Village Board of Trustees Minutes 11/4/2013

PRESENT:  Mayor Fixell presiding; Trustees Basher; Butler, Hoyt; McGee, McGovern and Zollo; Administrator Blau; Treasurer Hart and Village Clerk Booth

The meeting began with the Pledge to the Flag.

REPORTS

Mayor Fixell reported on the following:

  • Tomorrow is Election Day and the polling places will be at the normal locations that you go to for national elections.
  • We are in the middle of leaf season and once again he urged people to mulch your leaves in place whether you do your leaves yourself or have a contractor do it.  It saves time, money and it is good for your lawn and gardens.
  • Our code states that green industry contractors are not permitted to blow leaves on Saturdays, Sundays and holidays anytime during the year.  Individual homeowners are permitted, but landscape contractors are not.  He asked that residents remind their contractors of this code provision.
Trustee McGovern noted that the Tarrytown Senior Citizen Meeting this week will be held on Wednesday, November 6th instead of Tuesday, November 5th due to Election Day.

Trustee Hoyt reported on the following:

  • He thanked everyone who attended the Village’s Annual Halloween Parade; it was a great success.  He also thanked everyone involved in making it a great success.  The video of the parade will be on our website.
  • This Sunday, November 10th, is our Annual Pilgrim Run (4-mile run). It will be held at Hackley School at 10:30 a.m.  For more information, please contact the Recreation Department at 631-8347.
VILLAGE ADMINISTRATOR’S REPORT

H- Bridge - Repair work on the H- Bridge Northwest Ramp is scheduled to commence on November 7, 2013.  For Phase Four, the northwest ramp connecting Main Street, Depot Plaza, Cortlandt Street, West Main Street and Green Street to Division Street in Tarrytown and River Road in Sleepy Hollow will be closed to all traffic.  In order to access the businesses on Division Street and the Tarrytown DPW, vehicles from Tarrytown must travel north on Cortlandt Street in Sleepy Hollow to Beekman Avenue; then west on Beekman Avenue to River Road; south on River Road to Division Street.
All other ramps on the H-Bridge will be reopened to two way traffic.
Notice is being placed on the website and scroll.  In addition, an email blast was sent to all people with commuter parking permits and the businesses on Division Street are receiving notice.

OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD ONLY ON AGENDA ITEMS.  SPEAKERS SHALL HAVE THREE (3) MINUTES TO ADDRESS THE BOARD OF TRUSTEES

Mayor Fixell asked if anyone wanted to address the Board on agenda items. No one appeared.

DECLARING THE DATE, POLLING HOURS, DESIGNATED POLLING PLACES AND THE PAY FOR ELECTION INSPECTORS WITH RESPECT TO THE VILLAGE ELECTION TO BE HELD ON MARCH 18, 2014

Trustee Basher moved, seconded by Trustee McGovern, and unanimously carried, that the following resolution be approved:  Approved: 7-0  

BE IT RESOLVED, that the Village Election shall be held on Tuesday, March 18, 2014, between the hours of 7 a.m. and 9 p.m.

The following Polling Places have been designated:

District No. 1          - Village Hall, One Depot Plaza
District No. 2          - Main Street Firehouse, 50 Main Street
District No. 3                  - Main Street Firehouse, 50 Main Street         
District No. 4                  - First Baptist Church, 56 South Broadway
District No. 5          - First Baptist Church, 56 South Broadway
District No. 6          - Village Hall, One Depot Plaza
District No. 7                  - Washington Engine Firehouse, 157 White Plains Road
District No. 55                 - Washington Engine Firehouse, 157 White Plains Road
District No. 74         - Village Hall, One Depot Plaza
District No. 76         - Washington Engine Firehouse, 157 White Plains Road
        
BE IT FURTHER RESOLVED, that the pay for Election Inspectors shall be $200.00 for Election Day. The Chairman in each district shall be paid an additional $25.00 on Election Day.  The hours for which the Election Inspectors shall be paid on Election Day shall be from 6:30 a.m. to 9:30 p.m. for a total of fifteen hours.

BE IT FURTHER RESOLVED, that Election Inspectors be appointed to serve on Election Day, Tuesday, March 18, 2014, in accordance with Section 15-116(1) of the Election Law.

BE IT FURTHER RESOLVED, that all persons appearing on the permanent Voter Registration List provided by the Westchester County Board of Elections shall be eligible to vote.  Pursuant to Section 15-118(3) of the Election Law, the Village no longer conducts a local Village registration day;

BE IT FURTHER RESOLVED, that the Village offices to be filled on Election Day, Tuesday, March 18, 2014, and the terms of those offices are as follows:

BE IT FURTHER RESOLVED, that the Board of Trustees shall hold a Special Meeting on Tuesday, March 18, 2014 at 10:00 p.m. at the Tarrytown Village Hall to canvass the vote of the 2014 Village Election.

BE IT FURTHER RESOLVED, that the Board of Trustees request all Election Inspectors vote in their respective, personal designated voting districts and not by absentee vote.

APPOINTMENT OF AUTOMOTIVE MECHANIC II

Trustee McGovern moved, seconded by Trustee Hoyt, and unanimously carried, that the following resolution be approved:  Approved: 7-0    

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby appoints Jason Mauguin to the full-time position of Automotive Mechanic II, Step 4, effective November 5, 2013 at an annual salary of $67,054 subject to all Civil Service rules and regulations.

FIRE DEPARTMENT MEMBERSHIP CHANGE
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 7-0     

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the following Fire Department membership change recommended at the October 15, 2013 Board of Fire Wardens meeting:   Driver:  Paul Cappella has been approved as a driver for Conqueror Hook & Ladder.

CHANGE THE DATE OF THE BOARD OF TRUSTEES WORK SESSIONS

Trustee Butler moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 7-0     

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby reschedule the following Board of Trustees Work Sessions:

  • November 27th Board of Trustees Work Session from Wednesday, November 27, 2013 to Tuesday, November 26, 2013
  • January 1st Board of Trustees Work Session from Wednesday, January 1, 2014, to Thursday, January 2, 2014.
RESOLUTION – CORRECTION OF MINUTES

Trustee Zollo moved, seconded by Trustee Butler, that the following resolution be approved.  Motion carried, all voting “aye” with the exception of Trustees Basher, Hoyt and McGovern who abstained.   Approved: 4-0-3 

WHEREAS, Peter Bartolacci addressed the Board of Trustees at the meeting of August 19, 2013 during the “Opportunity for the Public to Address the Board”; and

WHEREAS, the minutes associated with the August 19, 2013 Board of Trustee meeting reflect a statement by Mr. Bartolacci referring to replacement of a retaining wall on his property; and

WHEREAS, Mr. Bartolacci contacted the Village Clerk to request that the minutes be corrected to reflect that he referred to a repair of the retaining wall and not a replacement of the retaining wall; and

WHEREAS, the Village Clerk reviewed the video of the August 19, 2013 meeting and confirmed that Mr. Bartolacci stated repair and not replace; and

WHEREAS, the Board of Trustees is willing to correct the minutes as per the request of Mr. Bartolacci.

NOW THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby correct the minutes of August 19, 2013 by changing the sentence in the minutes to show that Mr. Bartolacci said at the meeting that he is trying to repair the retaining wall as follows:

From:  He is trying to replace an existing retaining wall on his property to alleviate the health and safety hazards currently present.
To:  He is trying to repair an existing retaining wall on his property to alleviate the health and safety hazards currently present.

APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD OF TRUSTEES HELD ON OCTOBER 21, 2013
        
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 7-0     

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the regular meeting of the Board of Trustees held on October 21, 2013 as submitted by the Clerk.

APPROVAL OF AUDITED VOUCHERS

Trustee Zollo moved, seconded by Trustee Butler, and unanimously carried, that the following resolution be approved:  Approved: 7-0     

BE IT RESOLVED the Board of Trustees hereby approves the Audited Vouchers included in Abstract No. 8 and hereby orders the Audited Vouchers to be paid in the following amounts:

        General         $   187,377.55
        Water                                  25,041.70
        Sewer Fund                              0.00
            Capital                          293,938.46
            Library                            12,007.38
        Trust & Agency                8,498.22
        Total                       $   526,863.31

Mayor Fixell asked whether anyone wished to address the Board on any matter.  No one appeared.

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the meeting be adjourned at 8:13 p.m.
