ADJOURNMENT TO EXECUTIVE SESSION – 7:00 p.m.

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, to adjourn to executive session to discuss a personnel matter.

REGULAR MEETING RECONVENED AT 8:00 P.M.

The meeting began with the Pledge to the Flag.

REPORTS

There were no Board of Trustee reports.

CLOSING OF GRIEVANCE DAY

Trustee McGee moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 7-0      

WHEREAS, Grievance Day in the Village of Tarrytown commenced at 4:00 p.m. on Tuesday, February 17, 2015; and

WHEREAS, the purpose of Grievance Day is to hear tax grievance proceedings; and

WHEREAS, Grievance Day was conducted in accordance with the requirements of New York State Law.

NOW THEREFORE, BE IT RESOLVED that Grievance Day is hereby closed.

BE IT FURTHER RESOLVED that all grievances are hereby referred to the Village Assessor for a written report on the grievances filed on Grievance Day to be received on or before April 1, 2015.  The Village Assessor is hereby authorized and directed to arrange for hearings with taxpayers who have requested hearings.

ADMINISTRATORS REPORT

Administrator Blau reported the following:

Ice Skating - During the 2014 ice skating season, one of the Village Parks and Recreation staff members was driving a small tractor on the Upper Tarrytown Lake to clear the ice of snow when the staff member and tractor broke through the ice.  The specific location where the staff member and tractor broke through the ice was in the middle of the large general skating area where the majority of ice skaters are skating during the season.  Thankfully our staff member was fine, but this incident brought to the forefront a question regarding how the Village can assure the safety of Village staff and the ice skating public on the lake where people had skated in the past.

Since that time the Village has been pursuing two avenues to address ice skating in the Village.  The first is the development of a synthetic ice rink on the tennis courts in Pierson Park.  The second is the reopening of the Upper Tarrytown Lake for ice skating.  The synthetic ice rink would enable the Village to assure ice skating throughout the ice skating season, regardless of the temperature.  The rink would be smaller than the area provided on the Upper Tarrytown Lake for ice skating and the development of the rink comes at a cost, but the availability and operation is not subject to the elements.  The reopening of the Upper Tarrytown Lake requires action by the Village to establish new ice testing, safety and rescue protocols.  The Village is in the process of working with various entities to establish those protocols.
 
There is no doubt that the ice skaters in Tarrytown want to get out to the lake to skate, or for the Village to find an alternative if such an alternative is appropriate for the Village.  However, ice skating will not occur on the Upper Tarrytown Lake until the Village can assure the safety of everyone going ice skating.  The Village greatly appreciates your patience as we go through this process.   

Administrator Blau received information from our insurance agent today regarding signage, flags to display whether ice skating is open or closed.  He also requested ice rescue protocols and operational protocols from a large municipal insurance carrier.   He will then draft these protocols for the board’s review.

Mayor Fixell asked if anyone wanted to address the Board on agenda items.  No one appeared.

APPOINTMENT OF LABORER
Trustee Basher moved, seconded by Trustee McGovern, that the following be approved. Motion carried, all voting “aye” with the exception of Trustees Butler and Zollo who voted “no” and Trustee Hoyt recused himself because his son applied for the position.  Approved: 4-2-1

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby appoint William Avery to the position of Laborer, Step 1, effective February 18, 2015, at an annual salary of $45,165.00, subject to all civil service rules and regulations.

APPOINTMENT OF A MEMBER OF THE ADVISORY COMMITTEE FOR THE RIVERWALK PARK EXTENSION AT LOSEE PARK AND FOR THE PEDESTRIAN TUNNEL

Trustee Hoyt moved, seconded by Trustee Butler, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby rescind the appointment of J. P Hill as a member of the Advisory Committee for the RiverWalk Park Extension at Losee Park and Pedestrian Tunnel representing the Parks and Recreation Advisory Council, due to his inability to attend meetings during the day, and does hereby appoint Henry Crepeault to serve as the representative from the Parks and Recreation Advisory Council on the Advisory Committee for the two noted projects.  

LIEUTENANTS BARGAINING UNIT AGREEMENT

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the collective bargaining agreement between the Village of Tarrytown and the United Federation of Police Officers, Inc. on behalf of the Tarrytown Lieutenants Bargaining Unit, Local 588 effective June 1, 2012, through May 31, 2016 at an annual increase of 2.6%, 2.6%, 2.75% and 3% respectively and does hereby direct and authorize the Village Administrator to execute the agreement with the United Federation of Police Officers, Inc.

VEHICLE AND TRAFFIC CODE AMENDMENT – SNOW EMERGENCY PARKING – CHURCH STREET

Trustee Butler moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the following amendments to Chapter 291 of the Code of the Village of Tarrytown entitled “Vehicles and Traffic” as follows:
  • For the creation of a parking restriction when snow emergency parking is in effect on Church Street; and
  • For clarification of a section of snow emergency parking on MacArthur Lane,
which was rescinded several years ago and replaced with no parking any time but was not stricken from the code.

§291-89.  Schedule XXIV:  Snow Zones

In accordance with the provisions of Article IV, Snow Emergency Parking, the following locations are hereby designated as snow zones, and no person shall park any vehicle or permit any vehicle to remain parked in any of said places while snow is falling or while the Village is engaged in removing snow from such places:

VEHICLE AND TRAFFIC CODE AMENDMENT – RESCINDING OF HANDICAPPED PARKING SPACE – RIVERVIEW AVENUE

Trustee McGee moved, seconded by Trustee Basher, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the following amendment to Chapter 291 of the Code of the Village of Tarrytown entitled “Vehicles and Traffic” to allow for the rescinding of a parking space reserved for handicapped persons in front of 63 Riverview Avenue, which is no longer needed in this area.

Material to be deleted is set forth in parenthesis ( ).

Section 291.92. Schedule XXVII:  Handicapped Parking Spaces.

VEHICLE AND TRAFFIC CODE AMENDMENT – PARKING CHANGE – NORTH WASHINGTON STREET

Trustee Basher moved, seconded by Trustee Hoyt, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the following amendment to Chapter 291 of the Code of the Village of Tarrytown entitled “Vehicles and Traffic” to allow for changes that will prohibit parking during certain hours in front of the Neighborhood House to allow for parking by the senior vans to service the Neighborhood House for the senior nutrition program.

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the following amendment to Chapter 291 of the Code of the Village of Tarrytown entitled “Vehicles and Traffic” by adding a new section and schedule to prohibit trucks, commercial vehicles and buses not making stops from using Franklin Street as a method of traveling from the Depot Plaza area to Broadway.

Trustee Basher moved, seconded by Trustee Zollo, that the following resolution be approved.  Motion carried, all voting “aye” with the exception of Mayor Fixell and Trustee Butler who abstained.   Approved: 5-0
                        
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the regular meeting of the Board of Trustees held on January 20, 2015 as submitted by the Village Clerk.

APPROVAL OF THE MINUTES OF THE SPECIAL JOINT MEETING OF THE BOARD OF TRUSTEES AND THE PLANNING BOARD HELD ON DECEMBER 16, 2014

Trustee Basher moved, seconded by Trustee McGee, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the special joint meeting with the Board of Trustees and the Planning Board held on December 16, 2014 as submitted by the Village Administrator.

APPROVAL OF THE MINUTES OF THE SPECIAL MEETING OF THE BOARD OF TRUSTEES HELD ON FEBRUARY 4, 2015    

Trustee Butler moved, seconded by Trustee McGovern, and unanimously carried, that the following resolution be approved:  Approved: 7-0
                        
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the special meeting of the Board of Trustees held on February 4, 2015 as submitted by the Village Administrator.

APPROVAL OF AUDITED VOUCHERS

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve Abstract No. 15 of Audited Vouchers to be paid in the following amounts:

OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD.  SPEAKERS HAVE FIVE (5) MINUTES BEFORE YIELDING TO THE NEXT SPEAKER; THEN THREE (3) MINUTES FOR ADDITIONAL COMMENTS

Francesca Spinner, 206 Wilson Park Drive, thanked Police Chief Scott Brown and the Police Department for addressing the parking issue in front of the Neighborhood House to accommodate the Senior Van dropping off and picking up seniors participating in the Town of Greenburgh’s nutrition program which will now be operating 5 days a week at the Neighborhood House.  Chief Brown recommended two parking spaces, but if it is later determined that only one parking space is needed, the Neighborhood House will come back to the Board and request that the parking restriction be reduced to one space.  She knows that parking is tight on that street.  Ms. Spinner noted that they are working on making some upgrades to the building to accommodate the nutrition program.   When the upgrades are complete, she would like to invite the Board of Trustees to an official ribbon cutting to the new nutrition program.
