Minutes of the Taunton Conservation Commission February 27, 2012
Present: Chair Brian Marques, filling in as Vice Chair Neil Kelly, Commissioners Ernest Enos, Marla Isaac, Debra Botellio, and Renwick Chapman.

Motion to approve the minutes of 2-6-12, RC, second NK, so voted. DB voted present.
Certificate of Compliance
- 24 N. Walker Street, Federal National Mortgage Association, (COC), SE73-2021 Field report states that this project was for the construction of a 28’ x 28’ garage. No work has been started on this project; therefore, MR requests that the TCC issue a COC to close this file. Motion to issue a COC to close out this project, DB, second MI, so voted.
- 336 Winthrop Street, SooHoo, (COC), SE73-2265 Field report states that this project was for a septic system repair and parking lot repaving and approved under an Order of Conditions issued on 6-4-07. All work has been completed in significant compliance to the Order of Conditions. The parking area has been repaved and there is no indication of sedimentation into the adjacent BVW. MR recommends that the TCC issue a COC for this project. Motion to issue a COC, DB, second RC.
Amendment
- 1094 Bay Street, Anderson, (AMEND), SE73-2301 Motion to move this to the end of the agenda, RC, second DB, so voted.
Public Meetings
- 1000 County Street, Mass DOT-Highway Div., (RDA), DSE-1032 Field report states that this project is for the installation of an office trailer, new parking, and fencing, with associated drainage and utilities. Wetland flags were re-hung along the southeast and east of the property only as this is the area of concern. MR reviewed the wetland line and is in agreement with the placement of the flags. MR recommends that the TCC approve the wetland line as follows: flags 2D through 19D, and 4A through 8A. The trailer will be located adjacent to an existing garage and picnic shelter and will be placed on concrete columns. An existing chain link fence will be relocated to enclose this area. 23 additional parking spaces will be created to the north of this building, adding
an additional 4,050 sf of impervious surface. A hot mix asphalt (HMA) berm will be located along the edge of the parking area and surface stormwater will be directed to an HMA waterway with overflow leaching basin and stone apron in the east corner of the parking area. A new leaching basin will be located to the southeast of the trailer and within 21 feet of the BVW. Water and sewer lines will also be installed along the southeast in order to connect to the trailer. These utilities will be 15 feet from the BVW. The office trailer will be 30 feet from the BVW and the additional parking spaces will be located 42 feet from the BVW. An erosion control barrier is depicted on the plan and will be within five feet of the wetland at the closest point. The work as presented should not negatively impact the wetland, therefore MR recommends that the TCC approve the project and issue a negative determination to include the attached special conditions. second NK, so voted. Motion to approve the flags as read, RC, second DB, so voted. Motion to close the hearing, issue a negative determination with special conditions 1, 2, 3, 4, 18, 19, 20, 21, and 22, with RC’s requests: where the new chain link fence in the right hand corner cuts off the WPZ, move it further away from wetland cutting across instead of at a right angle, move leaching to right hand of building at the end which will take it out of the WPZ, on west side move the sewer line in at utility pole 40 where bulge is, move lines closer together keeps line out of buffer, RC, second NK, so voted.
- Sunset Drive, Columbia Gas of MA, (RDA), DSE-1031 Field report states that this project is for a gas main replacement within the existing paved roadway and edge of the paved road. Work will fall within 100 feet of a BVW. The BVW was delineated by Environmental Consulting & Restoration, LLC on 1-24-12. MR reviewed the wetland delineation and is in agreement with the placement of the flags. MR recommends that the TCC approve the line as follows: flags A1 to A11 for reference purposes only. The work will consist of excavating a trench approximately 2 to 3 feet wide by 4 feet deep within the roadway and replacing 850 feet of 3-4 inch steel natural gas pipe with 2-inch plastic natural gas pipe. Half of the excavated material will be used to
backfill the trench while remaining material is trucked out and disposed of per applicable laws. Once the work is complete, any temporary pavement will be replaced by permanent paving. Any work within the non-paved areas will be returned to their original state, such as laying sod or plantings. An erosion control barrier will be placed between the work and resource area. Work is expected to start this spring. The project as outlined should not negatively impact the adjacent resource area, therefore MR recommends that the TCC approve the work and issue a negative determination to include the attached special conditions. Motion to open the hearing, DB, second NK, so voted. Motion to continue to March 12, 2012, DB, second MI, so voted.
Public Hearings
- Kilmer Ave. (Fairfax Gardens), Zahler/Trinity Taunton Nine Ltd. Partnership, (NOI), SE73-2488 Motion to open the hearing DB, second MI, so voted. MI wanted it to be known she is an abutter of the property. H & W did the peer review for the TCC, Rich Claytor and Amy Ball were both present to for the discussion of their review. They have a long letter of requests for Trinity. Present for Trinity was Hank Keating and Mathieu Zahler, Engineer from Kelly Engineering, David Kelly was present. Colleen Doherty from the THA was also present for the hearing. Amy and Rich started the discussion of their review. David Kelly responded to some of their concerns. The two are still currently working together on the requests so they will need to continue their work
and come back to the TCC with the results of this. TCC members voiced some of their concerns, making both our reviewers and the applicants aware of what the TCC is going to expect in order to approve this project. RC would like them to continue working together and a second letter from H & W should be issued stating that everything has all been worked out to the satisfaction of the TCC. Motion to continue to 3-12-12, DB, second NK, so voted.
- Bassett Street, Taunton Dev./MA Dev. Corp., (ANRAD), SE73-2489 This filing is for the approval of a wetland line located behind 300 Constitution Drive and associated with Bassett Street and the Dever property. The wetland was delineated by Lenore White, Wetland Strategies, Inc., on 1-14-12. MR reviewed the wetland line with Lenore on Wednesday 2-22-12. During this site visit, two flags were changed- Flags 143R was added and moved back 10 feet from flag 143, and flag 147R was added and moved back 20 feet from flag 147. These changes were sent to Field Engineering and a revised plan will be brought to the meeting. It is possible that between flags 121 to 133 there exists a vernal pool. This should be investigated for that possibility, and access
to the property for this purpose should be permitted. MR is in agreement with the placement of the flags, including the two additional flags. MR recommends that the TCC approve the delineation as follows: flags 38 to 158, including flags 143R and 147R, with flags 159-161 for reference purposes only. Motion to open the hearing, DB, second MI, so voted. Motion to approve the wetland line, DB, second MI, so voted.
Motion to revert back to the regular order of business, DB, second NK, so voted.

Violations
- 17 Mechanics Street. Graded, now eroding into the wetland. No damage but siltation is there. They are working with MR now. Motion to remove the violation and have them work with MR, DB, second RC, so voted.
Other Business
- Removal of Junk Cars at Boyden. Motion to have Gene Correira go in to remove the junk cars DB, second MI, so voted.

- NK will bring Roger Hoffman a plan of 1094 Bay Street.
- 78 Liberty Street. Order of Conditions was to put in a pole barn 2 years ago. The couple has since split, barn never put in, now the gentleman has been clear cutting and driving an excavator right through the stream. MR needs ratification of the enforcement order so she can send it out. Motion to ratify the enforcement order DB, second MI, so voted.
- H & W. Renewal of their yearly agreement with TCC.
- Electric Bill at Boyden. It is paid by Park & Rec. DB will look for a copy of the memorandum of understanding for this.
