PRESENT:  Deputy Mayor Basher presiding; Trustees Butler, Hoyt, McGee; McGovern and Zollo; Deputy Village Administrator Hart; Village Attorney Shumejda and Village Clerk Booth

ABSENT:  Mayor Fixell

Trustee Hoyt moved, seconded by Trustee Butler, that the following resolution be approved.  Motion carried, all voting “aye” with the exception of Trustee Zollo who recused himself.    Approved: 5-0-1

RESOLUTION ORDERING REMOVAL OF BUILDING OWNED BY WAYNE ERIC WRIGHT

At a Special Meeting of the Board of Trustees of the Village of Tarrytown held on June 24, 2014 at One Depot Plaza, Tarrytown, New York at 8:00 A.M.

WHEREAS, the Building Inspector of the Village of Tarrytown has filed his survey in writing with the Board of Trustees of the Village of Tarrytown containing his findings and recommendations regarding a certain building owned by Wayne Eric Wright at 13 John Street, Tarrytown, New York 10591 designated by Tax Map No. 1.70-34-7 in which survey said Building Inspector states his opinion that said building is unsafe and dangerous to the public and recommends its immediate removal, and

NOW THEREFORE BE IT RESOLVED, the Board of Trustees of the Village of Tarrytown after reviewing said survey in regard thereto and after having duly deliberated upon the same, hereby determines that said survey warrants the removal of the building.

NOW THEREFORE BE IT RESOLVED, that: (1) notice be given to Wayne Eric Wright, the owner of the building situate on premises on 13 John Street, Tarrytown, New York designated by Tax Map No. 1.70-34-7, (2) said notice to be served personally upon said Wayne Eric Wright or by Registered Mail to his last known residence if any and if he cannot be reasonably found for such personal service by affixing a copy thereof upon said building and (3) said notice shall order the removal of the building.

NOW THEREFORE BE IT FURTHER RESOLVED, that pursuant to §105-8 of the Village of Tarrytown Code entitled "Emergencies," the Deputy Mayor hereby determines that any delay of proceedings provided for in Chapter 105 of the Village Code would result in probable loss of life and property; therefore, the Deputy Mayor hereby directs the Building Inspector to proceed at once to take the necessary action to guard the safety of persons and property.
NOW THEREFORE BE IT FURTHER RESOLVED that the Board of Trustees of the Village of Tarrytown hereby ratifies the Deputy Mayor's declaration of an emergency pursuant to §105-8 of the Village of Tarrytown Code.

NOW THEREFORE BE IT FURTHER RESOLVED that the Board of Trustees of the Village of Tarrytown hereby directs the Village Attorney to bring a proceeding at a special term of the Supreme Court, Westchester County, for an order determining the building to be a public nuisance and directing that it shall be taken down and razed and that in the event that Wayne Eric Wright fails to take down and raze such building, the Village of Tarrytown will to take down and raze such building and assess the costs and expenses  according to Chapter 105 of the Village Code and New York General Municipal Law §78-b.

Trustee Zollo moved, seconded by Trustee Butler, and unanimously carried, that the meeting be adjourned at 8:15 a.m.
