Roll Call: Spencer, Campbell, Lopes, Abreau, and Medeiros.  Meeting opens at 5:36 PM.  Also present City Engineer Mark Slusarz.  

Arthur made motion to accept minutes of November 4, 2010 seconded by Tony. All in favor.

Joshua Lane Estates – E-5 Final Release of Surety – holding $30,000 plus $1,500 Mylar Deposit – All lots released –submitted by A.J. Marshall  
 A.J. Marshall stated his subdivision is all done, all 4 houses are up and he just needs to have final paving done and that will be done this weekend. He is requesting all monies, except $5,000 be released and he will forward the as-builts to the City once they are completed by Paul Patneaude.  He also has to get the C.O.C. from Conservation Commission.   He stated this subdivision was approved prior to the outside consultant inspection rules went into effect.  City Engineer Mark Slusarz did an inspection this week and he’s fine with releasing all monies with the exception of $5,000.   Vice Chairman Campbell read dept. letters from B.O.H., Water Dept., Conservation Commission and City Planner which were placed on record.   
Tony made motion to release $25,000 once they received confirmation from City Engineer relative to the final paving. Seconded by Arthur. All in favor.

Tony made motion to release the remainder $5,000 when the bounds and As-Builts have been submitted to the City Engineer.  Seconded by Arthur. All in favor.

Arthur made motion to forward a positive recommendation to the City Council for street acceptance, seconded by Alan. All in favor.

Winthrop Heights – Lot Release  -  Holding 2 lots, request to Release Lot # 29 – holding $115,000 & $48,000 Mylar Deposit – submitted by Richard Feodoroff
Richard Feodoroff stated he’s requesting release of Lot #29, you will still be holding one lot.  He stated he anticipated everything to be completed by Spring.   City Engineer’s letter recommends release lot upon receipt of an additional $5,000 of surety.

Manny made motion to release Lot #29 upon receipt of $5,000 of surety, seconded by Arthur. All in favor.

     
Public Hearing – Site Plan Review – to allow a 33,000 sq. ft. medical building on Lot 14-1 thru 5 Bay Street/Industrial Park Rd., - submitted by William Shamon, Myles Standish Medical Facility, LLC.
Jon Connell, Field Engineering Co. Inc., filling in for Rich Riccio, who just had his second baby son today.  Jon stated they submitted new plans showing some changes to the site.  He stated at the last meeting the Board had concerns with the entrance off Bay Street and they have moved the entrance further down and moved building.  They also increased the radii along Industrial Park Road to accommodate trucks.  Jim Noyes, Greenman-Pedersen submitted traffic report and also just recently did traffic count today.   Bob stated the Board suggested having access off Industrial Park Road.  Jon wasn’t aware of that? Tony stated at the last meeting the Board indicated they have problem with access off Bay Street.  Tony stated, in his opinion, having access will create mess with lane change.   Jim stated when they went to the DIRB and he was under the understanding that Board did not want access off Industrial Park Rd because of the site distance.  He spent time out there today doing some radar checks.   He stated they only had one car making right turn traveling at high speed of 54 mph.  He stated the low rate was 33 mph and the high was 45 mph.  Jim stated there is about 1,400 cars that travel thru the right turn lane.  Manny had major concern with this area of which he’s very familiar with.  He stated if you are not familiar with the area you will be confused. He voted against the Tedeschi and the drive-thru there.   He’s not comfortable with any entrance off Bay Street.    Manny suggested alleviating congestion in the area not adding to it.  He strongly suggests submitting plans showing no access driveway off Bay Street.  Manny asked the reasoning of having Bay Street access?  Jon answers convenience.   Bob stated that there are 1,500 vehicles a day traveling this roadway and he doesn’t think it’s wise to add entrance off Bay Street.  He asked if it’s would be wise to add this access around choke point and if they widen the roadway the driveway will be in the way?  Will this interfere with future development of the park?    At this time Vice Chairman read the DIRB recommendations into the record.  
Alan made motion to place the on file, seconded by Tony. All in favor.

Bob comments on condition #14 – traffic signal design and any surety being proposed for the intersection at Industrial Park Rd., Jos. Quinn and Myles Standish Blvd?   Jon stated they didn’t talk about any monies being proposed?  Bob stated the Bay Street access only benefits Bay Street.   He too suggests re-designing plans.   Bill Shamon, CFO of LLC who owns property. He stated TDC made it attractive with Bay Street access.  No Bay Street access takes away the economic ability to market site.  He stated they were proposing medical offices but not limited to medical. The site will be offices.  He stated they still have to build Joseph Quinn access.  Mr. Shamon stated without the Bay Street access it will make it a tough sell.  Jim stated the radar indicated 35 mph coming off ramp.  In his opinion, Jim stated the Bay Street access is not unsafe and nothing unusual that will create accidents.    Bob suggests perhaps making entrance further down on Industrial Park Road.   Bob suggests moving main entrance. Mr. Shamon answers they will be losing visibility from Rte. 495.  Alan suggested having entrance off Industrial Park Rd.  or Joseph Quinn Dr.  Jon stated they could speak to the TDC to see if they have any plans for adjacent lot?   It was the concensus of the Board to eliminate any access drive off Bay Street.   Bob suggests moving access drive around corner on Industrial Park Rd, about a couple hundred feet where the property ends to open the site distance.   
Alan made motion to open public input, seconded by Arthur. Al l in favor.
David Yetman, KGI – BJ ‘s plaza stated he’s not opposed just had some questions.  His concern was with the amount of litigation they had to pay they were just making sure there wouldn’t be a problem after this goes in they would have more mitigation, He’s not against development but was a little concerned with the Bay Street access.  Public input will be kept open.     It was suggested submit new plans showing access off Joseph Quinn Drive. Also the Board would consider plans showing a right-turn in and right-turn out driveway off Industrial Park Road west of the current property line in addition to the Joseph Quinn access.  


Alan made motion to continue to January 6, 2011 meeting. Seconded by Manny. All in favor.

Tony brought up Sabbatia Landing Condo project on Bay Street. They were here in
May 2009 requesting some changes to the entrance with regards to installing automatic gate and nothing has been done.   He stated there are about 7 condo units occupied and they are still waiting for the gate to be installed.  There are abandoned foundations out there and the entrance is overgrown.    
Alan made motion to send letter to owner, Carlos Melo, asking for update, seconded by Arthur, All in favor.
