The meeting began with the Pledge to the Flag.
MOMENT OF SILENCE – ELIZABETH (LIBBY) MASCIA
Mayor Fixell requested a moment of silence in honor and recognition of Elizabeth (Libby) Mascia who passed away this past weekend. She was a wonderful Tarrytown resident for many years and the founder of the Elizabeth Mascia Day Care Center.
VILLAGE ADMINISTRATOR’S REPORT
Parking – The Pierson Park – Andre Brook improvement project includes the reconstruction of parking islands, the replacement of street lights and the milling and repaving of the portion of the non-resident parking lot that is not being used for the expansion of Pierson Park for tennis courts and a basketball court. The work is scheduled to begin this coming Friday, September 21. The Village is working on creating alternate locations for parking purposes and a flyer designating the temporary commuter parking areas will be provided to all cars parked in the parking lots. Signage noting the additional locations will also be installed and information will be provided on the website. The Village is working at compressing the construction timetable for the parking lot work so as to reduce the
level of inconvenience caused by the construction work.
Street Repaving – The contractor started milling the roads to be repaved last Thursday. Today, Walnut, Browning, Embree, Front and High from Front to Lincoln were repaved. Weather permitting, Benedict from Loh to Martling and Altamont, from Rosehill to Fairview will be repaved either tomorrow or Wednesday. Hanford Place is also on the list of streets scheduled for repaving and it will be repaved should there sufficient funds remaining in the repaving budget for 2012. The Village, working cooperatively with the other five Villages in the Town of Greenburgh, jointly bid the milling and repaving projects. This cooperative bidding has significantly reduced our paving costs and has enabled the Village to pave more streets than when the Village bid the repaving project separately.
PUBLIC HEARING – ALARM USER PERMITS (adopted)
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Tarrytown will hold a public hearing on the 17th day of September, 2012, at 8 PM, in the Municipal Building, One Depot Plaza, Tarrytown, New York 10591, to hear, discuss and to act upon a proposed amendments to Chapter 76 entitled “Alarm Systems” of the Code of the Village of Tarrytown. A summary of the legislation is available at Village Hall. The complete text of this legislation follows:
A LOCAL LAW to amend §76.3, Alarm User Permits; Application; Fee; Violations; Denial or Revocation of Chapter 76 entitled “Alarm Systems” of the Code of the Village of Tarrytown.
SECTION 1. LEGISLATIVE INTENT AND FINDINGS OF FACT.
A. Findings of Fact.
The existing Code requires that alarm system permits be renewed on an annual basis. Village staff involved in the permit renewal process has received input from residents and businesses involved in the renewal process that the process should be extended to a renewal every two years. It is the recommendation of staff to the Board of Trustees that Chapter 76 be amended to provide for a renewal process every two years to accommodate the residents and businesses, which would also simplify the process for Village staff.
B. Legislative Intent.
It is the intent of the Board of Trustees of the Village of Tarrytown to amend the language of §76 entitled "Alarm Systems” of the Code of the Village of Tarrytown, Section 3.B.(2) to provide for renewals of alarm permits every two years as opposed to every year.

SECTION 2. Amendment to §76-3, “Alarm User Permits; Application; Fee; Violations; Denial or Revocation”, Sub-section 3.B. of Chapter 76 entitled “Alarm Systems” of the Code of the Village of Tarrytown.
(2) Any property owner or lessee of property in the Village of Tarrytown having on his or her premises an alarm device shall apply to the licensing authority for an alarm user permit on a form designated by the licensing authority. Such alarm user permit is nontransferable. Such permit shall be valid for a two [one]-year period, commencing on January 1 and expiring on December 31, two years after the said January 1. [on a calendar-year basis, expiring on December 31 of each year.] Notwithstanding this subsection, a holder of an alarm user permit may continue to operate his/her permitted alarm system until January 31 of the year following the expiration of his/her alarm user permit. [Such permit shall be for an indefinite period, subject to the
provisions of Subsection B(3) below.]
[(3)An alarm user permit shall remain in full force and effect, provided that there is no change in the alarm device or the central alarm station. Should such a change occur, the alarm user shall apply for a new alarm permit pursuant to provisions of this section.]
SECTION 3. EFFECTIVE DATE
This local law shall take effect immediately, as provided by law.
All interested parties are invited to attend and be heard. Access to the meeting room is available to the elderly and the handicapped. Signing is available for the hearing-impaired; a request must be made to the Village Clerk at least five days in advance of the meeting.

Trustee McGovern moved, seconded by Trustee Zollo, and unanimously carried, that the hearing be closed.
Trustee McGee moved, seconded by Trustee McGovern, and unanimously carried, that the following resolution be approved: Approved: 7-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby amend the Code of the Village of Tarrytown, Chapter 76-3 entitled “Alarm user permits; application; fee; violations; denial or revocation,” to provide for renewals of alarm permits every two years as opposed to every year.
WHEREAS, a public hearing was held for the proposed action on September 17, 2012; and
WHEREAS, a notice of public hearing was published in the Journal News on September 7, 2012; and
WHEREAS, the Board of Trustees of the Village of Tarrytown is the only agency which has approval authority over the Proposed Action, and is therefore the Lead Agency for the Proposed Action.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
In accordance with Article 8 of the State Environmental Conservation Law and 6NYCRR Part 617, including without limitations the criteria set forth in 6 NYCRR Part 617.7(c) and based upon review of the Environmental Assessment Form and all other materials that were prepared for the Proposed Action, the Village Board of Trustees hereby determines that Proposed Action will not have a significant adverse impact on the environment, and hereby adopts a Negative Declaration.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Board of Trustees of the Village of Tarrytown hereby adopts Local Law No. 7 of 2012.
OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD ONLY ON AGENDA ITEMS. SPEAKERS SHALL HAVE THREE (3) MINUTES TO ADDRESS THE BOARD OF TRUSTEES.

AMENDMENT TO THE MASTER FEE SCHEDULE – ALARM PERMIT FEES
Trustee Hoyt moved, seconded by Trustee Basher, and unanimously carried, that the following resolution be approved as amended: Approved: 7-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby amends the Master Fee Schedule for the Village of Tarrytown by amending the Alarm Permit fees as follows:
Alarm Permit (residential) from $50 per year to $75 for two years
Alarm Permit (commercial) from $100 per year to $150 for two years
Alarm Permit renewal (residential) from $25 per year to $50 for two years
Alarm Permit renewal (commercial) from $50 per year to $100 for two years
INVESTMENT SERVICES FOR THE LENGTH OF SERVICE AWARD PROGRAM (LOSAP) – FIRE DEPARTMENT
Trustee Zollo moved, seconded by Trustee Butler that the following resolution be approved. Motion carried, all voting “aye” with the exception of Trustees Basher, Hoyt and McGee who recused themselves. Approved: 4-0-3
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby authorize and direct the Village Administrator to enter into an agreement with RBC Wealth Management for investment services for the Tarrytown Volunteer Fire Department’s Length of Service Award Program (LOSAP).
AWARD A BID FOR CENTRAL AVENUE CULVERT FLOOR REPAIR/RESTORATION
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved: Approved: 7-0
WHEREAS, sealed bids were opened on August 31, 2012 for the Central Avenue Culvert Floor Repair/Restoration; and
WHEREAS, four bids were received and the bids received are listed below:
- Heitkamp Inc. $112,941.74
- Fourmen Construction $117,000.00
- Arben Group LLC $197,648.00
- Legacy Valve, LLC $234,111.00
and
WHEREAS, all of the bids have been reviewed by Village staff and staff recommends an award of the bid to the lowest responsible bidder, Heitkamp Inc., and
NOW THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby authorize and direct the Village Administrator to execute an
agreement with Heitkamp, Inc., 99 Callender Road, Watertown, Connecticut, per their bid of $112,941.74 for the Central Avenue Culvert Floor Repair/Restoration project; and
BE IT FURTHER RESOLVED that funding for this project may be provided from a future borrowing resolution.
APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD OF TRUSTEES HELD ON SEPTEMBER 4, 2012
Trustee Zollo moved, seconded by Trustee McGee that the following resolution be approved. Motion carried, all voting “aye” with the exception of Trustee McGovern who abstained. Approved: 6-0-1
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the regular meeting of the Board of Trustees held on September 4, 2012 as submitted by the Village Clerk.
APPROVAL OF AUDITED VOUCHERS
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved: Approved: 7-0
BE IT RESOLVED the Board of Trustees hereby approves the Audited Vouchers included in Abstract No. 5 and hereby orders the Audited Vouchers to be paid in the following amounts:

The Board was polled all voting “aye” with the exception of Trustee McGee who recused herself from Voucher Number 2012237828. Motion carried. 7-0
