Roll Call: Spencer, Campbell, Abreau, Lopes, Medeiros, Faulkner and Dermody.    

Chairman Dermody and the Board welcomed new member Alan Medeiros.    

Arthur made motion to approve minutes of December 3, 2009 meeting, seconded by Manny. All in favor.

Election of Officers:

Arthur made motion to keep same slate of officers as last year. Seconded by Tony. All in favor.

Daniel Dermody was unanimously elected Chairman.

Dick Faulkner was unanimously elected Clerk.

Robert Campbell was unanimously elected Vice Chairman


Conway Estates – Request to switch Lot 6 for Lot 5 which was approved in November.
Clerk Faulkner read letter from City Planner and applicant in regards to switching Lot 6 for Lot 5.   
Bob made motion to make the letters part of the record, seconded by Manny.  All in favor
Manny asked if there was any difference with the lots?  It was stated the owner had a buyer at this time for that specific lot.

Manny made motion to approve the switch of the lots (release lot 5 instead of 6) seconded by Bob . Al in favor .

Public Hearing – Form J Plan – 76 Fremont St.  – to split one lot into two lots, waiver of frontage, submitted by Mathew Arruda
 Roll Call:  Present were Spencer, Campbell, Abreau, Lopes, Medeiros, Faulkner and Dermody.  Hearing opens at 5:32 PM.
Clerk Faulkner read letters from Fire Dept., City Planner, B.O.H., Water Dept. and Conservation Commission which were placed on file.
Bob made motion to invite petitioner into the enclosure, seconded by Arthur.  
Mathew Arruda, 86 Kilmer Ave., was invited into the enclosure.
Mr. Arruda stated he is asking for waiver of frontage for property on Fremont Street. He has 25 feet of frontage and he wishes to build house in back of his Grandmother’s house.     He did receive ZBA approval for variance for lot area, dry area, frontage.  Manny asked what would be the access to the lot?  Mr. Arruda answers the 25 feet would be a long driveway accessing the lot and the house would be to the left of the lot.   Tony stated he thinks there is a 2” forced sewer main in this vicinity and if he could tie in he would recommend it.  Tony recommends sewer with grinder pump instead of septic system?   Mr. Arruda stated he was under the impression the sewer stops a couple of houses down.  Tony was thinking this property was closer to the sewer?    Mr. Arruda stated 76 Fremont Street does not have municipal sewer.    John Arruda, 82 Fremont St., in favor .  No one in opposition.  
Arthur made motion to close public input, seconded by Dick. All in favor.

Arthur made motion to approved Form J for 76 Fremont St., seconded by Tony. All  in favor.  Hearing closes at 5:40 PM.

Tony suggests having Veoila (sewer for City) more involved in future subdivision that have municipal sewer.  He wants them to work with the outside consultants on the subdivision that have city sewer.  He stated the don’t get the As-Builts but have to review building permits.  There was some discussion as to the process.  Bob pointed out there is a process in place for septic system by the Board of Health. They do witness holes and final inspections.    Arthur asked if Veolia has an inspector for sewer?  Tony stated Veolia inspects open trenches but does not inspect on private property.  Tony just wants Veolia and the Outside Consultants to work together during the sewer process.  The Secretary asked Tony what Veolia’s address was. Tony stated 825 W. Water Street,send it to Anacet Teves.  The Secretary asked Tony where do the applicants go for a Sewer Extension Permit? Tony answers they come to the DPW and Veolia gets that information.  He suggests adding Veolia to the E-5 list.  

Tony made motion to have the Outside Inspectors and Veolia work together on any future subdivisions that have municipal sewer and add them to the E-5 list. Seconded by Bob.    

Bob asked if the Form F (Conveyance of Utilities) is being completed and submitted to the Planning Board office. The Secretary stated she didn’t think so.   The Board asked for an update next month regarding Form F Utilities Form ?
