8.23.10 Conservation Commission Minutes
Minutes of the Taunton Conservation Commission August 23, 2010


Present:  Marla Isaac, Ernest Enos, Brian Marques, Renwick Chapman, Steven Turner, Deborah Botellio, and Neil Kelly


Motion to approve the minutes of July 26, 2010, MI, second DB, so voted.


Certificate of Compliance
  • 172 Dean St., Hawthorne Development, (COC), SE73-2007  Field report states that this project was for the construction of a 28-unit condominium complex and a 4,800 square foot office building with associated drives, parking, landscaping, and utilities. The Order of Conditions was later amended to expand the existing parking area by 1,300 square feet with associated grading. All areas are stabilized and work was completed in significant compliance to the Order of Conditions issued on March 30, 2005 and later amended on May 21, 2007.  MR recommends that the TCC issue a COC for this project.  Motion to approve and issue a COC, DB, second NK, so voted.

Public Meetings
  • 50 Highland Street, #43 Butternut Circle, Ouellette, (RDA), DSE-997 Motion to open the hearing DB, second RC. Jim McCormack present representing the homeowner. Field report states that this project is located in the Leisurewoods Estates Mobile Home Park off Highland Street. The Applicant is proposing to construct a 12’ x 12’ sunroom onto the rear of the mobile home. The floor will be supported by sona tube footings and all work will e done by hand. The sunroom, after construction, will be 58’ from the wetland at its closest point. There is a detention pond behind this lot and the storm drain outfall is along the southern property line and the headwall is 25’ from the proposed sunroom. The work as presented should not negatively impact the wetlands or stormwater management structures. MR recommends that the Taunton Conservation Commission approve this work and issue a Negative Determination to include the attached Special Conditions. Motion to close the hearing and issue a negative determination with special conditions 1-4, DB, second NK, so voted.

Extensions
  • Tremont Street, Morgan, (EXT), SE 73-2232 NK steps down. Attorney David Gay representing the Applicant. The Applicant is requesting a three-year Extension of the Order of Conditions which was issued on October 24, 2007. This is for a 16-lot subdivision known as “The Preserve.” The Field Report stated that once the Applicant received all his approvals, the real estate market took a downturn and construction was postponed. The CA visited the site and found that no work had been started, although there is evidence of ATV activity. MR recommends that the Taunton Conservation Commission approve the request and grant a three-year Extension. Motion to issue a three-year Extension to the Order of Conditions, valid until October 24, 2013, DB, second RC, so voted.
ST arrives

Other Business
  • TMLP, 500 West Water Street, SE 73-2430. Karl Smith from TRC representing the Applicant. The Applicant is requesting a minor change to the Order of Conditions. During demolition activities, Project personnel assessed that the adjacent “Turbine Room” section of the building was in poor condition and would present a safety hazard if left in its present condition. As a result, TMLP is planning to demolish this room as part of the ongoing project. The Turbine Room is located outside the 25-foot Riverfront Area and approximately 1,600 square feet is located within the 100-foot buffer zone.
MR recommends the Taunton Conservation Commission approve this as a minor change. Motion to approve project change as minor and to have MR write a letter regarding this minor change and send to Applicant and include a copy in the file, DB, MI second, so voted.
  • Vinay Shaw-Vinay is an Eagle Scout and his proposed project is to clear the vegetation away from the boardwalk and add signage directing people to the Bardwalk. He would be starting this Saturday (August 28th) and would have two troops show up and get the work done within two weeks. All work will be done using hand tools. Motion to approve the project and good luck DB, second NK, so voted.
  • Fencing at Boyden.  Motion to approve additional $859.71 for fencing materials to come out of the Boyden account, DB, second MI, so voted.
  • Database.  Kevin Scanlon wrote requesting the Conservation Commission to approve expenditure from the Filing Fee Account of not more than $10,000 to complete our database records. Motion to approve the expenditure DB, second ST, so voted.  
  • Rehoboth and issue at 1561 Glebe St.  Complaint by homeowners that the town of Rehoboth is flooding their property and contaminating their well. Motion to invite Rehoboth officials to next meeting, ST, second NK, so voted.
  • 3 Eighth St.   Garage addition was done to house but there was encroachment into the wetland and there is no drywell per the plans and Order of Conditions. Engineer cannot do an as-built because of these issues. MR stated that the haybales and silt fence are still visible – they were put along the wetland rather than what the plan originally showed. Motion to issue a violation and to send a copy of the plan to commissioners, ST, second DB, so voted.
To alleviate this issue with hay bale placement there should be a note on the Order of Conditions to have the CA check the haybale line.
