Minutes of the Taunton Conservation Commission February 28, 2011

Motion to approve the minutes of February 7, 2011 with the addition of 8pm added as the time the meeting ended, DB, second MI, so voted.
Continued Certificates of Compliance
1. 60 Hodges Avenue, Comm. Of MA, (COC), SE73-2379 Field report states that this project was for the demolition of 25 buildings/structures, disposal of the debris, and the remediation of the disturbed area at the above address. The work has been done in significant compliance to the Order of Conditions issued on 4-11-09. MR completed a site visit on 2-24-11 and found that the resource areas show no sign of disturbance from the demolition work. MR recommend that the TCC issue a COC for the project. Motion to approve DB, second RC, so voted. RC asked if it was all stable, MR said yes.

2. Liberty & Union Industrial Park, Taunton Dev. Corp., (COC), SE73-1653 Motion to continue to 4-25-11, ST, second DB, so voted.
Certificate of Compliance
1. Briggs Street, COT-Water Div., (COC), SE73-2388 Field report states that this project was the 2009 Water Mains Improvements Project and the streets involved in this project are Briggs, McSoley, Marvel, Billings, Godfrey, Knight, Exeter, Bradford, and Dean Streets. Approximately 10,500 linear feet of existing 6-inch, 8-inch, and 12-inch diameter cast iron water mains were replaced with new 8- and 12-inch ductile iron and polyvinyl chloride water mains. There were 14 wetlands identified throughout the project and the proposed work was in BLSF, Riverfront, 100-foot buffer zone of BVW, and Inland Bank. All construction was within existing roadways and not in any of the resource areas. All roadways were repaved and new headwalls were installed over the brook. The siltation barriers
are still in place. All work has been completed in significant compliance to the Order of Conditions issued on 5-5-09. There is no indication of siltation within resource areas. All banks are stabilized, and all other disturbed areas have been stabilized and seeded. All siltation barriers should be removed. MR recommends that the TCC issue a COC for this project. Motion to approve once all siltation barriers are removed, ST, second RC, so voted. RC questioned whether the TCC really wanted to approve until hay bales are removed. MR said she would drive out to make sure they were removed.
2. 99 Seekell Street, Couto, (COC), SE73-1394 The field report states that this project was for the construction of a single family home with garage, deck, driveway, utilities, and associated grading. All work has been completed in significant compliance to the Order of Conditions issued on 1-12-00. MR recommends that the TCC issue a COC for this project. Motion to approve DB, second MI, so voted.
3. 470 Lothrop Street, Silvia, (COC), SE73-2313 The field report states that this project was for the construction of a 14-unit expansion to an existing Mobile Home Park, with roadway, detention basin, and grading. MR visited the site yesterday, 2-24-11, but MR was not able to determine if all work was done in accordance to the Order of Conditions due to the snow cover still on the detention basin and lawn areas. MR recommends that the TCC continue this hearing to 3-14-11. Motion to continue to 3-28-11, DB, second RC, so voted. MR will send RC a PDF of the plan.
4. 49 Cotuit Road, Smith, (COC), SE73-1471 The field report states that the project was for the construction of a garage and open breezeway. All work was completed in significant compliance with the order of conditions issued on 10-13-00. MR recommends that the TCC issue a COC for this project. Motion to approve, DB, second MI, so voted.

Continued Public Meetings
1. 80 Diniz Drive, Turner, (RDA), DSE-1005 The field report states that this project is for the construction of a 10’ x 20’ pool house within the 100-foot buffer zone of a BVW. MR visited this property on 2-24-11, but due to the snow cover MR was unable to verify the wetland line. MR recommends that the TCC continue this project to the 3-14-11 meeting. Motion to continue to 3-14-11, DB, second MI, so voted.

Continued Public Hearings
1. 342 Winthrop Street, St. Germain, (NOI), SE73-2463 The field report states that this project is for the construction of a convenience store, retail shops, restaurant, and a fueling station with canopy, on an existing disturbed site, with associated grading, lighting, and landscaping. This property is located on the south (right) side of Winthrop Street just past Harvard Street. MR did a site visit to this property on 2-24-11 and reviewed the wetland line. Matt St. Germain and John Sousa were both present at this visit. The wetland runs along the eastern property line south where it joins with an intermittent stream running from Joseph Warner Boulevard and then all water flows through a drainage pipe underground to the Three Mile River. This property falls within the Three Mile
River Area of Critical Environmental Concern (ACEC). MR is in agreement with the placement of the flags and therefore recommends that TCC approve the line as follows: Flags 3-19, with flags 1, 2, and 20 for reference purposes only. The proposed gas pumps and storage tanks will be outside conservation jurisdiction. Half of the proposed convenience store, a third of the retail and restaurant building, and portions of the parking lot fall into conservation jurisdiction. All storm water runoff falls within conservation purview. All work is outside the 25-foot WPZ. The Applicant is proposing to construct a 2,865 f convenience store, and a 6,891 sf one story multi-use building (restaurant and retail). The majority of the site will be paved for parking. Landscaping will be located on three sides of the property and an island in the front. A washout area and dewatering area should be noted on the plan. Stormwater will be managed by
infiltration trenches along the east and west landscaped areas (LID), and throug a storm water storage and attenuation system under the parking area in the southwest which will drain to the wetland. The City Engineer approves the drainage plan. Sheet 10 of the plan shows the siltation barrier, which has been in place since work started. The work as proposed should not negatively impact the wetlands or adjacent properties. MR recommends that the TCC approve this project and issue an order of conditions to include the attached special conditions. Motion to approve the wetland line as delineated and change right to left in the field report, DB, second MI, so voted. Motion to approve with special conditions 1-5, 7, 8, 9, 15, 17, 20, 21, 24-27, and 28-no snow storage in the buffer zone, and 29-trees need to be 12 feet or more as they are planted, ST, second NK, so voted. Just to be stated in the minutes: Mr. St. Germain agree to buy 4 trees and
work with the abutter on placing them on her property.
2. 47 Waverly Street, Whoolley, (ANRAD), SE73-2461 The field report states that this project is for approval of a wetland delineation performed by Robert Murphy of Conservation Consultants in November 2011. MR visited this site on 2-24-11, to review the wetland line. The wetland is located in the western portion of the property and runs along the edge of the lawn line and then a line of deciduous trees. The plan is missing the north arrow and the wetland line should be extended to the property line. The area shows drainage ditches throughout the wetland as it was previously used for agricultural purposes. This did make for a challenging interpretation of the wetland. MR is in general agreement with the delineation and recommends that the TCC approve the delineation as follows
and issue an ORAD for this location. Flags 1 through 21. MR also recommends that the revised plan showing the north arrow and extension of the wetland line to the property line be submitted prior to release of the ORAD. Motion to approve flags 1-21 and issue an ORAD, DB, second RC, so voted.

3. Lot 19A S. Precinct Street, Poillucci, (NOI), SE73-2462 The field report states that this project is for the construction of a single family home with associated grading and utilities on a property along the west side of S. Precinct Street within the buffer zone of a BVW. This wetland was previously approved under an ORAD issued on 12-13-05 (SE73-2120). This line was reflagged by Pilling Engineering for this filing. MR visited this site on 2-24-11 and was able to complete an inspection of the wetland line. MR is in agreement with the placement of the flags and recommends that the TCC approve the delineation as follows: flags WCI-101-WCI-116, and flags WCI-100 and WCI-117 for reference purposes only. The plans show the septic system in the front of the proposed house, with parking
to either side of the driveway. A ramp is proposed along the south side of the house that connects to the porch in the rear as a second means of egress. Grading will occur within 35 feet of the wetland. The rear porch will be 27 feet from the wetland. The limitations of the site prevent the construction from moving further from the wetland. A siltation barrier is depicted on the plan running along the 25-foot WPZ in the rear, and then along the sides of the project, and is noted as the limit of work. MR recommends that a washout area and a schematic of a dewatering plan be shown on the plan. MR also recommends that roof drains go into drywells or a similar infiltration system. The project as presented should not negatively impact the wetland, therefore, MR recommends that the TCC approve this project and issue an order of conditions to include the attached special conditions. Motion to approve the wetland line, ST, second DB, so
voted. Motion to approve with special conditions 1-5, 8, 15, 16, 17, 19, 20, 21, 23-27, MI, second ST, so voted.
4 155 Duffy Drive, Butterfield, (NOI), SE73-2464 The field report states that this project is for the construction of an in-ground pool with concrete apron and patio. The wetland was delineated by John Delano. MR visited this property on 2-24-11 and reviewed the wetland line. This line runs as the toe of slope at the back (east) of the property. Most of the wetland is off property with a sliver at the southeast corner of the property. MR recommends that the TCC approve the wetland as follows: flag 7 with flags 1-6 and 8-11 for reference purposes only. The applicant is proposing to install an in-ground pool with apron within the 25-foot WPZ and then planting high bush blueberry and sweet pepper to enhance the remainder of the WPZ near the pool. The 25-foot WPZ has
been established to protect resource areas from activities such as clearing, filling, or construction, which may result in a negative impact on this area… There are other options available that would not be as detrimental to the adjacent resource areas, and would keep construction out of the WPZ. MR met with John Delano, the applicant’s engineer, regarding construction options and he showed me a plan that would keep the pool at the same dimensions (12’x30’) and 25 feet from the wetland. MR cannot recommend approval of the pool construction as presented as it does not fit the exemptions to the 25-foot minimum WPZ, nor does it create a harship, as there are alternatives to this plan. MR recommends that the TCC deny this project as proposed. If an alternative design that is outside the WPZ is agreed upon by the TCC and the applicant , then MR would recommend approval to include the attached special conditions. Motion to approve the
wetland line, DB, second RC, so voted. Motion to approve the original plan for this project with special conditions 1-5, 17, 19, 21, 25-27, ST, second NK, 3 in Favor/3 Opposed, Chair votes in favor, motion carries 4-3.
Public Hearings
1. Richmond Street, COT-DPW, (NOI), SE73-2465 The field report states that this project is for the proposed emergency replacement of an existing dry stone masonry culvert that crosses Richmond Street. A site visit is scheduled with the DEP for 3-9-11. MR recommends that the TCC continue this hearing to 3-14-11 in order to accommodate this meeting. Motion to continue to 3-14-11, DB, second MI, so voted.
Other Business
1. John Tourkantonis re:Boyden. Gave his presentation on what his plan is for Boyden. He explained what he plans to do, how and with what funds. Motion to approve this project and work on getting the water going out there for the project, DB, second RC, so voted.
