PRESENT:  Mayor Fixell presiding; Trustees Basher, Hoyt, McGee; McGovern and Zollo; Administrator Blau; Treasurer Hart; Village Attorney Shumejda and Village Clerk Booth

ABSENT:  Trustee Butler

The meeting began with the Pledge to the Flag.

PUBLIC HEARING – TAX LEVY CAP LEGISLATION

Trustee Hoyt moved, seconded by Trustee Basher to open the public hearing.  Motion carried 6-0.  

Mayor Fixell asked if anyone wanted to speak on the proposed legislation.  No one spoke during the public hearing.

Trustee Basher moved, seconded by Trustee McGovern to close the public hearing.  Motion carried 6-0.  

Trustee Basher moved, seconded by Trustee McGovern to approve the following resolution.  Motion carried 6-0.  

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby adopt a proposed Local Law authorizing a property tax levy in excess of the limit established in General Municipal Law §3-c.

WHEREAS, a public hearing was held for the proposed action on May 1, 2013; and

WHEREAS, a notice of public hearing was published in the Journal News on April 26, 2013; and

WHEREAS, the Board of Trustees of the Village of Tarrytown is the only agency which has approval authority over the Proposed Action, and is therefore the Lead Agency for the Proposed Action.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

In accordance with Article 8 of the State Environmental Conservation Law and 6NYCRR Part 617, including without limitations the criteria set forth in 6 NYCRR Part 617.7(c) and based upon review of the Environmental Assessment Form and all other materials that were prepared for the Proposed Action, the Village Board of Trustees hereby determines that Proposed Action will not have a significant adverse impact on the environment, and hereby adopts a Negative Declaration.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Board of Trustees of the Village of Tarrytown hereby adopts Local Law No. 2 of 2013.

BUDGET ADOPTION RESOLUTION FISCAL YEAR 2013-2014

Administrator Blau noted that the difference between the amount the Board of Trustees could have increased the tax levy and still remain within the 2% tax levy cap is $706,453.00.

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 6-0     

WHEREAS, the Board of Trustees has met at the time and place specified in the notice of public hearing on the tentative budget and heard all persons desiring to be heard thereon.

NOW, THEREFORE, BE IT RESOLVED, that the tentative budget as amended and revised and as hereinafter set forth is hereby adopted and that there be and is hereby appropriated for the objects and purposes specified, including the amounts set forth required for the payment of principal and interest on indebtedness, the following amounts:

FISCAL YEAR 2013-2014 TAX LEVY AND WARRANT
        
WHEREAS, the budget for the fiscal year commencing June 1, 2013, has been duly adopted and filed with the Village Clerk; and

WHEREAS, it has been thereby determined that the sum of $21,985,765 will be necessary to meet the obligations of the Village; and       

WHEREAS, there has been duly credited as against said sum estimated revenues and appropriated fund balance aggregating $7,170,889 leaving $14,814,876 to be raised by the levying of taxes; and

WHEREAS, it appears from the Assessment Roll of the year 2013 for taxes for the fiscal year June 1, 2013 that the total assessed valuation of real property in the Village is $51,839,776;

NOW THEREFORE BE IT RESOLVED, that the tax rate for the Village of Tarrytown for the fiscal year commencing June 1, 2013 be and the same hereby is fixed at the rate of $285.78 on each $1,000 of assessed valuation for properties in the Village of Tarrytown.

BE IT FURTHER RESOLVED that the sum of $14,814,876, the same being taxes for the fiscal year commencing June 1, 2013 be, and the same hereby is, levied upon the taxable property in the Village of Tarrytown and that the Village Treasurer be and he hereby is authorized and directed to extend and carry out upon the roll the amount to be collected from each of the persons named thereon, and the respective amounts of said tax roll against each such parcel of taxable property set forth thereon be and the same hereby are levied upon each parcel of taxable property respectively which said levy includes items shown on the budget for the fiscal year commencing June 1, 2013.        

ADJOURNMENT

Trustee Zollo moved, seconded by Trustee Basher, and unanimously carried, that
the meeting adjourn to the regular Work Session at 6:10 p.m.
