7.11.11 Conservation Commission Minutes
Minutes of the Taunton Conservation Commission July 11, 2011

Present Chair Brian Marques, Vice Chair Neil Kelly, Commissioners Marla Isaac, Debra Botellio, Ernest Enos, and Renwick Chapman.  Commissioner Steven Turner was absent.


Motion to table the minutes of June 27, 2011 until the next meeting, RC, second MI, so voted.


Continued Public Meetings
1.  70-74 Weir Street, Izedian, (RDA), DSE-1016  Applicant not present yet.  Motion to move this to the end of the agenda, RC, second MI, so voted.


Public Meetings
1.  93 redwood Drive, Lowell, (RDA), DSE-1018  Field report states that this project is for the construction of a 28’ diameter above-ground pool with a  12’ x 16’ deck, and the placement of a 12’ x 10’ shed.  This property is on the west side of Redwood Drive with wetlands situated behind the house.  The wetlands are at the base of a slope and are clearly defined by open water.  The slope is treed and the siltation barrier remnants are visible.  MR recommends that the TCC re-approve the wetlands delineation as follows:  Flags 182-185, flags 1-4, and for reference purposes flags 180, 181, 4, and 5.  The shed will be placed on blocks and will be 45 feet from the wetland edge.  The pool will be 65 feet from the wetland and the deck will be 66 feet from the wetland.  The Applicant plans to use a cartridge filter for the pool.  The project as presented should not negatively impact the wetland, therefore MR recommends that the TCC approve the project and issue a negative determination to include the attached special conditions.  Homeowner John Lowell present.  Flags are there.  Motion to approve the wetland land line, MI, second RC, so voted.  (NK arrived) (DB arrived)  Motion to close the hearing, issue a negative determination with special conditions 1, 2, 3, and 4, RC, second EE, so voted.  DB voted present.  

2.  162 Ice House Road, (RDA), DSE-1019  Field report states that this project is for the construction of a 10’ x 16’ deck addition and a 24’ above-ground pool.  This property is on the east side of Ice House Road and the wetlands are located near the rear of the property line and are at the edge of the lawn area.  The wetlands were flagged and located by SFG Associates.  MR recommends that the TCC approve the wetland delineation as follows:  flags SFG 1-4, and flags WCL 114-117 for reference purposes only.  The deck will be added to the current deck and will be on sona tubes.  The pool will be adjacent to the new deck and the Applicant will be using a cartridge filter.  There will be minor grading for the pool.  A siltation barrier is shown on the plan.  The project as presented should not negatively impact the wetland, therefore MR recommends that the TCC approve the project and issue a negative determination to include the attached special conditions.  Motion to open the hearing, DB, second MI, so voted.  Motion to approve the wetland land line, RC, second DB, so voted.  Motion to close the hearing and issue a negative determination with special conditions 1, 2, 3, 4, and 28- 28 feet from the existing deck, running parallel to the house, a hay bale line is to be put in place, RC, second DB, so voted.

1.  97 Ingell Street, Cooperative Production Inc., (NOI), SE73-2452  Applicant has requested a continuance.  Motion to continue to August 22, 2011, DB, second MI, so voted.

Public Hearings
1.  195 Princess Kate Circle, Brennan, (NOI), SE73-2475  Field report states that this project is for the construction of a 30’ x 28’ addition to the east side of the house.  This property has wetlands along three sides of the property.  The wetlands closest to the project site were re-flagged by Walter Hewitson on 6-4-11.  The wetland to the west was flagged with flags A1-A3 and is located off property.  The system to the east is delineated by flags A1-A12, all on-property.  MR agrees with the placement of the flags and recommends that the TCC approve the delineation as follows:  Flags A1-A12(east), and for reference purposes flags A1-A3(west).  The addition will be 37 feet from the wetland (flag A4) at its closest point.  A siltation barrier is shown 20 feet from the flag A4, its closest point.  Grading will be 36 feet from the wetland.  MR recommends that roof drains go into drywells.  The work as proposed should not negatively impact the wetlands.  MR recommends that the TCC approve the project and issue an order of conditions to include the attached special conditions.  Motion to approve the line, DB, second RC, so voted.  Motion to close the hearing, approve the NOI with special conditions 1, 2, 3, 4, 5, 19, 21, 23, 25, and 28- hay bale line 25 feet or greater from the wetlands at its closest point, RC, second DB, so voted.  

Motion to approve moving 391 Winthrop Street from the meeting on July 11, 2011 to the meeting on July 25, 2011, DB, second RC, so voted.

Continued Public Meetings
1.  70-74 Weir Street, Izedian, (RDA), DSE-1016  Field report states that this project is for vegetation management along the building which directly abuts the Mill River.  The building was built in 1900 and last housed the Triangle Gym.  The Applicant submitted photos of the vegetation that has grown around the foundation of the building.  MR walked the property with him on June 3rd in order to recommend the type of filing he should submit.  Under 310 CMR 10.02(1)(a) through (c), a vegetation management plan may be submitted under a Request for Determination of Applicability.  The work as presented should not negatively impact the Mill River.  In fact, the elimination of invasive species should enhance the area.  MR recommends that the TCC approve the plan and issue a negative determination to include the attached special conditions.  Motion to close the hearing, issue a negative determination with special conditions 1, 2, 3, 4, and 28- vegetation is to be removed by hand only, DB, second RC, so voted.

1.  Railroad Right of Way, MBTA, SE73-2472  Motion to continue to August 8, 2011, send a letter from BM stressing that they are to be present at the meeting on 8-8-11 because this will not be continued again, RC, second NK, so voted.

Other Business
1.  MACC Dues.  Motion to give permission to pay these dues, DB, second NK, so voted.

2.  Antioch Church.  Request to use the Riverfront Park on 9-10-11 at 12pm for approximately 150-200 people.  Motion to approve using the park on this date, DB, second MI, so voted.

3.  Liberty and Union Surety.  Motion to give MR permission to sign DB, second RC, so voted.  If MR needs BM’s signature on this, please let him know and he will come in to sign.

4.  Motion to instruct MR that anything that comes before the Commission has a stamped engineered plan before it is heard, RC, second DB, so voted.
