PRESENT:  Mayor Fixell presiding; Basher, Butler, Hoyt, McGee, McGovern and Zollo; Administrator Blau; Treasurer Hart; Village Attorney Shumejda; and Village Clerk Booth

REGULAR MEETING immediately followed the Organizational Meeting

REPORTS
Mayor Fixell noted that the Village of Tarrytown was just named one of Forbe’s “10 Prettiest Towns.”

VILLAGE ADMINISTRATORS REPORT

Cleaning and Water Line Project - This project has started up again in the Crest area.  Temporary water lines have been put in place which is part of the cleaning water lining project.

Stop and Shop - Pursuant to an agreement among Tarrytown, Greenburgh and Stop and Shop, if you are 62 years of age, you do not own or lease a car and you live is certain areas designated in the agreement, Stop & Shop will waive the delivery fees for the Pea Pod delivery service.  Letters are being mailed out to senior citizens in the designated areas, which include:

In the letter is a contact person who qualifying senior citizens should contact.  Letters should be received by the end of this week.

Televising of Board of Trustee Meetings – the link to the website where interested persons can click on a specific Board meeting to watch the meeting was placed on the Tarrytowngov.com website after the last meeting.  Go to the website, click on Boards and Commissions, click on Board of Trustees, click on Board of Trustees Meetings which will then say click here to get to the Index of Board of Trustees meetings.  Some people may be able to immediately access the website.  Others may not.  We have our Information Technology consultant reviewing the matter to determine what fix may address the problem.  We are also looking at other options, although the other options are considerably more expensive than what we have developed to this point.  As we proceed, I will keep you apprised.  


PUBLIC INFORMATION MEETING – TARRYTOWN LAKES TRAIL PROJECT PRESENTATION BY STEVE YARABEK

Tree City USA - Mr. Yarabek stated that he had the privilege on behalf of Scott Weaver, General Foreman, of accepting from Governor Cuomo and Commissioner Martens, a 30-year award for the Village of Tarrytown for “Tree City
USA.”  Robert Lustyik, a former Trustee was at the forefront of this program and we have been very proud to be a Tree City for 30 years.  He presented Mayor Fixell with a “Tree City USA” award, tree sign, tree flag and hat.  

Steve Yarabek, Landscape Architect Consultant, for the Tarrytown Lakes Trail Project, presented a power point presentation of the Tarrytown Lakes Trail Project.   Mr. Yarabek stated that the entire Tarrytown Lakes Trail Project is
about access to the Tarrytown Lakes.  This project is being funded by a grant from the New York State Department of State, Department of Environmental Conservation.

Administrator Blau stated that we have two grants for the Tarrytown Lakes Trail Project, one grant from the Department of State in the amount of $100,000 and another grant from the Hudson Valley Greenway in the amount of $10,000.  The Village is obligated to match the Department of State in the amount of $100,000.

Carole Griffiths, 251 Martling Avenue, stated that the Tarrytown Environmental Advisory Council have been working for years to preserve the Tarrytown Lakes and to increase the trail usage in the area.   She is fully in favor of this
project and thanks the Lakes Committee for all the great work they have done.

Mayor Fixell thanked the Tarrytown Lakes Committee for all the tremendous work they have done on this and other projects as well.

Administrator Blau stated that he will be presenting to the Board for review the short form environmental assessment for SEQRA purposes for declaration of the Board as Lead Agency for this project and making an environmental
impact declaration.   In the meantime, the bid documents will be put together to move this forward.

Mark Fry, member of the Tarrytown Lakes Committee, thanked the Board of Trustees for their support to the Tarrytown Lakes Committee and Trustee Tom Butler for his leadership as the Board’s Liaison.  He stated that the grant
would not have happened without Administrator Blau, he did a wonderful job putting the grant together along with the grant writer, Marty Schneider.  He also thanked Steve Yarabek, the landscape architect for a great job, who also
went above and beyond creating a master plan for the Lakes to be used in future projects and grants.  He thanked Carole Griffiths who has been working on environmental issues since 1986.  He thanked past Chairpersons of the Lakes
Committee, Kathy Knight and Amy Wesson and our current Chairperson of the Lakes Committee, Cathy Ruhland.  For more information on the Tarrytown Lakes, please go to our website at www.tarrytownlakes.org

Mr. Fry noted that the Village-Wide Clean-up Day is on Saturday, April 21st at 10 a.m.  Meet either at Patriots Park or at the Tarrytown Lakes Parking Lot.  Everyone is encouraged to join in.

OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD.  SPEAKERS HAVE FIVE (5) MINUTES BEFORE YIELDING TO THE NEXT SPEAKER; THEN THREE (3) MINUTES FOR ADDITIONAL COMMENTS

Lori Semeraro, 205 Martling Avenue, asked who the Board of Trustee liaison is going to be for the Tarrytown Ambulance Corp.  Mayor Fixell stated that the Board will be appointing someone in due course.

Carole Griffiths, 251 Martling Avenue, stated that the Community Garden at the Tarrytown Hall Care Center has been moved to the John Paulding School.  Please contact the Tarrytown Environmental Advisory Council if anyone is
interested in participating with the Community Garden.  

John Stiloski, 54 Walnut Street, asked the following questions:
  • When the vac-all truck is used for sewer and catch basin work, where does the raw sewage go?  Administrator Blau stated that it goes into the holding tank in the truck, but he would have to get back to him with a more detailed answer as to where the materials held in the tank are placed.
  • When the Village uses the vac-all truck, does the Village have permits and where do we dispose of the sewage and other materials.  Mayor Fixell stated that we will have to get back to Mr. Stiloski with these answers.
Murat Turk, TVAC member (inactive), asked the following:
  • Does anyone check to see if the Village’s Sexual Harassment Policy is distributed correctly at the Tarrytown Ambulance Corp.?  Attorney Shumejda stated that the Village provides the policy and it’s up to the Ambulance Corp to distribute it.
  • Can any member of the Fire Department, Police Department, TVAC or Village employee obtain a copy of the Village’s sexual harassment policy, if they present an I.D.?    Attorney Shumejda stated that anyone can come to Village Hall and obtain documents that are subject to FOIL.
John Chebetar, Sleepy Hollow resident, asked the following:
  • Is there an update on the petition that was presented to the Board that the Village Attorney sent to a number of government agencies.  Attorney Shumejda stated that there was a limited response; the District Attorney acknowledged receipt.  
  • An update on revising the Village’s confined space permits and the training of the Village employees to properly fill out the permits. Administrator Blau stated that we are currently working with PESH regarding the modification of the permit in an attempt to make the permit clearer and simpler to complete and are awaiting response.  They have suggested that we may want to have different permits; one for catch basins and one for entering manholes.  
The Village employees were re-trained and will have on-going training with respect to filling out confined space permits.  The permits that are completed are reviewed.

Peter Lombardi, 33 Main Street, asked how the Village budget looks.  Mayor Fixell stated that we have a tentative budget that the Board is reviewing.   The Board will be holding a public hearing and will adopt the budget before May 1,
2012.  He asked if hiring a new Superintendent was a good idea with respect to the budget.

Eleanor Miscioscia, 34 Storm Street, asked if Trustee Hoyt would be held accountable in regards to the Ambulance Corps and the Village’s Sexual Harassment Policy.  Attorney Shumejda  stated that the Volunteer Ambulance Corp is
an independent organization.  He noted that she could bring her concerns to the TVAC Board of Directors.  

Murat Turk, TVAC member (inactive), asked that the Board not re-appoint Trustee Hoyt as liaison to the Ambulance Corp as he feels it is a conflict of interest.

VILLAGE SAFETY POLICY

Trustee Basher moved, seconded by Trustee McGovern, and unanimously carried, that the following resolution be approved:  Approved: 7-0

WHEREAS, the personal safety and welfare of Village employees, as well as the general public, is a primary and continuing concern of the Village of Tarrytown; and

WHEREAS, it is the goal of the Village to help provide every employee a place of employment free from recognized hazards, which are a potential cause for serious physical harm or health impairment; and

NOW THEREFORE BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby establish the following Village employee safety policy.

POLICY
  • An executive safety committee will be established, consisting of key personnel from each major department, and chaired by an appointed safety coordinator. The committee will meet at a minimum every two (2) months to assist in the accomplishment of the Village’s safety goal, reporting its findings and recommendations directly to the Board of Trustees.  The Board of Trustees will work with the Village Administrator and department heads to appropriately address those committee findings.
2.  To accomplish the Village’s goal, Management will:
Implement progressive accident prevention programs, systems, and techniques;

Provide a work environment where identified occupational hazards are controlled when elimination is not feasible;
Cooperate with government and labor to optimize employee safety and health.

3.  To accomplish the Village’s goal, Department Heads or Supervisory Staff will:
Be responsible for employee protection and performance;
Institute work practices which reflect the safest, most efficient methods available for accomplishing the required tasks;
Educate and train employees regarding on-the-job” hazards.

4.  To accomplish the Village’s goal, all employees will:
Be expected to conduct their jobs in the safest and healthiest manner prescribed;
Be expected to conduct themselves in a way that enhances their personal safety and that of their fellow employees;
Be encouraged to cooperate and contribute towards the overall success of the safety program, including participation in safety activities and committees when requested;
Report all accidents and injuries immediately to their supervisor;
Cooperate in the accident reporting and safety evaluation process.

APPOINTMENT PART-TIME PARKING ENFORCEMENT OFFICER

Trustee Butler moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby appoints Lisanny Neris of Sleepy Hollow, New York, to the position of Part-time Parking Enforcement Officer at an hourly rate of $18.50 effective April 3, 2012 subject to all Civil Service rules and regulations.

APPOINTMENT TARRYTOWN MUNICIPAL HOUSING AUTHORITY

Trustee Basher moved, seconded by Trustee Butler, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby appoint Sharon Bryan-Morgan to fill the unexpired term of William Burnette as member of the Tarrytown Municipal Housing Authority for a term to
expire in April of 2015.

VILLAGE DPW FACILITY LEASING AGREEMENT

Trustee McGee moved, seconded by Trustee McGovern, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby authorize and direct the Village Administrator to enter into a lease agreement between the Village of Tarrytown and the Union Free School District
of the Tarrytown to lease a portion of the Village DPW facility to be utilized by the school district for bus repair purposes.

PARKING MANAGEMENT AGREEMENT – PROPARK, INC

Trustee Basher moved, seconded by Trustee McGovern, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby authorize and direct the Village Administrator to enter into an agreement with ProPark Inc. for the 2012 Yankee baseball season for the purpose to operate game day event parking in the three commuter parking lots adjacent to the Metro North Railroad Station.

SCHEDULE A PUBLIC HEARING – TENTATIVE BUDGET FY 2012-2013

Trustee McGovern moved, seconded by Trustee McGee, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED, that the Board of Trustees of the Village of Tarrytown does hereby schedule a public hearing for April 11, 2012 at 7:00 p.m. in the Municipal Building, One Depot Plaza, Tarrytown, New York 10591, to hear and discuss the proposed Tentative Budget for Fiscal Year 2012-2013.

APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD OF TRUSTEES HELD ON MARCH 19, 2012

Trustee McGee moved, seconded by Trustee Basher that the following resolution be approved. Motion carried, all voting “aye” with the exception of Mayor Fixell who abstained.
Approved: 6-0-1

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the regular meeting of the Board of Trustees held on March 19, 2012 as submitted by the Village Clerk.

APPROVAL OF THE MINUTES OF THE SPECIAL MEETING OF THE BOARD OF TRUSTEES HELD ON MARCH 20, 2012

Trustee Zollo moved, seconded by Trustee McGovern, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the special meeting of the Board of Trustees held on March 20, 2012 as submitted by the Village Clerk.

APPROVAL OF AUDITED VOUCHERS

Trustee McGovern moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 7-0

BE IT RESOLVED the Board of Trustees hereby approves the Audited Vouchers included in Abstract No. 18 and hereby orders the Audited Vouchers to be paid in the following amounts:

The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Number 2012235680.   Motion carried.   7-0

ADJOURNMENT TO EXECUTIVE SESSION

Trustee Basher moved, seconded by Trustee McGovern, and unanimously carried, that the Regular Meeting be adjourned to Executive Session at 9:15 p.m.
