Special Meeting No. 15

6:30 p.m.
PRESENT: Mayor Fixell, Trustees, Butler, Hoyt, McGee; McGovern and Zollo; Village Attorney Shumejda; and Village Clerk Booth
ABSENT: Trustee Basher
Trustee Zollo moved, seconded by Trustee McGovern and unanimously carried to open the Special Meeting.
ADJOURNMENT TO EXECUTIVE SESSION
Trustee Hoyt moved, seconded by Trustee Zollo and unanimously carried to adjourn meeting to Executive Session at 6:31 p.m. to discuss a personnel matter.
Mayor Fixell stated that the Board of Trustees will return to this Special Meeting, but did not know the time.
Trustee Basher previously recused himself from all deliberations and discussions regarding this personnel issue.
MEETING RECONVENED at 7:19 p.m.
HEARING OFFICER’S RECOMMENDATION
Trustee Zollo moved, seconded by Trustee Butler that the following resolution be approved. Motion carried. All Ayes.
WHEREAS, a hearing was held before Hearing Officer George E. Fufidio, Jr. in April and May 2011 regarding charges dated February 4, 2011 preferred against Scott Weaver pursuant to Section 75 of the Civil Service Law. In a Hearing Officer’s Report dated August 29, 2011, the Hearing Officer recommended that the disciplinary charges be dismissed; and
NOW, THEREFORE, BE IT RESOLVED that the Village of Tarrytown Board of Trustees adopts the Hearing Officer’s recommendation and does hereby dismiss the disciplinary charges brought against Scott Weaver.
Adjournment
Trustee Zollo moved, seconded by Trustee Hoyt and unanimously carried that the Special Meeting be adjourned. Meeting was adjourned at 7:21 p.m.
