MINUTES OF SELECTMEN MEETING – September 13, 2010 5:05 PM

Minutes of the previous meeting were read and accepted.
Wayne presented a bid for the paving of Colebrook River Road. Colebrook River Road will be reclaimed and paved from Beetle Road to Rivers Road. A bid was received from Lane Construction in the amount of $89,775.00. The cost per ton binder is $66.50 with the number of tons being 1350. Bid accepted.
The Board met with Richard Dziedzic to discuss the exchange of his driveway for equal amounts of the town’s property where his leaching field is located. The exchange would help with the “right of way” to the town’s property and give him ownership of the property where his leach field is located. Mr. Dziedzic was asked to have his surveyor give exact dimensions of the property. A Special Town Meeting will be scheduled.
The Board of Selectmen would like to met with Louis Lodovico and will be requesting that he attend the Selectmen’s meeting of Monday, September 20th. The board would like to discuss the “Right of Ways” that are located on his property.
Wayne Carr attended a meeting on September 8th regarding the Otis dam. Wayne will attend all meetings relating to the project. A special meeting will be scheduled to discuss snow removal. The Otis Reservoir will have an early drawdown starting September 15th and the road will be closed on October 15th.
Francis Deming expressed some concerns with the sale of the Twining Properties. The sale is a private sale and the Board of Selectmen has no authority over the sale. The dam will be the responsibility of the current owner or if sold the new owner. The Board stated that the DEP will step in if the dam is not maintained. Francis was also concerned that the maps show his property included within the sale. The Selectboard advised him to review his deeds for verification.
Susan Voudren informed the board that the Board of Assessors is ready to hold the Classification Hearing and the Selectboard needs to schedule. The board will schedule the hearing for next Monday, September 20, 2010.
John Verones, Project Manager received a letter from Jeremia Pollard of Hannon Lerner, Tolland’s legal counsel. The letter gave his evaluation of restrictions found in a deed with respect to the parcel that the Town of Tolland has designated as the site for the construction of its Public Safety Complex. (see below)
The Selectmen received a copy of a letter from Jeffrey Parrette that was sent to the Tolland Planning Board regarding the application for a cell tower on Harvey Mountain Road. The letter was read and taken under advisement.
An email was received from Police Chief Munson asking/notifying the board that he would like to sponsor Blake Middleton of the Town of Otis. He will be attending the Police Academy on a part time basis. The sponsorship has no financial responsibility or the intent to hire to the Town of Tolland.
The Berkshire Trail riders Recreational Trail Ride will be holding a trail ride/fundraiser event on September 18th & 19th.
“It appears that the relevant restrictions have expired by operation of law. However, my recommendation at this point is to purchase an owner’s policy of title insurance to guard against any title issues that may arise in this regard.”
