6.27.11 Conservation Commission Minutes
Minutes of the Taunton Conservation Commission June 27, 2011


Present Chair Brian Marques, Vice Chair Neil Kelly, Commissioners Debra Botellio, Marla Isaac, Renwick Chapman, and Steven Turner.
Absent Commissioner Ernest Enos.


Motion to approve the minutes from the meeting on June 6, 2011, DB, second MI, so voted.


Continued Certificate of Compliance
1.  39 Sydney’s Way (Lot 3), Maroney Building & Contracting, (COC), SE73-2257  Field report states that this project was for the construction of a single family home with septic system.  Work has bee completed and the lawn is stabilized.  A revised plan was received showing “existing home” as requested.  Roof drains go into an infiltration trench behind the house.  All work has been done within significant compliance to the Order of Conditions issued on May 8, 2007 and extended on March 22, 2010.  MR recommends that the TCC issue a COC for this project.  Motion to issue a COC for this project, MI, second NK, so voted.


Certificate of Compliance
1.  Bay Street, COT-Water Dept., (COC), SE73-2385  Field report states that this project was for the construction of a new industrial park booster station as part of a new high service system to promote the continued development of the Myles Standish Industrial Park.  The work consisted of construction of a new 24’ x 28’ booster pump station and associated piping, and a 46 foot long gravel access driveway.  Roof runoff is directed to two 4’ wide gravel infiltration trenches equipped with six inch diameter perforated high density polyethylene (PDPE) pipes.  The water is then piped via 6 inch solid HDPE pipes to a 1.5 foot deep retention basin prior to discharge to Sabbatia Lake.  All work has been completed in significant compliance to the order of conditions issued on May 18, 2009.  All areas are stable and there is no indication of siltation into Sabbatia Lake.  MR recommends that the TCC issue a COC for this project.  Motion to issue a COC for this project, DB, second MI, so voted.
2.  18 Jessie Lane, Vigliotti, (COC), SE73-1150  Field report states that this project was for the construction of a single family home with garage, driveway, and associated utilities.  The lawn area is stabilized and there is no indication of siltation into adjacent wetlands.  All work has been completed in significant compliance to the order of conditions issued on March 4, 1998.  A Partial COC was previously issued for this property for closing purposes.  MR recommends that the TCC issue a COC for this project.  Motion to issue a COC for this project, DB, second MI, so voted.


Continued Public Meetings
1.  82 Landing Drive, Rocha (RDA), DSE-1011  Field report states that this project is for the construction of a 25’ x 24’ attached garage with an extended driveway and retaining wall within the 100 foot buffer zone of a BVW.  MR received the revised plans recommended by the TCC showing the delineation and contours and revisited the property to review the wetland delineation performed by Conservation Consultants.  For the most part this line is conservative and is along the top of slope rather than toe of slope.  Between flags 11 and 16 MR felt it was more upland at the tope of slope and would have flagged it at the toe, a change of 4 feet, but this is a minimal amount that would not necessarily change the parameters of the project.  MR recommends that the TCC approve the wetland line, flags 1 through 25 as shown on the plan titled Existing Conditions Plan dated June 14, 2011.  The applicant is proposing to erect a retaining wall along the driveway extension/addition as this area slopes down to the basin and he will need to add fill to level off the additional driveway section.  A siltation barrier is depicted on the plan per the recommendations of the TCC.  The barrier is marked as the limit of work and is at least 30 feet from the wetland edge.  As presented, the construction of the garage, driveway extension, and retaining wall should not negatively impact the adjacent BVW and pond.  MR recommends that the TCC approve this plan and issue a negative determination to include the attached special conditions.  Motion to approve the wetland line, DB, second MI, so voted.  Motion to issue a negative determination with conditions 1, 2, 3, 4, 14, 16, and 18, RC, second DB, so voted.  Motion to close the hearing DB, second RC, so voted.


Public Meetings
1.  18 Jessie Lane, Vigliotti, (RDA), DSE-1014  Field report states that this request is for the proposed construction of a 12’ x 32’ wood deck to be constructed between the existing deck and the existing above-ground pool.  The pool and small deck were issued a Negative Determination on September 14, 2010 under RDA DSE-999.  This is an after-the-fact filing due to the time constraints of the builder hired by the applicant .  MR reviewed the plan and based on earlier filings MR approved the work as it was sandwiched between the pool and the house on a level piece of yard with the stipulation that a request for determination be filed.  The work has been completed and there was no negative impact to the adjacent wetlands.  MR recommends that the TCC approve the plan and issue a negative determination for the record.  Motion to issue a negative determination DB, second RC, so voted.

2.  278 Winthrop Street, (RDA), DSE-1015  Field report states that this project is for the construction of two concrete pads for dumpster and HVAC at the above address.  This filing is an after-the-fact filing as the pads were poured and MR was called out on a complaint.  This is the former Friendly’s Restaurant location, just after Planet Petroleum.  The plans do not show the wetland area to the east (back) of the property.  The “trees and weeds” is the edge of the wetland area and is approximately 12 feet from the dumpster platform and 11 feet from the AC platform.  This property has been here since 1070, prior to the WPA.  The TCC can approve this without the usual buffer zone prerequisites.  MR did not issue a violation when she went out to the site but did request that the owner call me.  He came into the office and explained the work they were doing and MR explained about the wetlands.  He immediately worked on filing a Request for Determination.  The work has not negatively impacted the adjacent wetland.  MR recommends that the TCC approve the plan and issue a negative determination.  Motion to issue a negative determination, DB, second ST, so voted.
3.  70-74 Weir Street, (RDA), DSE-1016  Motion to continue to July 11, 1011, and the applicant must be present at this meeting, DB, second MI, so voted.
4.  1136 Norton Avenue, (RDA), DSE-1017  Field report states that this project is for the construction of a 10’ x 8’ deck addition to the rear of the existing house.  The wetlands were not delineated but are approximately 75 feet away and down a steep slope.  The deck will be located within an enclosed back yard approximately 25 feet from the top of the slope.  The deck will be on sona tubes and work will be done by hand.  The work as presented hold not negatively impact the wetland system.  MR recommends that the TCC approve the plan and issue a negative determination to include the attached special conditions.  Motion to issue a negative determination, ST second NK, so voted.  


Public Hearings
1.  609 Tremont Street, McIntyre, (NOI), SE73-2474  Field report states that this project is for a septic system repair.  The existing cesspool, currently 40 feet from the wetland, will be drained, crushed, and abandoned.  Wetlands were delineated by Dr. Walter Hewitson on April 11, 2011 using flags 1-9.  MR reviewed the line and agrees with the placement of the flags.  MR recommends that the TCC approve the delineation as follows: flags 5 and 6, and for reference purposes only, flags 1-4, and 7-9.  Both a 1000 and a 1500 gallon tank will be installed behind the house and will be 51 feet from the wetland.  The new leaching field will be located on the east side of the property and will be 77 feet from the wetland.  The work as presented should not negatively impact the wetland system.  MR recommends that the TCC approve the plan and issue a negative determination to include the attached special conditions.  Motion to approve the wetland line, ST, second DB, so voted.  Motion to issue a negative determination with conditions 1-5, 19, 21, and 25, DB, second MI, so voted.  


Other Business
1.  Tire Shack.  MR will go out to have a look.  Issues from the emergency fix, water on property and mosquitoes are bad.
2.  Hart Street.  MR asked who stopped there just after Barstow’s Pond to speak with a gentleman who was clearing.  He was site clearing and had permission.  No commission member stopped.  BM would like MR to speak with gentleman and get back to him.  Description of people, etc.
