Roll Call: Faulkner, Spencer, Campbell, Pimental, Lopes. Also present was Kevin Scanlon, City Planner. Meeting opens at 5:30 PM.

Dick made motion to accept minutes of February 5, 2009, seconded by Manny. All in favor.
Manny made motion to revert out of the regular order of business, seconded by David. All in favor.
Special Permit-Site Plan Review – 406 Tremont Street - 75 dog kennel, & training facility. Need to forward a recommendation to Municipal Council
It was discovered the petitioner was not present due to not being notified of meeting. City Planner stated the petition is for a 75 dog kennel in the basement of an existing dwelling. They are proposing to have shows in the garage in the rear of the property. The City Planner stated that the DIRB met and continued because they had a variety of reasons. Some include lot size, parking lot, show access, detail of the retail sales, tree line, 3 acre lot size of which they don’t’ have and training area wasn’t specified on plans. For these reasons the DIRB continued their meeting for updated plans. At this time the City Planner indicated to the Board, since the petitioner wasn’t made aware of the meeting, they could continue to give them a chance next month to present
their case or if the Board feels they want to act tonight they could? Mr. Faulkner, stated, based on the outstanding issues of the DIRB he feels we should not go forward. Kevin asked if he meant he wanted to wait for new plans that the DIRB is asking for? Manny recommends against it. Dave stated he would be voting no because of the retail store in a residential area, the number of dogs they are proposing and no fencing. Arthur agreed and stated his reasons are too many dogs on an undersized lot and the impact it will have on the residential neighborhood. It was noted there were several residents in the audience in opposition. Other Board members indicated they would be voting no for this proposal.
Dick made motion to forward a NEGATIVE recommendation to the Municipal Council on this proposal due to the Board identifying that the petition does not meet the minimum lot size, 250 foot min. setback to abutter’s houses, and no more than 3 dogs in the house. The Board found the proposed use is completely inappropriate for the site. Seconded by Manny. All in favor.
Arthur made motion to revert back to the regular order of business, seconded by David. All in favor.

Public Hearing – Proposed Zoning Map Amendment – Bay Street, Fremont St., & Bassett St. & Paul A. Dever State School site – City of Taunton
Public hearing opens at 5:39 PM. Roll Call: Spencer, Pimental, Lopes, Faulkner, Campbell present. Also present was City Planner, Kevin Sanlon. Letter from Mayor Crowley requesting a continuance until next month.
Dick made motion to place letter on filed, seconded by Manny.
Manny made motion to grant continuance and place on April 2nd 2009 Agenda, seconded by Arthur. All in favor.
Public Hearing – Definitive Subdivision – John Hancock Road Extension – located on Assessor’s Map 30, Lot 3 – Vacant land currently being used as a quarry haul road. Submitted by Site Restoration Tech., owned by TDC.
Public hearing opens at 5:41 PM. Roll Call: Spencer, Pimental, Lopes, Faulkner, Campbell present. Also present was Kevin Scanlon, City Planner. Clerk Faulkner read the public hearing notice into the record. City Planner read department comments from himself, TMLP, Fire, B.O.H., Conservation Commission, City Planner, Water Dept., and City Engineer.
Arthur made motion to place dept. comments on file, seconded by Dick. All in favor.
Jon Connell, Field Engineering Co. Inc., was invited into the enclosure. Mr. Connell stated they currently have haul road that connects to Fremont Street. He stated the petitioner SRT has 3 buildings on the property north of the quarry. Jon stated they went the DIRB wanted them to upgrade John Hancock Rd. Extension currently owned by the TDC. Jon stated the road will become a public way . Jon stated that everyone knows the tough shape the roadway is in and he has been working with Mark and Jim from the Engineer’s Office on the upgrades. The roadway is 24 feet wide and they are proposing 30 feet wide and paving, installing berm and drainage. They plan to level and overlay, widen the southerly side. Jon stated the north side was the driving factor for the anticipation of the
stormwater policy. They plan on boxing out, install gravel over the existing and overlay the whole thing. He stated there will be an easement granted to the City of Taunton. Jon stated he anticipated the comments from the water dept. and didn’t’ have a problem with other department comments. He apologizes if he forgot some things on plans but he can address them per the City Engineer’s letter. Manny asked what roadway runs along this. Jon pointed out it’s not a roadway it’s the railroad tracks, Attleboro branch. Bob asked about the easement that will be granted to the City it’s just to accept the easement not to maintain? Jon answers yes just to accept easement the TDC maintains it. Bob stated they will continue to use as a haul road. Jon answers yes, they are proposing to add 4 inches of pavement and box out and add to the existing pavement grade and then overlay whole thing. Manny asked if it will
be a public way? Jon stated yes that’s the intent. Bob stated it will provide access from Fremont Street. Kevin stated the plans show the worse case scenario because they don’t know what uses will go in there? It was noted that emergency vehicles will benefit from this. Dick asked if it will be used for the future trash energy plant? Kevin answers yes, that has been filed with the Conservation Commission and Beta is working on it now.
Arthur made motion to open public input, seconded by Manny. All in favor.
No one appearing in favor or opposed.
Arthur made motion to close public input, seconded by Manny. All in favor.
Manny made motion to approve John Hancock Road Extension to include the City Engineer’s comments. Seconded by Arthur. All in favor. Public hearing closed at 6:00 PM.
Arthur made motion to adjourn meeting at 6:01 PM, seconded by Manny. All in favor.
