5.13.13 Conservation Commission Minutes
Minutes of the Taunton Conservation Commission May 13, 2013

Present: Chair Brian Marques, Commissioners Steven Turner, Ernest Enos, Marla Isaac, Neil Kelly, and Renwick Chapman.
Absent: Vice Chair Debra Botellio

Motion to approve the minutes from the April 2013 meeting, ST, second MI, so voted.  RC abstains

Motion to go out of order ST, second MI, so voted.

Other Business
1.  Weir Corp requesting permission to put up a sign advertising their Weir Corp Day.  It will be on the “Weir” side of the bridge, Kevin Scanlon said this needed TCC approval.  Motion to allow, ST, second RC, so voted.  RC asked if it was an electric sign? MR not sure if electric or just lettered sign.  

Motion to revert to the regular order of business, ST, second MI, so voted.  

Continued Certificates of Compliance
1.  113 Craven Court, Meridian Custom Homes, Inc., (COC), SE73-2497  Field report states that this project was for the construction of a single family home, attached garage, back yard, utilities, and associated grading.  The yard has been loamed and seeded but still has not germinated.  Because this property still has not fulfilled the requirements for a stable lawn area, it still is not in significant compliance to the order of conditions issued on 4-26-12.  MR recommended that this project be continued to 8-12-13.  A re-visit fee of $50 is required for this additional visit.  Motion to approve continuance to August 12, 2013, ST, second NK, so voted.  


Certificate of Compliance
1.  68 Dunbar Street, Cabral, (COC), SE73-2521  Field report states that this filing was for a septic system repair within 100 feet of a BVW.  The existing septic tank was drained, filled and abandoned, the new septic tank placed to the west of the concrete deck around the pool.  The leaching field is between the retention wall and existing concrete pad in the rear of the property.  The siltation barrier is placed 27 feet off the wetland and was the limit of work.  The work on the leaching field and new septic system are complete and the area has been loamed and hydro seeded.  MR inspected the property on 5-6-13 and observed that the grass has not started growing in the disturbed lawn area, and therefore is not stable.  In order to receive a COC all disturbed areas must be stable.  MR recommends that the TCC continue this filing to 6-10-13, in order to ensure that the hydro seeding was successful and that grass germinates.  Motion to approve continuance to June 10, 2013, ST, second NK, so voted.  


Public Meetings
1.  68 North Walker Street, Rankin, (RDA), DSE-1053  Field report states that this filing is for a septic system repair within the riverfront area of the Three Mile River and NHESP designated priority habitat of rare species and estimated habitat of rare wildlife.  A letter from NHESP must be presented to the Conservation Agent prior to sign-off of plans.  The septic system work will all be in front of the property and within the outer riparian zone, with the closest work 153 feet from the river and outside the 100 buffer zone of BVW.  The existing septic tank will be replaced with a 2 compartment 2500 gallon tank/pump chamber combination tank.  The existing soil absorption system will be pumped and abandoned and replaced with 4 rows of Infiltrator Quick4 standard chambers.  One of the existing trees will be removed in order to place the new leaching system.  The silatation barrier will be placed as the limit of work.  The project as presented will not negatively impact the river or wetland, therefore MR recommends that the TCC approve this project and issue a negative determination to include the attached special conditions.  Steve Gilbert from SFG Assoc. was present for the homeowner.  Motion to open, RC, second MI, so voted.  Motion to issue a negative determination with conditions 1, 2, 3, 4, 14, 18, 19, and 20-pending updated plan and changed wording on plan ST, second NK, so voted.  RC had asked about moving the siltation barrier closer to the house rather than along side the outside edge.  Steve Gilbert agreed to that.  Motion to close, MI, second ST, so voted.  

2.  1219 Bay Street, Baptista, (RDA), DSE-1054  Field report states that this filing is for the proposed construction of an attached 24’ x 26’ two car garage with an upstairs bedroom which falls within the 100 foot buffer zone to Lake Sabbatia.  The garage is 80 feet from the lake at its closest point and will be placed on a concrete pad.  The area where the garage will be located is flag and the land remains flat up to 22 feet from the shore where it drops off steeply at almost a 1:1 slope to the edge of the water.  The project as presented will not negatively impact the lake, therefore MR recommends that the TCC approve this project and issue a negative determination to include the attached special conditions.  David Baptista the homeowner is present.  Motion to open the hearing, RC, second MI, so voted.  RC asked about a property line on the plan?  MR said she did measure 80 feet to the water line.  MR said edge of lake to where the garage will be is 80 feet.  RC said a botanist should look at the edge of bank and a topo survey should be included, as well as a registered surveyors stamp.  ST stated the TCC is just concerned that nothing is going on in wetlands or lake correct?  RC yes and no materials erode into the lake.  BM asked couldn’t TCC just require siltation barrier?  Builder said they will tell the engineer what else is required for this hearing.  Motion to continue to June 10, 2013, applicant to come back with an updated plan, ST, second RC, so voted.  Motion to close, MI, second ST, so voted.


Continued Public Hearing
1.  Pratt Street, Fasolo/The Fasolo family Limited Partnership, (NOI), SE73-2538  Paul Patnaude is present for the applicant.  ST said there was a site walk with the neighbors, whole project was explained, questions were answered, visit was a success.  Motion to approve with conditions 1, 2, 3, 4, 5, 8, 9, 19, 21, 25, 26, 27, 28 & 29 were add ons that I did not get in my field report, ST, second NK, so voted.  RC abstains.  Motion to close MI, second ST, so voted.  


Public Hearing
1.  10 Ingell Street, Debrosse/Edmond T. Debrosse 2007 Revocable Trust, (NOI), SE73-2539  Field report states that this project is for the proposed installation of a new sewer system to include abandoning the existing septic system on site, installing an MDC oil/water separator, installing an E-One sewer pump, and installing 430 feet of 2” PVC force sewer main to a sewer manhole within the right of way of Ingell Street to the intersection of High Street.  This property is at the confluence of the Taunton and Mill Rivers and has been in existence since 1950, with an existing one story business building at the south end of the site.  The property is within the 100 year flood zone (Zone AE elevation 12).  All work on the property will be within the outer riparian zone with the closest work 138 feet from the bank of the Taunton River.  The sewer line within the right of way of Ingell Street will be outside the riverfront area but still within the 100 year flood zone.  The abandonment of the septic system and conversion to sewer will be an improvement on the property and will better protect the waters of the Taunton and Mill Rivers during periods of flooding.  A temporary stockpile area will be located on the east side of the parking lot adjacent to the building and will be outside the riverfront area.  A hay bale barrier will be installed around the perimeter to prevent siltation runoff.  The septic tank and leaching field will be removed and abandoned with contaminated soils removed and the disturbed area loamed and seeded.  A siltation barrier is depicted west of the leaching field and should be considered the limit of work.  The project as presented will not negatively impact the rivers, therefore MR recommends that the TCC approve the project and issue an order of conditions to include the attached special conditions.  Present Steve Gioso from SITEC.  Motion to open the hearing, MI, second RC, so voted.  (ST out at 7:15)  RC would like them to back fill after the days work and paved with a one inch binder.  Steve Gioso does not mind doing a binder at all.  He will do this if the TCC wants it done.  BM asked how neighbors feel about the project, businesses there?  Steve said they are aware, on board and may participate.  Motion to approve with conditions 1, 2, 3, 4, 5, 6, 7, 10, 17, 19, 21, 25, 26, 27, 28-back fill at the end of each day and put a one inch binder of asphalt down, RC, second MI, so voted.  

2.  8 Davis Street, Levesque, (NOI), SE73  Motion to continue to June 10, 2013, EE, second NK, so voted.  


Violations
1.  Enforcement Order-Williams Street.  MR asked them for a complete plan of work and to be here on 5/13/13, MR did hand them the NOI paperwork.  They are requesting a continuance.  Motion to continue to June 10, 2013, RC, second MI, so voted.  


Other Business
1.  Request to remove one parcel out of conservation restriction and make the parcel closest to the river a conservation restriction parcel.  1.5 acres removed from restriction, 1.5 acres put into conservation restriction.  The percent of wildlife and species is the same on both?  MR said this will improve the wildlife corridor.  The parcel to be put into restriction is closer to the wetland and at a lower elevation.  The parcel to come out of restriction is farther away, upland, and near other houses.  Motion to approve, NK, second MI, so voted.

3.  Letter:  Re: surveillance in Westfield Conservation Area on South Walker Street.  MR is working on this, will get rules and regulations for the area to the Committee on Police and Licensing, as they requested.  Will also request a fence be put up.
