12.06.10 Conservation Commission Minutes
Minutes of the Taunton Conservation Commission December 6, 2010


Present: Chair Brian Marques, Vice Chair Neil Kelly, Commissioners Ernest Enos, Marla Isaac, Debra Botelio, and Steven Turner.  Commissioner Renwick Chapman was absent.  

Motion to approve the minutes of 11-15-10, DB, second NK, so voted.

Certificate of Compliance
  • 98 Dwinell road, Medeiros, (COC), SE73-2437  Field report stated this project was for the expansion of the backyard through cutting trees, grading, adding loam, and seeding within the 25-foot WPZ.  The Applicant received an Order of Conditions on 7-27-20.  All work has been completed in significant compliance to the Order of Conditions.  The lawn is established and there seems to be no negative effect on the BVW.  MR recommends that the TCC issue a COC for this project.  Motion to approve and issue a COC for this project, DB, second MI, so voted.
  • 163 Worcester Street, Pelczarski, (COC), SE73-2428  Field report states that this project was for a septic repair and associated grading.  The order of conditions was issued on 3-25-10.  All work has been completed in significant compliance to the order of conditions.  The lawn is established and there seems to be no negative effect on the BVW.  MR recommends that the TCC issue a COC for this project.  Motion to approve and issue a COC DB, second ST, so voted.
Public Meetings
  • 48 Lakeview Place, Smith, (RDA), DSE-1004  Field report states that this project is for the construction of a porch in the front of the house within the 100-foot buffer zone of a BVW and Sabbatia Lake.  The wetland boundary is at the stone wall, with the lake 12 feet beyond the wall.  The porch, at its closest, will be 68 feet from the wetland.  The porch will be supported by six sona tubes, the holes of which will be dug by hand.  The project as presented will not negatively impact the wetlands or lake, therefore MR recommends that the tCC approve this project and issue a negative determination to include the attached special conditions.  Motion to issue a negative determination with special conditions 1, 2, 3, 4, 18, and 19, DB, second ST, so voted.


Extensions
  • 100 Field Street, Abreau, (EXT), SE73-2307  The field report states that this project is for the construction of a single family home with driveway, well, and septic system.  All work on the house has been completed but the Applicant has not been able to complete the exterior work-grading, loaming and seeding.  The Applicant is requesting a three year Extension to the order of conditions.  This filing is automatically extended through 11-13-12, per the Permit Extension Act, Section 173.  This request extends this order of conditions to 11-13-13.  MR recommends that the TCC approve this request and grant the three year extension.  Motion to extend for 3 years to 2013, DB, second MI, so voted.
Continued Public Hearings
  • 97 Ingell Street, Cooperative Production, Inc., (NOI), SE73-2452  Motion to continue to the first meeting in February, DB, second ST, so voted.  This would be February 7, 2011.
  • 110 Prince Henry Drive, Tribe Mediterranean Foods, (NOI), SE73-2445  Motion to continue to 12-20-10, ST, second DB, so voted.
Public Hearings
  • Winthrop Street, City of Taunton-DPW, (NOI), SE73-   Motion to continue to 12-20-10 because there is no DEP # yet, ST, second DB, so voted.
  • 195 Burt Street, Hicks, (NOI), SE73-2454  Field report states that this project is for a septic system upgrade within the 100-foot buffer zone of a BVW.  This property is on the west side of Burt Street and the wetlands are in the rear of the parcel.  The wetlands were flagged by Outback Engineering and MR is in agreement with the placement of the flags.  MR recommends that the TCC approve the delineations as follows: flags WF1 through WF6.  The work will consist of removing the existing septic system, adding a new 1500 gallon tank and leaching system, and moving the existing 8’x14’ shed further to the rear.  The shed will be 60 feet from the BVW at the new location but should not negatively impact the wetland.  The leaching field will be 52 feet from the wetland with grading 37 feet from the BVW at its closest.  The leaching field will also be 100 feet from the existing well, meeting Board of Health requirements.  A siltation barrier is depicted on the plan titled “Sewage Disposal System Upgrade Design” dated 10-15-10.  This should be considered the limit of work.  As proposed, this project will not negatively impact the adjacent wetlands.  MR recommends that the TCC approve this project and issue an order of conditions to include the attached special conditions.  Motion to approve the flags as delineated, DB, second ST, so voted.  Motion to approve with special conditions 1, 2, 3, 4, 5, 16, 17, 19, 21, 25, 26, 27, and 28-shed to be placed on sonar tubes, ST, second MI, so voted
  • Tremont Street, Quattrocchi/Court Company, (NOI), SE73-2456  Field report states this project is for the construction of a common driveway to serve two proposed lots within the 100-foot buffer zone of a BVW.  The TCC approved the wetland line and issued an ORAD on 8-2-10.  This property is adjacent to another project approved by the TCC.  This site is not within NHESP Priority Habitat but is within the ACEC of the Three Mile River.  The driveway will enter the property on the westerly side approximately ten feet from wetland flag #30.  This is the closest construction point to the wetland .  As the driveways progresses north, it veers farther from the wetland .  a siltation barrier is depicted on the plan beginning at a distance of five feet from the wetland to 25 feet from the wetland.  There is no alternative placement for the driveway entrance, therefore all precautions should be in place to prevent any impact to #591 Tremont Street, and the BVW is between this site and the previously approved subdivision’s property.  Any future construction on either lot associated with this filing will require a NOI separate from this project.  MR recommends that the TCC approve this project and issue an order of conditions to include the attached special conditions.  Motion to approve with conditions 1, 2, 3, 4, 5, 6, 16, 17, 19, 21, 25, 26, 27, and 28-no chemicals to be used on the driveway, DB, second MI, so voted.
  • 700 Joseph Warner Blvd., Sain-Gobain Performance Plastics, (ANRAD), SE-73  Motion to continue to 12-20-10, DB, second MI, so voted.
Violations
  • Town of Rehoboth-Glebe street (Vote to Remove).  Motion to remove the violation from the property, DB, second ST, so voted.  Motion to send a letter to the town of Rehoboth from Brian Marques thanking them for their prompt attention to this matter, ST, second Nk, so voted.
Other Business
  • 2011 Meeting Schedule.  Motion to approve dates and continue to meet at the Library until we move to Maxham School, DB, second MI, so voted.
  • Elections next meeting, Nominations tonight.  Motion to nominate Brian Marques for Chair DB, second MI, so voted.  Motion to nominate Neil Kelly for Vice Chair ST, second MI, so voted.  
  • Motion to pay an additional $2500.00 to the TCC’s consultant for the Tribe project, DB, second MI, so voted.
  • TCC asked MR to get clarification from Kevin on what the discussion of the budget was about regarding moving Wetlands Protection money into Offset Planning Budget.  TCC thinks maybe for salaries but not sure.  
  • BM discussed the City Council meeting he attended.
