APPROVAL OF THE MINTUES – February 14, 2011
Mr. Brown moved, seconded by Mr. Maloney and unanimously carried, that the minutes of February 14, 2011, be approved as submitted. Motion carried
CONTINUATION OF PUBLIC HEARING – WAGNER – 1 ARCHER PLACE
Ms. Lawrence stated that all of the members of the Zoning Board did attended the site visit of the neighbor’s house and viewed the back of the applicant’s house and could visualize the addition from the neighbor’s house. Ms. Lawrence required that two letters, one from the Wagner’s and one from the Singman’s be attached as part of the minutes.
Ms. Lawrence asked if anyone had anything they would like to say.
Sadie McKeown, 3 Archer Place, stated that they have always supported the single story addition but felt that the Wagners should utilize a shed roof which would maximize the air and light, as they did, in consideration of their neighbors, when they did their addition.
Ms. Lawrence asked if anyone else would like to speak. No one else wished to speak.
Ms. Lawrence then stated that the board took quite a lot of time to discuss this variance and hopes that everyone is satisfied that they have reviewed the plans and several revisions, visited the neighbor’s house and have taken into consideration all aspects of the application. She felt that the applicants have compromised considerably since their original application was a two story, which has now been reduced to a one-story with a slight shed roof. With the window and the light plane she felt that this is going to be an architecturally pleasing addition.
Ms. Lawrence moved, seconded by Ms. Brown, and unanimously carried, that the hearing be closed and the Board having arrived at the Findings required by the ordinance:
1. That the benefit to the applicant outweighs any detriment to the health, safety, and welfare of the neighborhood
2. That the proposed variance will not create an undesirable change to the neighborhood or detriment to the neighborhood
3. That the benefit the applicant seeks to achieve cannot be achieved by any other feasible method
4. That the variance is not substantial in the Board’s judgment
5. That the variance would not have an adverse environmental impact on the neighborhood
6. That the variance is the minimum one deemed necessary and will preserve and protect the character of the neighborhood and the health, safety and welfare of the community
7. Subject to any permits required by the building department.
