CONTINUATION OF PUBLIC HEARING – CASE – 77 CREST DRIVE

No one appeared on behalf of the applicant.  No one appeared to speak on this application.  Chairwoman Lawrence noted the Secretary sent a letter to the applicant advising that if no additional submissions were received or if no one appeared to address the Board on this application tonight, the matter would be removed from the Board’s agenda.

Mr. Jolly moved, seconded by Ms. James, and unanimously carried, to remove the Case, 77 Crest Drive, application from the Board’s agenda.

CONTINUATION OF PUBLIC HEARING – RENHA – 3 WINDLE PARK

No one appeared on behalf of the applicant.  No one appeared to speak on this application.  Chairwoman Lawrence noted the Secretary sent a letter to the applicant advising that if no additional submissions were received or if no one appeared to address the Board on this application tonight, the matter would be removed from the Board’s agenda.

Mr. Jolly moved, seconded by Ms. James, and unanimously carried, to remove the Renha, 3 Windle Park, application from the Board’s agenda.

CONTINUATION OF PUBLIC HEARING – DUNBAR – 94 MAIN STREET

Chairwoman Lawrence noted the architect for the applicant has requested an adjournment until the Board’s October meeting.  No one appeared to speak on this application.

Chairwoman Lawrence requested the Secretary arrange another site visit prior to the October meeting.

The Board unanimously agreed to continue this hearing at the Board’s October meeting.

CONTINUATION OF PUBLIC HEARING – MOSA – 163 RIVERVIEW AVENUE

Chairwoman Lawrence noted the Board revisited this property yesterday and they measured the outline for the proposed addition as reduced and as originally proposed.

Mrs. Mosa stated they showed the Board why the drainage from their property is not a problem.  They have shown the plans to one neighbor since last month.  They attempted to show the plans to the other neighbor but they have been away.  The addition has been reduced to 9 ft. x 20 ft.  It has been reduced in length and width.  (The revised plans show a 17.45 ft. rear yard setback where 26 ft. is required.)

Chairwoman Lawrence questioned whether anyone wished to address the Board on this application.  No one appeared.

Counsel Shumejda noted last month the Board had requested that the architect submit a line drawing of the houses on the street and there should be photographs submitted showing houses north, south, east and west.  Mrs. Mosa stated they did not want to incur additional architectural costs especially since they did not know whether this variance would be granted.  She stated they would agree that they probably have the largest house in the neighborhood but there are other houses that are as tall if not taller than their house.

Counsel Shumejda stated the line drawing would show the size and bulk of the houses in the neighborhood.  It was a reasonable request but the applicant chose not to comply.

Mrs. Mosa’s daughter stated the Board has made several visits to the property and has seen the size and height of the houses in the neighborhood.  Her family did not want to incur the additional architectural expenditure.

Ms. Brown stated the photographs could still be provided.  She noted the proposed addition does not affect the height of the house since it is a one-story addition.

Chairwoman Lawrence stated the house is probably larger than 90% of the houses on the block; however, it is not obtrusive since it is a dark cedar shake and it is set back on the property with a lot of foliage in the front.  The proposed addition is in the back and won’t affect the appearance from the street.  Ms. Brown stated it will not be visible to the neighbor in the rear as well.

Mr. Jolly stated if the applicant does not want to incur the additional architectural expense for the line drawing, they could go to the Town of Greenburgh’s web site, which will show the Floor Area Ratios for all the houses on the street.  That would provide the Board with bulk information.

Chairwoman Lawrence stated the photographs and FAR information for houses on the street would be helpful to the Board.

Ms. Brown stated what concerns her is that the requested variance is a large one and the only comment in the record is from a neighbor who objected.

Mrs. Mosa stated they will be removing the tool shed that is on the property so that will open a large area on the side.  Ms. Mosa stated the house has been its current size for 25 years and when added on to in the past no variances were ever needed.

The Board unanimously agreed to continue this hearing at the Board’s October meeting and requested the applicant submit the photos and F.A.R. information.

APPROVAL OF MINUTES

Mr. Jolly moved, seconded by Ms. Brown, that the minutes of August 13, 2007, be approved as submitted.  Chairwoman Lawrence and Ms. James abstained.  Mr. Jolly, Ms. Brown, and Ms. Merrill-Verma assented.  Motion carried.

ADJOURNMENT

Ms. James moved, seconded by Ms. Brown, and unanimously carried, that the meeting be adjourned – 8:30 p.m.
