APPROVAL OF THE MINUTES
Ms. Merrill-Verma moved, seconded by Ms. Brown, and unanimously carried, that the minutes of September 8, 2008, be approved as submitted.
PUBLIC HEARING – WHITE – 51 GROVE STREET
The Secretary read the following Notice of Public Hearing:
PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Village of Tarrytown will hold a public hearing at 8:00 p.m. on Tuesday, October 14, 2008 in the Municipal Building, One Depot Plaza, Tarrytown, New York to hear and consider an application by
Lawrence and Barbara White
51 Grove Street
Tarrytown, NY 10591
for a variance from the Zoning Code of the Village of Tarrytown for property located at the above address regarding a 6 ft. x 12 ft. living room extension requiring the following variances:
1. Increase in the degree of non-conformity: (§305-18A(1))
- Minimum lot size is required to be 10,000 sq. ft. and 9,148 sq. ft. exists.
- Minimum width at front of house is required to be 100 ft. and 98.97 ft. exists.
- Minimum street frontage is required to be 100 ft. and 98.97 ft. exists.
- Minimum front yard setback is required to be 25 ft. and 7.1 ft. exists
- Minimum side yard setback is required to be 12 ft. and 3 ft. exists.
- Maximum height permitted is 30 ft. and 32 ft. exists.
- Maximum F.A.R. permitted is .366 (3348) and .53 (4825) exists.
2. Maximum F.A.R. allowed is .366 (3348) and .54 (4895 is proposed. (§305-107)
Documents are available for inspection in the Planning and Zoning Office at Tarrytown Village Hall. The property is shown on the Tax Maps of the Village of Tarrytown as Sheet 11, Block 40, Lot 5 and is located in an R-10 (Residential) zone.

All interested parties are invited to attend and be heard. Access to the meeting room is available to the elderly and the handicapped. Signing is available for the hearing impaired; request must be made to the Village Clerk at least one week in advance of the meeting.
Mr. Sam Vieira, Architect, introduced himself as a representative for the Whites of 51 Grove Street, who are requesting a variance for a small addition to the living room on the second floor over the covered porch. Mr. Vieira stated that local FAR regulations stated that an open porch with a roof does not count toward the bulk for the FAR; but once it’s enclosed, it does. Therefore, the Whites are requesting a variance for a small area, 6’ deep by 12’ wide, which is an extension of the existing living room, to come out to meet the existing wall. Since the roof already exists, there is no increase in the footprint or impervious surface. Basically they are requesting a 72 s.f. increase in FAR.
Ms. Brown asked if the FAR ratio was .01; and Mr. Vieira state it was at the end of the scale.
Chairwoman Lawrence asked if it was a two-family house and Mr. Vieira stated that it was.
Chairwoman Lawrence stated that the plans were very well done and that they showed exactly what was happening to the house.
Chairwoman Lawrence read the follow memo dated October 14, 2008 from Michael Blau, Environmental Review Officer, which was reported as received by the members of the Board:
I have reviewed this application for variances to allow for a living room extension. The majority of the variances are for existing non-conformities on the property. The only new variance is for Floor Area Ratio; but since the extension is under an existing roofed area, I have determined the proposal appears to pose no significant environmental impact. Should the Board agree, you may make a negative declaration under SEQRA.
Chairwoman Lawrence asked the owners if they would like to say anything and asked if anyone else was present to speak or if they heard anything from any of their neighbors, for which they responded “no.” She stated that the certified mailing receipts were submitted and the sign was posted in front of the house, so everyone knows what was going on.
Board members visited the property.

Ms. Merrill-Verma moved, seconded by Ms. Brown, and unanimously carried, that the Board determines there will be no significant adverse environmental impacts as a result of granting the variance for the proposed project.
Ms. Brown moved, seconded by Mr. Maloney, and unanimously carried, that the hearing be closed and Board grants the variances for 51 Grove Street subject to:
- Approval of plans by the Building Inspector.
- Approval of the plans by the Planning Board.
- Obtaining a building permit within two years.
ADJOURNMENT
Ms. Merrill-Verma, seconded by Mr. Maloney, and unanimously carried, that the meeting be adjourned – 8:05 p.m.
