upgrade of the WPCF to I. Kruger Inc. as approved by CTDEEP.

RESOLUTION: PAVING NEWFIELD RD.
On a motion by Councilor Waldron, seconded by Councilor Noujaim, the Council voted unanimously to adopt Resolution #143-17-1 supporting he Rural Collector-Surface Transportation Program project titled “Paving Newfield Road from South of Saw Mill Hill Road Intersection To Winchester Town Line”, and a commitment to funding the municipal share, as follows:   

The Newfield Road paving project spanning approximately 7690 feet from a point approximately 800 feet south of the Saw Mill Hill Road intersection (where State Project No. 143-187 terminated), north to the Winchester Town Line.     
WHEREAS, the City of Torrington has published a news release, mailed a copy of the news release to required officials and agencies, and mailed a notification letter to abutting property and business owners and tenants, announcing a proposed transportation project titled “Paving Newfield Road From South Of Saw Mill Hill Road Intersection To Winchester Town Line”; and
 
WHEREAS, a public comment period was given from December 16, 2016 to January 3, 2017 which allowed interested parties to voice their concerns; and  
 
WHEREAS, the engineering phase will be funded exclusively by the City of Torrington and the construction phase will be funded utilizing 80% Federal funds, 10% State Funds and 10% municipal funds; and
 
WHEREAS, the Northwest Hills Council of Governors has selected this project as a regional priority and to utilize federal and state funds for construction activities; and
 
WHEREAS, the Mayor, Elinor C. Carbone has considered the concerns of the residents from the public comment period and finds that the proposed Newfield Road Paving Project is in the best interest of the City of Torrington, and will promote the health, safety and general welfare of its residents and provide for convenience and safety of the traveling public.  
 
WHEREAS, the City of Torrington, based on the above information, and by virtue of this resolution, hereby fully supports the proposed project;
 
NOW, THEREFORE, BE IT RESOLVED, that the City of Torrington hereby supports the Rural Collector-Surface Transportation Program project titled “Paving Newfield Road from South Of Saw Mill Hill Road Intersection To Winchester Town Line”, and hereby commits to funding the municipal share.  

SMALL CITIES GRANT PROGRAM

On a motion by Councilor Farley, seconded by Councilor Cogswell, the Council voted unanimously to table consideration of the Small Cities Community Development Program Administrator to later in the meeting.

Subordination for V. Borelli
On a motion by Councilor Waldron, seconded by Councilor Noujaim, the Council voted unanimously to accept the recommendation of the Small Cities Committee and approve a subordination for V. Borelli.

ADD TO AGENDA
On a motion by Councilor Waldron, seconded by Councilor Ruwet, the Council voted unanimously to add to the agenda.
SMALL CITIES GRANT PROGRAM
Project #143-467        
On a motion by Councilor Waldron, seconded by Councilor Farley, the Council voted unanimously to accept the recommendation of the Small Cities Committee and approve Project #143-467.

TAX COLLECTOR TAX REFUNDS
On a motion by Councilor Waldron, seconded by Councilor Cogswell, the Council voted unanimously to accept the recommendation of the Tax Collector and authorize the following (80) tax refunds:
  • 7 taxpayers on list dated 12/19/2016
  • 9 taxpayers on list dated 1/3/2017
  • 34 taxpayers on list dated 1/17/2017
  • 30 taxpayers on list dated 1/17/2017a
TAX COLLECTOR SEWER USAGE FEE REFUNDS
Herein acting as the Water Pollution Control Authority, on a motion by Councilor Waldron, seconded by Councilor Ruwet, the Council voted unanimously to accept the recommendation of the Tax Collector and authorize the 1 sewer usage fee refund indicated on the list dated December 19, 2016.

BUILDING DEPARTMENT REPORT
On a motion by Councilor Waldron, seconded by Councilor Cogswell, the Council voted unanimously to accept the Building Department Reports for November and December, 2016.

SMALL CITIES GRANT PROGRAM
Program Administrator
On a motion by Councilor Waldron, seconded by Councilor Cogswell, the Council voted unanimously to authorize the Mayor to award the Small Cities Community Development Program Administrator to L. Wagner & Assocs., Inc. of Waterbury, CT.  Councilor Farley abstained.

BUSINESS BY DEPT. HEADS
On a motion by Councilor Waldron, seconded by Councilor Ruwet, the Council voted unanimously to consider business presented by Department Heads.  No business was presented.

City Clerk Joseph Quartiero reported that Asst. City Clerk Carol Anderson has completed her Master Municipal Clerk Certification.  Mayor Carbone presented a Certificate of Achievement.

BUSINESS:  MAYOR & MEMBERS
On a motion by Councilor Waldron, seconded by Councilor Farley, the Council voted unanimously to consider business presented by the Mayor and members of the City Council.  No business was presented.


OPEN TO PUBLIC: Agenda Items Only
On a motion by Councilor Waldron, seconded by Councilor Cogswell, the Council voted unanimously to open the meeting to the public to discuss agenda items only.  There was no one present who wished to speak.

ADJOURNMENT
On a motion by Councilor Waldron, seconded by Councilor Ruwet, the Council adjourned at 7:10 p.m.
