MINUTES
       BOARD OF PUBLIC SAFETY
        FEBRUARY 4, 2009

A   SPECIAL  MEETING   of the Board of Public Safety was held on Wednesday, February 4, 2009, in the Council Chambers.

Those in attendance included Mayor Ryan J. Bingham, members of the Board of James Potter, Gerald Zordan, Douglas Benedetto, and Christopher Cook, and Corporation Counsel Ernestine Yuille Weaver, Police Chief Robert Milano, and Deputy Police Chief Michael Maniago. Commissioner Robert Zordan and Richard Zaharek were absent.  Also present were Atty. Francis J. Grady and Former Police Officer Richard Cerutti.

Mayor Bingham called the meeting to order at 6:30 p.m.

EXEC. SESSION: PENDING LITIGATION #106
On a motion by Commissioner Gerald Potter, seconded by Commissioner Benedetto, the board voted unanimously to enter executive session under pending litigation. Police Chief Milano, Deputy Police Chief Maniago and Atty. Weaver were invited to attend.

OPEN TO THE PUBLIC #142
On a motion by Commissioner G. Zordan, seconded by Commissioner Potter, the board voted unanimously to open the meeting to the public.

Atty. Grady stated he preferred there be a record of this meeting, and asked the  Board to stay out of executive session under Personnel. He said at the last         meeting he submitted a waiver signed by Former Officer Cerutti indicating he  had no objections to discussing his medical conditions in the public arena.

DISABILITY PENSION: RICHARD CERUTTI #183
On a motion by Commissioner Benedetto, seconded by Commissioner G. Zordan, the Board discussed disability pension for Former Officer Cerutti.
Mayor Bingham clarified the motion that a vote in the affirmative would allow Former Officer Cerutti the disability pension, disqualifying him from performing any kind of police work including light duty based on the information presented.

The Board was unanimously opposed, the motion failed.

        ADJOURN #703
        A motion to adjourn at 6:58 p.m. was made by Commissioner Potter, seconded by Commissioner Benedetto.
