The meeting began with the Pledge to the Flag.
REPORTS
Deputy Mayor Basher reported on the following:
- The Tarrytown Fire Department will hold a Dedication Ceremony to honor two fallen Firefighters, Anthony Ruggiero Jr. and John Kelly on Monday, September 5th (Labor Day) at 10 a.m. at Main Street Firehouse. The public is invited.
- Deputy Mayor Basher read a commendation letter from a Hudson Harbor resident to thank the Police Department and, in particular, the exemplary actions of Officer Purdy. The letter shall be affixed to these minutes as part of the official record.
VILLAGE ADMINISTRATOR’S UPDATE
Television Equipment – the new equipment to televise the Board of Trustees and Planning Board meetings has been installed and is being tested tonight. We will be working on the ability of residents to select the particular Board
meeting they would like to watch from a library of meetings. All of the equipment and the installation of the equipment were paid from a fund established with Capital monies provided by Cablevision and Verizon.
Solar Panels – The installation of the solar panels on the Village Hall building was completed one week ago with the connection of the panels to our electrical system occurring this past Saturday. The installation of the solar panels on
the Senior Center is scheduled for this week.
Tarrytowner – The next issue of the Tarrytowner will be available on line next week. Residents should go to www.tarrytowngov.com and they will be able to access the new on-line version of the newsletter. Limited copies will be
available at Village Hall, Senior Center and the Library.
PUBLIC INFORMATION MEETING – RIVERFRONT PARKING LOT
Public Information Meeting to review the schematic design for the development of a new parking lot on the riverfront in the area commonly known as the Fire Training Center
Michael Stein, President of Hudson Engineering and Consulting, stated that they have prepared plans and specifications for the construction of a new commuter parking lot at the former Fire Training Center on Green Street. The
proposed parking lot will provide 169 new commuter parking spaces and will also include a new pathway leading from the existing sidewalk on Green Street and lead up to the River front. They have designed a bio-retention basin to
meet all the storm water, water quality treatment requirements. They worked with Lin Star Engineering on a lighting plan for the parking lot. They also worked with Munz Associates, landscape architect, for the preparation of the
landscape and mitigation plan.
Trustee McGovern questioned what the four-prong area was? Michael Stein stated that currently DPW has a storage yard located on one side of the proposed parking lot and this area will provide DPW with a similar site for storage;
it will just be located on the other side.
Trustee Butler asked if there is a requirement for handicap parking. Michael Stein stated that based where the site is located, (not close to the platform); handicap parking will be provided closer to the platform. Administrator Blau
stated that we added a number of handicap parking spaces by the platform near the elevator.
Trustee McGovern asked that the Chief of Police look over these plans for safety issues with respect to the cars pulling in and out of the lot.
Jaime Valencia, Tarrytown resident, asked if the walkway around the parking lot would allow him to enter from the baseball field and through the boat club. Michael Stein stated, yes.
Lori Semeraro, 205 Martling Avenue, asked if there will be a crosswalk for pedestrians. Michael Stein stated the pedestrian walkway will be entered onto the Green Street sidewalk.
Mike Messina, taxi driver, asked if the road to get to the other boat club would change. Michael Stein stated that the road will remain the same.
PUBLIC HEARING – COMPATIBLE USE PERMIT – TARRYTOWN HOUSE ESTATE AND CONFERENCE CENTER
Trustee Zollo moved, seconded by Trustee McGovern, and unanimously carried, that the hearing be opened.
Administrator Blau stated that the Tarrytown Conference Center has been operating as a conference center in the OB Zone (Office Building Zone) in the south end of the Village for quite a while now. A number of years ago, the Board of Trustees adopted language that allowed for the issuance of a compatible use permit for this particular use in an OB Zone. The applicant is here tonight to seek the issuance of that compatible use permit.
John Cavallaro, with the law firm, Huff, Wilkes, Cavallaro and Loveless, representing the Tarrytown House stated the following:
- He is here tonight with Joseph Santore, the General Manager of the Tarrytown House, in connection with Tarrytown House’s application for a compatible use permit for a conference center in the OB Zoning district.
- Tarrytown House, being the nation’s oldest conference center, presently applies for the compatible use permit so that for zoning purposes, it may be designated as a conference center in the OB Zoning district.
- On March 29, 2010, we appeared before the Planning Board and by unanimous vote; we received a positive recommendation for the issuance of a compatible use permit from the Planning Board.
- Under this application, the Tarrytown House does not seek to make any expansions to the premises or structures located thereon. Tarrytown House seeks to leave the premises in its current condition without any intensification of the use.
- They seek the compatible use permit solely for the purpose of changing the designation afforded to Tarrytown House under the Zoning Code. They seek to make clear that Tarrytown House is a conference center for zoning purposes.
- All open space will be preserved as presently exists on the site; no increase in impervious surface. Traffic on the site will not be increased because the premises will continue to be operating in the same manner as its past operation. Traffic flow in and out of the center will not increase because the operation at the Tarrytown House is not changing in any manner whatsoever.
- The issuance of the compatible use permit will not cause noise, fumes, vibrations, lighting or the flashing of lights to be more objectionable to nearby properties as compared with the permitted uses not requiring a compatible use permit.
- The Tarrytown House complies with the 10 special conditions derived at through the International Association of Conference Centers.
Deputy Mayor Basher questioned whether anyone wished to address the Board on this matter. No one appeared.
Trustee McGovern moved, seconded by Trustee Zollo, and unanimously carried, that the hearing be closed.
Trustee Zollo moved, seconded by Trustee Basher, and unanimously carried, that the following resolution be approved: Approved: 6-0
WHEREAS, the Tarrytown Planning Board approved on September 29, 2009, the recommendation to the Board of Trustees an amendment to Section 305-34, entitled “Office Building OB Zone” of the Tarrytown Zoning Code , Section
2.A. (7) Permitted principal uses; conference centers and approval of issuance of a compatible use permit to the Tarrytown House Estate and Conference Center; and
WHEREAS, on November 2, 2009, the Board of Trustees adopted Local Law No. 9 of 2009 to amend Section 305-34, entitled “Office Building OB Zone” of the Tarrytown Zoning Code , Section 2.A. (7) Permitted principal uses;
conference centers; and
WHEREAS, the Proposed Action is an Unlisted action pursuant to the State Environmental Quality Review Law, and
WHEREAS, an Environmental Assessment Form (EAF) was filed; and
WHEREAS, a notice of public hearing was published in the Journal News on July 22, 2011; and
WHEREAS, a public hearing was held for the proposed action on August 15, 2011; and
WHEREAS, the Board of Trustees of the Village of Tarrytown is the only agency which has approval authority over the Proposed Action, and is therefore the Lead Agency for the Proposed Action.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
In accordance with Article 8 of the State Environmental Conservation Law and 6NYCRR Part 617, including without limitations the criteria set forth in 6 NYCRR Part 617.7(c) and based upon review of the Environmental Assessment Form and all other materials that were prepared for the Proposed Action, the Village Board of Trustees hereby determines that Proposed Action will not have a significant adverse impact on the environment, and hereby adopts a Negative Declaration.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Board of Trustees of the Village does hereby grant a Compatible Use Permit for 25 years to the Tarrytown House Estate and Conference Center. This Compatible Use permit
will automatically renew after said period of time unless the Village of Tarrytown finds that the Tarrytown House Estate and Conference Center has failed to substantially comply with the requirements of the Tarrytown Zoning Code
and the conditions of the site plan approvals issued by the Village of Tarrytown Planning Board.
PUBLIC HEARING – TATTOO PARLORS – (to be continued)
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Tarrytown will hold a public hearing on the 15th day of August, 2011, at 8 PM, in the Municipal Building, One Depot Plaza, Tarrytown, New York 10591, to hear, discuss and to act upon a proposed amendment to Chapter 268 entitled “Tattoo Parlors” of the Code of the Village of Tarrytown. A summary of the legislation is available at Village Hall. The complete text of this legislation follows:
A LOCAL LAW to amend §268 of the Code of the Village of Tarrytown entitled “Tattoo Parlors” to allow for tattoo parlors in the Village of Tarrytown subject to restrictions.
SECTION 1. LEGISLATIVE INTENT AND FINDINGS OF FACT.
A. Findings of Fact.
The Board of Trustees of the Village of Tarrytown has determined that the rationale for prohibiting tattoo parlors from existing in the Village no longer exists and that tattoo parlors should be permitted in the Village subject to reasonable restrictions that would protect the health, safety and welfare of the residents and visitors to the Village.
B. Legislative Intent.
It is the intent of the Board of Trustees of the Village of Tarrytown to rescind the existing Chapter §268 entitled “Tattoo Parlors”, which Chapter prohibited tattoo parlors in the Village and to adopt a new Chapter §268 to permit tattoo parlors subject to restrictions.

SECTION 2. RESCINDING OF CHAPTER §268 ENTITLED “TATTOO PARLORS” of the Code of the Village of Tarrytown entitled “Tattoo Parlors”.
Chapter §268 of the Code of the Village of Tarrytown entitled “Tattoo Parlors” is hereby rescinded in its entirety.
SECTION 3. ADOPTION OF NEW CHAPTER §268 OF THE CODE OF THE VILLAGE OF TARRYTOWN ENTITLED “TATTOO PARLORS”.
§ 268-1. Tattoo parlors permitted.
Tattoo Parlors shall be permitted only in the Restricted Retail zoning district.
§ 268-2. Definitions.
- Body Piercing. Body Piercing shall mean puncturing or penetrating the skin of a client with presterilized single-use needles and the insertion of presterilized jewelry of other adornment into the opening. Such term shall not include tongue splitting.
- Cosmetic Tattooing. Cosmetic tattooing shall mean a method of tattooing, which involves placing ink or other pigment into or under the skin, including but not limited to the eyelids, eyebrow area and lips, by the aid of needles or any other instrument used to puncture the skin, resulting in permanent coloration.
- Tattooing. Tattooing shall mean any method, which involves placing ink or other pigment into or under the skin by the aid of needles or any other instrument used to puncture the skin, resulting in permanent coloration of the skin.
- Tattoo Parlor. Tattoo parlor shall mean an establishment where body piercing, cosmetic tattooing and tattooing are performed. Tongue-splitting is expressly prohibited.
- Tongue-splitting. Tongue-splitting shall mean the cutting of a person’s tongue into two (2) or more parts.
§ 268-3. Distances from other tattoo parlors; schools; parks.
- A tattoo parlor shall be no closer than five hundred (500) feet to a lot containing another existing tattoo parlor.
- A tattoo parlor shall be no closer than five hundred (500) feet to a lot containing any school.
- Any distancing restrictions provided in this Chapter shall be measured along public streets by the shortest route of pedestrian traffic between the respective main public entrances or measured horizontally between the respective main public entrances, whichever is greater.
§ 268-4. Displays; Signs
A tattoo parlor shall not have any pictorial or illustrative display on any sign or in any window. The signs shall be limited to words, letters and/or numbers. There shall be no neon signs that are visible from the street.
§ 268-5. Licenses; Certifications; Costs.
- The tattoo parlors shall obtain and maintain at all times any licenses and approvals required now or in the future by Westchester County or the State of New York governing such activities.
- The owner and/or operator of a tattoo parlor shall certify to the Village, on an annual basis, compliance with the Rockland County Sanitary Code, Article XVI, Body Art. Such certification shall be provided to the Village Administrator.
- Should the Village Administrator believe that it is necessary to hire an individual or firm to determine compliance with the Rockland County Sanitary Code, the Village Administrator shall provide notice to the owner and/or operator of a tattoo parlor and the costs associated with this compliance determination shall be borne by the owner and/or operator.
§ 268-6. Hours of Operation.
The hours of operation of a tattoo parlor shall be limited to 9:00 a.m. to 9:00 p.m. Monday through Saturday and 11:00 a.m. to 7:00 p.m. on Sunday.
SECTION 4. EFFECTIVE DATE.
This local law shall take effect immediately, as provided by law.
All interested parties are invited to attend and be heard. Access to the meeting room is available to the elderly and the handicapped. Signing is available for the hearing-impaired; a request must be made to the Village Clerk at least five days in advance of the meeting.

Trustee Zollo moved, seconded by Trustee McGovern, and unanimously carried, that the hearing be opened.
Lori Semeraro, 205 Martling Avenue, read the current Village Code on Tattoo Parlors. She asked what has changed since this law was passed in 1996 to now allow tattoo parlors.
Trustee Zollo read a section of the proposed law: “The owner and/or operator of a tattoo parlor shall certify to the Village, on an annual basis, compliance with the Rockland County Sanitary Code, Article XVI, Body Art. Such certification shall be provided to the Village Administrator. Should the Village Administrator believe that it is necessary to hire an individual or firm to determine compliance with the Rockland County Sanitary Code, the Village Administrator shall provide notice to the owner and/or operator of a tattoo parlor and the costs associated with this compliance determination shall be borne by the owner and/or operator.”
John Garibaldi, 3 Hudson Place, stated that the Board should continue this hearing into September when more families can voice their opinion and he stated the following:
- Would a tattoo parlor improve the image of Tarrytown?
He believes that tattooing is still a risky procedure. He wouldn’t want to be a town promoting tattooing.
- Is it difficult to find a tattoo parlor in Westchester? He stated that in a 10 mile radius, there are 7 tattoo parlors. When he thinks of Tarrytown, he doesn’t think of tattoos.
- Has tattooing finally become a truly regulated industry? He stated that the FDA does not regulate tattoo inks that are put under our skin.
- Is there no more health risks involved in tattooing? He stated that there are no regulations on the inks that tattoo parlors use.
- What affect would this have on our population, especially our younger generation? He stated that no long term studies have been performed confirming that tattoos are safe as a permanent cosmetic.
Christina Sarofeen, Altamont Avenue, stated that we are a historic village; where does a tattoo parlor fit in this village. She asks the Board not to approve this proposed legislation.
Chuck Hognell, the prospective tattoo parlor owner, stated that he understands that the Village is not promoting tattoo parlors but it is a matter that he has the right to run a legitimate business in this Village. He doesn’t cater his business or his art toward children. He has material safety data sheets for all the ink that he uses and if the Board would like, he can provide them to the Board.
Danielle Chung, Tarrytown resident, stated that she chose to move to Tarrytown from Brooklyn because Tarrytown is historic and quaint. We like the environment that is here in Tarrytown; we should preserve that. Tattoo parlors do not fit the image of the Village and what we want our children to grow up in. Ms. Chung stated that she is against tattoo parlors in Tarrytown and asked the Board to continue this discussion into September when more families can be heard on this topic.
Santo Penalo, Sleepy Hollow resident, stated that he has three children and he believes that tattoos have been linked with violence and Tarrytown does not have an image of violence. He has lived in the Tarrytown area for the past twenty years and it has a great image and he is very proud to raise his children here. This prospective tattoo owner may be a responsible person, but you don’t know the next tattoo parlor owner; he could be irresponsible.
A Tarrytown Resident stated that what he has heard so far is of fear and stereotyping. A lot of good people have tattoos. Disease can be controlled through proper techniques and proper care of the equipment.
Steve Cerbone, 138 Rosehill Avenue, stated that he supports to leave the legislation that prohibits tattoo parlors in the Village Code and to not pass this proposed legislation.
Diane Tuohy, 11 Storm Street, stated that she does not support tattoo parlors in Tarrytown. Tattoo parlors do not belong in Tarrytown. The Board has the power to change the face of Tarrytown and she pleads with the Board not to do it.
Trustee Hoyt moved, seconded by Trustee Zollo, and unanimously carried, that the hearing be continued.
PUBLIC HEARING – TAXI AND LIVERY DRIVERS LICENSES – (to be continued)
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Tarrytown will hold a continuation of a public hearing on the 6th day of September, 2011, at 8 PM, in the Municipal Building, One Depot Plaza, Tarrytown, New York 10591, to hear, discuss and to act upon a proposed amendment to Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown to transfer the licensing responsibility for drivers from the Village to the Westchester County Taxi and Limousine Commission. A summary of the legislation is available at Village Hall. The complete text of this legislation follows:
SECTION 1. LEGISLATIVE INTENT AND FINDINGS OF FACT.
A. Findings of Fact.
The Board of Trustees of the Village of Tarrytown has determined that the Westchester County Taxi and Limousine Commission provides an extremely extensive background investigation prior to the issuance of licenses as well as ongoing enforcement of their regulations for licensed drivers
and thorough investigation of complaints and the Village is desirous of utilizing their experience and expertise in such licensing within the Village of Tarrytown. The Village’s law must be amended in order to provide for the transfer of this responsibility from the Village to the Westchester County Taxi and Limousine Commission.
B. Legislative Intent.
It is the intent of the Board of Trustees of the Village of Tarrytown to amend Chapter 273 entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown by eliminating provisions in the Chapter that provide for the Village of Tarrytown to be the licensing entity for the issuance of drivers licenses and to add language that provides for the responsibility for the issuance of drivers licenses to rest with the Westchester County Taxi and Limousine Commission.

SECTION 2. Amendment to §273-1”Definitions” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
§273-1 Definitions.
LICENSING OFFICIAL – The Village Administrator of the Village of Tarrytown for taxicab licenses or livery licenses. The Westchester County Taxi and Limousine Commission for all for hire vehicle driver permits.
LIVERIES [AND LIVERY DRIVERS] – The regulations concerning liveries [and livery drivers] contained in this chapter apply only to liveries [and livery drivers] which pick up or drop off passengers at the Metro North Commuter Railroad Station.
[LIVERY DRIVER – Includes any person who operates a livery.]
[TAXICAB DRIVER – Includes any person who operates a taxicab.]
SECTION 3. Amendment to §273-2,”Taxicab/livery combination driver’s license required” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
- No person shall drive a taxi which picks up passengers within the Village limits and no owner of a taxi shall permit a driver thereof to pick up passengers within the Village limits without [first] said driver having first procured a Westchester County for hire vehicle drivers permit from the Westchester County Taxi and Limousine Commission. [taxicab/livery combination driver’s license from the Village Administrator and keeping the same in force and effect under the provisions of this Chapter.]
- No person shall drive a livery which picks up or drops off passengers at the Metro North Commuter Railroad Station and no owner of a livery shall permit a driver thereof to pick up and/or drop off passengers at the Metro North Commuter Railroad Station without first having procured a Westchester County for hire vehicle drivers permit from the Westchester County Taxi and Limousine Commission [taxi/livery combination driver’s license from the Village Administrator and keeping the same in force and effect under the terms of this chapter.
SECTION 4. Amendment to §273-3,”Taxicab or livery license required” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
- No owner of a taxicab which picks up passengers within the Village limits shall cause or permit such taxicab to be driven, operated or kept for hire or pay within the Village limits without first having procured a Westchester County for hire vehicle drivers permit from the Westchester County Taxi and Limousine Commission [taxicab license for said taxicab] and keeping the same in effect under the terms of this provision.
- No owner of a livery which picks up passengers or drops off passengers at the Metro North Commuter Railroad Station shall cause or permit such livery to be driven, operated or kept
for hire or pay without first having procured a Westchester County for hire drivers permit from the Westchester County Taxi and Limousine Commission [livery license for said livery] and keeping the same in force and effect under the provisions of this chapter.
SECTION 5. Amendment to §273-4,”Application for a taxicab/livery combination driver’s license” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
[§273.4 Application for a taxicab/livery combination driver’s license.
A. Each applicant for a taxicab/livery combination driver’s license must comply with the following to the satisfaction of the licensing official:
- Must first have a New York State driver’s license of the appropriate class or designation to operate a taxicab or livery,
- Be of the age of 18 years or over,
- Must not be subject to epilepsy, vertigo, heart trouble or any other infirmity of body or mind which might render him/her unfit for the safe operation of a public vehicle.
- Be able to read and write the English language.
- Be clean in dress and person and not addicted to the use of intoxicating liquor or drugs.
- Produce, on forms to be provided by the licensing official, affidavits of good character from the citizens of the Village of Tarrytown who have known him/her personally and have observed his/her conduct for at least one year preceding the date of his/her application, and a further testimonial on a form provided for that purpose from his/her employer, unless, in
the opinion of the licensing official, sufficient reason is given for its omission. An applicant may substitute two affidavits of good character from nonresidents of Tarrytown for one affidavit from a Tarrytown resident. Applicants should make every effort to provide affidavits of good character from citizens of the Village of Tarrytown. An applicant shall be exempt from the provisions of this section if he/she has held taxicab driver’s license or a taxicab/livery combination driver’s license from the Village for the five continuous years previous to application.
- Fill out, upon a form to be provided by the licensing official, a statement providing the information below, which statement shall be signed and sworn to by the applicant and filed with the licensing official as a permanent record:
- Full name.
- Residence and applicant’s other places of residence, if any, during the five years previous to application, with dates provided for each place of residence.
- Date and place of birth.
- Height, color of eyes, color of hair.
- Telephone number.
- Places and dates of all previous employment during the five years previous to application.
- Place and date of any felony and misdemeanor convictions.
- Place and date of any previous licenses issued by the Village.
- Place, date and description of any revocations or suspensions of licenses issued by the Village.
- Each application shall contain the following statement: “It is a crime punishable as a Class A misdemeanor to knowingly make a false statement herein.”
- Any false statements by the applicant for a taxicab/livery combination driver’s license shall be promptly reported by the licensing official to the Chief of Police for the Village of Tarrytown. The licensing official is hereby authorized and empowered to require such additional information as he/she may deem necessary.]
SECTION 6. Amendment to §273-5,”Photograph of driver” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
[§273-5. Photograph of driver.
Each applicant for a driver’s license must file with his/her application two unmounted unretouched photographs of himself/herself, with head uncovered, taken with the 30 days preceding the filing of his/her application. Photographs shall be no larger than two inches by two inches, one of which shall be attached to the license when issued and the others shall be filed with the application. The photograph shall be so attached to the license that it cannot be removed and another photograph substituted without detection. Each licensed driver shall, upon demand, exhibit his/her license and photograph for inspection. When the application for a license is denied, two copies of the photograph shall be returned to the applicant by the licensing official.]
SECTION 7. Amendment to §273-6,”Conviction records check; fingerprints” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.

The licensing official, the Police Department or any designee thereof shall request from the State Division of Criminal Justice Services and the State Division of Motor Vehicles record checks as to criminal and Vehicle and Traffic Law convictions for applicants for taxicab/livery combination driver’s licenses to be issued by the Village. In connection thereto, every applicant for such licenses shall be fingerprinted by the Tarrytown Police Department, which fingerprints shall be forwarded to the New York State Division of Criminal Justice Services for identification processing. The applicant will tender the fees as established by the New York State Division of Criminal Justice Services for the taking of such fingerprints. No investigations as required herein shall be completed. An applicant
for renewal of the taxicab/livery combination driver’s license shall be subject to records checks as to criminal and Vehicle and Traffic Law convictions.]
SECTION 8. Amendment to §273-7,” Issuance of driver’s license; temporary permit; display” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
[§273-7. Issuance of driver’s license; temporary permit; display.
- Upon satisfactory fulfillment of the foregoing requirements and the payment of the licensing fee for a taxi/livery license, which Fee Schedule is on file in the office of the Village Clerk, there shall be issued to the applicant a license which shall be in such form as to contain a photograph of the licensee. All licenses shall contain the name of the licensee and the dates of issuance and expiration of the license. Any licensee who defaces, removes or obliterates any official entry made upon its license shall be punished by the revocation of his license.
- The licensing official may in his/her discretion deny the issuance of a driver’s license to an applicant whose application contains material false statements or whose health or previous criminal and Vehicle and Traffic Law conviction record would in his/her opinion endanger the general public or impair the applicant’s ability to drive a taxicab and/or livery. Such denial shall be in writing.
- If the licensing official denies the application, the applicant may appeal the decision within 30 days of the date of the decision to the Police Committee of the Village of Tarrytown.
- Taxicab/livery combination driver’s licenses shall be valid for three years unless previously suspended or revoked.
- Applications for renewal of a taxicab/livery combination license shall be filed in the office of the Village Clerk at least 45 days prior to the expiration of said driver’s license. Any licensee who fails to submit their renewal application prior to April 17 of the calendar year in which the license expires shall have said license suspended.
- A temporary permit may be issued by the licensing official pending receipt of the official record check detailed in a §273-6 above. Such issuance shall be at the licensing official’s sole discretion and upon his/her finding that the applicant would not endanger the general public by driving a taxicab or livery in the Village. Such temporary permit shall in no event be granted for a longer period than 90 days and shall be nonrenewable, and a fee of $25 shall be charged for its issuance, which fee shall be applied toward the licensing fee detailed in the Village’s Fee Schedule.
- Such license or permit shall be prominently displayed by the taxicab or livery driver at all times when driving a taxicab or livery in the Village so as to be visible to all passengers riding in the taxicab or livery. Rules concerning the display of licenses or permits shall be prescribed by the Police Committee.
- A badge shall be issued to each taxicab or livery driver and shall be worn by the drivers at all times while operating a taxicab or livery. Rules concerning the wearing of badges shall be prescribed by the Police Committee.]
SECTION 9. Amendment to §273-7.1,” Suspension or revocation of licenses” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
[§273-7.1 Suspension or revocation of licenses.
- Upon a finding of just cause, the Chief of Police or his designee may recommend to the Village Administrator the suspension of a taxicab license or livery license or a taxicab/livery combination driver’s license, and upon such recommendation the Village Administrator, if satisfied that there is cause to believe that the licensee has violated any provision of this chapter or any state or federal law or regulation, may suspend or revoke the license pursuant to Chapter 209, Licensing, of this Code.
- The decision of the Village Administrator to suspend or revoke a license may be appealed to the Police Committee within 30 days of the suspension or revocation. Should the Village Administrator be a member of the Police Committee, he/she shall not hear the appeal. The Village Clerk shall serve on the Police Committee in the absence of the Village Administrator, for the purpose of hearing and deciding upon the appeal.]
SECTION 10. Amendment to §273-8, “Application for a taxicab license or livery license; transfers” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
§273-[8]4. Application for a taxicab license or livery license; transfers
- An application for a taxicab license or livery license shall be made by the owner of the vehicle upon blank forms furnished by the licensing official.
- Such application shall contain:
(e) All individuals, owners, officers, partners, managers, members of the Board of Directors or holders of 10% or more of the outstanding stock or indebtedness as identified in §273-[8]4A(1)(c) of this chapter shall be fingerprinted by the Tarrytown Police Department, which fingerprints shall be forwarded to the New York State Division of Criminal Justice Services for identification processing. The applicant(s) will tender the fees as established by the New York State Department of Criminal Justice Services for the taking of such fingerprints. Said fingerprints to be taken every two years upon renewal. Should additional persons be added during the license year, those person(s) shall be immediately subject to the fingerprints
requirements of this section.
SECTION 11. Amendment to §273-9, §273-10, §273-11, §273-12 and §273-16 by renumbering these Sections.

SECTION 12. Amendment to §273-13, “Records to be kept” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
273-[13]9. Records to be kept.
The Police Chief shall keep a complete record of all taxicab licenses or livery licenses issued and denied under this chapter, together with all applications, record checks, renewals, suspensions and revocations thereof.
SECTION 13. Amendment to §273-14, “General operation regulations” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
273-[14]10. General operation regulations
[K. Every driver of a taxicab or livery must be clean and neat and must be dressed in
clean and neat clothing which are not offensive to the general public.]
[L.] K. Taxicabs and liveries not licensed by the Village of Tarrytown are not permitted
to pick up fares at the Metro North Commuter Railroad Station.
[M.] L. Any vehicle licensed under the requirements of this chapter which uses the
parking area designated as taxicab or livery stands and/or the waiting and
loading areas for the Metro North Commuter Railroad Station is required to
place the Village as an additional (named) insured on the vehicle’s and the
owner’s auto insurance policy.
[N.] M. A [driver of a] taxi or livery shall not be permitted to wait for fares on the
train station platform(s) or on walkway(s) at a distance greater than 20 feet
from their vehicle at any time.
[O.] N. The Chief of Police or his designee shall investigate all complaints regarding
taxi and/or livery companies or vehicles [or drivers] that are licensed by the
Village of Tarrytown and which occur within the geographical jurisdiction of
the Village. The Chief may, upon investigation, refer the matter to the Board
of Trustees for further review and possible disciplinary action.
[P.] O. The Chief of Police, or his designee may, from time to time, cause to have a
Department of Motor Vehicles inquiry run on any taxi or livery vehicle or
taxi [or livery driver] licensed by the Village of Tarrytown. The Chief or
his designee shall have the right to question the licensee regarding any
violation(s) that may be discovered. The Chief may, upon investigation,
refer the matter to the Board of Trustees for further review and possible
action.
[Q.] P. The lettering on taxicabs as specified herein is required to be permanently
affixed to the vehicle; and the roof lights on taxicabs as required herein are
required to be permanently affixed to the vehicle and lighted during the hours
of darkness.
SECTION 14. Amendment to §273-14, “Penalties for offenses; suspension or revocation of license” of Chapter 273, entitled “Taxicabs and Liveries” of the Code of the Village of Tarrytown.
273-[15]11. Penalties for offenses; suspension or revocation of license.
[A. Any person not having been duly licensed as a taxicab/livery combination driver
or any person whose license as such driver has been revoked or any person
whose license has been suspended and who, during the term of suspension, drives for hire a taxicab or livery upon the Village’s streets shall upon conviction, be punishable by a fine of not less than $250 and of not more than $1,000 or imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The Village Administrator shall also have the right to suspend or revoke a license if the vehicle shall be certified by the Police Chief to be in unsafe condition or to be unclean, unsanitary or unfit. A license, when so suspended or revoked, shall not be reissued until the vehicle shall be put in fit condition for use by the public.]
[B.] A. Any owner of a taxicab or livery not licensed, inspected or equipped in accordance with the provisions of this chapter, or of a taxicab or livery, the license of which has been suspended or revoked, who engages in the business of a taxicab or livery as defined herein or attempts to engage in such business or solicits passengers for hire, or any owner of a taxicab or livery who permits a taxicab or livery driver not licensed under this chapter to drive a taxicab or livery shall, upon conviction, be punished by a fine of not less than $100 and of not more than $250 or imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment.
[C.] B. Upon conviction of any person for any violation of a provision of this chapter for
which no punishment is specifically provided, the punishment, upon conviction for.
such violation, shall be a fine of not less than $100 and of not more than $250 or
imprisonment for a term not exceeding 15 days, or by both such fine and
imprisonment.
[D.] C. Each and every day that a violation of this chapter continues shall constitute a
separate and distinct violation of this chapter.
[E.] D. Suspension and revocation of license. In addition to the fine or imprisonment, or
both, authorized by this chapter, any licensee shall be subject to the suspension or
revocation of his/her license upon conviction for any violation of this chapter. The
Village Administrator may suspend or revoke a license granted under any provision
of this chapter, pending or in advance of criminal prosecution of the license.
[F.] E. Forfeiture of license. In addition to any penalty authorized by this chapter, any
owner of a taxicab and/or livery license shall be subject to the forfeiture of that
license, with the license reverting back to the Village, upon conviction for any
violation of this chapter.
SECTION 15. EFFECTIVE DATE
This amendment shall take effect sixty (60) days after adoption by the Board of Trustees.
All interested parties are invited to attend and be heard. Access to the meeting room is available to the elderly and the handicapped. Signing is available for the hearing-impaired; a request must be made to the Village Clerk at least five days in advance of the meeting.

Santo Penalo, taxi driver, asked the following:
- Will taxi drivers in Tarrytown need a TLC license and a Tarrytown license? Administrator Blau stated that the proposed legislation would completely turn this responsibility over to the TLC and you would not need a Tarrytown license.
- Will this include the hack license and the cab license? Administrator Blau stated that this is strictly dealing with hack licenses, not the registration of vehicles.
- There are many taxi drivers who do not have a hack license who take work away from the taxi drivers who have hack licenses. How will that be enforced? Administrator Blau stated that the TLC will be enforcing all rules governing the licensing of drivers; however the Tarrytown Police Department has the right to enforce their law.
- What will happen to people with hack licenses that expire 1, 2 or 3 years from now? Administrator Blau stated that there will be a prorated payment to be made to current holders of hack licenses.
- He is in support of going to the TLC because of stronger and deeper investigations.
Felix Lantigua, taxi driver, he stated the following:
- He has been a taxi driver in Tarrytown for the past 6 years. The Village taxi fees have gone up, but the taxi fares have not gone up at all.
- He believes the Village has done a good job licensing and enforcing taxi drivers in the Village and doesn’t understand why we have to turn it over to the TLC; it’s going to cost more money.
Juan Sanchez, taxi driver, stated the following:
- TLC will cost more.
- There is a problem with some taxi drivers picking up at the train station without waiting in the holding line. Deputy Mayor Basher stated that with TLC there will be more enforcement, which may help solve that problem.
Deputy Mayor Basher stated that he believes the board should continue this public hearing and schedule a meeting with a representative from the TLC to meet with the Board and interested taxi drivers to answer questions.
Segundo Sanchez, taxi driver, stated the following:
- The taxi fare rates have not gone up in a long time; it is hard to survive on the $4.00 rate.
- He pays $800/year for a County’s taxi business license because he is a taxi/limo company plus all the fees in Tarrytown.
Victor Arpi, taxi driver, stated that he doesn’t understand why the Board would consider bringing in the TLC; this is just a village. The TLC will just drive the cost of doing business up and he asked the Board not to approve that.
Santo Penalo, taxi driver, stated that when the TLC representative comes to meet with the Board and the taxi drivers, he wants to know exactly what the transfer to TLC really means. He asked if the Village can get information from the TLC prior to this meeting so that the taxi drivers can better understand all the new requirements.
Mike Messina, taxi driver, stated that the taxi drivers line up right by the police department and we already have enforcement in place; he doesn’t believe the TLC is necessary. The TLC is a good organization and does their job very well at airports and commercial areas, but this Village is like a family and we would like to keep it Village friendly.
Trustee Butler moved, seconded by Trustee Zollo, and unanimously carried, that the hearing be continued.
OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD. SPEAKERS HAVE FIVE (5) MINUTES BEFORE YIELDING TO THE NEXT SPEAKER; THEN THREE (3) MINUTES FOR ADDITIONAL COMMENTS
John Chebetar, Sleepy Hollow resident, read a letter from “Concerned Citizens for Responsible Government in Tarrytown” which he submitted to the Village Clerk along with 5 pages of signatures. The documents shall be affixed to
these minutes as part of the official record.
Michelle Casarella, 36 North Washington Street, read the remainder of the letter from “Concerned Citizens for Responsible Government in Tarrytown.”
Peter Lombardi, 33 Main Street, asked if the Board has an idea where this investigation stands. Attorney Shumejda stated that the Board is waiting for the report of the independent Hearing Officer.
Diane Tuohy, 11 Storm Street, stated that the independent Hearing Officer is taking a long time.
John Stiloski, 54 Walnut Street, asked the following:
- With reference to the confined space policy that had no date, does anyone know where it came from?
- At the press conference two days after the tragic incident, Mr. Blau said that we did not have a confined space policy. However, Mr. Blau’s written statement stated that the men were working within the confined space program/policy.
- Where did Mr. Blau get the information that they were working within the confined space program/policy.
Jaime Valencia, 1 Miller Avenue, stated that he received a notice from the Chief of Police about a level three sex offender who lives feet away from his son’s school in Sleepy Hollow. He wants to know if this is legal. Mr. Valencia
understands that there is no policy in place in the State of New York prohibiting sex offenders to reside near schools. He asked the Board to try to put a policy together to prohibit sex offenders to reside near schools for the safety of
our children. Attorney Shumejda stated that the state has pre-empted this area so the Village cannot create such a policy. Deputy Mayor Basher stated that we will make sure that a copy gets sent to the Public Schools of the
Tarrytowns.
Pat Derivan, Franklin Courts, asked if there was an outcome to the investigation or when we can expect it. Attorney Shumejda stated that we do not have a definite date.
Lori Semerarro, 205 Martling Avenue, stated the following:
- Is the Riverside Hose fire truck warrantee violated due to the changes that were made to the truck? Administrator Blau stated that there is no violation to the warrantee and the springs were put back into the truck at no cost to the Village. She asked who paid for the changes to the garage door and driveway. Administrator stated that the Village paid, but it was a minimal amount of money, maybe a total of $100.00.
- The new fences and signs at Patriot’s Park are up and very lovely, but her concern is that the hours to the park are not enforced. There are people in the park after dark and she has found the gate left wide open. Deputy Mayor Basher stated that they will notify the Chief
of Police. Administrator Blau stated that it is the responsibility of the people who use the park to close the gate.
- Sidewalks and sink holes that need repair: Corner of Broadway and Tappan Manor and sinkhole on Martling Avenue by Hitachi. Administrator Blau asked Ms. Semeraro to email him the list and he will have them checked out immediately.
- Who decides when items go to the Ethics Board? Administrator Blau stated that people who have a question whether if something is in violation of the Ethics Code may go directly to the Ethics Board. They can be items sent directly to the Ethics Board as a question or in some cases, employees ask for opinions from the Ethics Board.
Patrick Derivan, Franklin Courts, Chairman of the Riverside truck committee, stated that the specifications that were given for the truck to fit in the building were 115 or 116 inches. The consultant and the manufacturer measured the
door. The truck committee made it clear to the consultant that consideration has to be made to the degree and angle of the front driveway with the 119 inch door. It is being rectified by the Village, the consultant and the manufacturer.
SEQR – RIVERFRONT PARKING LOT

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby declare itself Lead Agency for the purposes of Article 8 (State Environmental Review Act) of the Environmental Conservation Law for the development of a new parking lot on the riverfront in the area commonly known as the Fire Training Center; and
BE IT FURTHER RESOLVED that in accordance with Article 8 of the State Environmental Conservation Law and 6NYCRR Part 617, including without limitations the criteria set forth in 6 NYCRR Part 617.7(c) and based upon review of the Environmental Assessment Form and all other materials that were prepared for the Proposed Action, the Village Board of Trustees hereby determines that the Proposed Action will not have a significant adverse impact on the environment, and hereby adopts a Negative Declaration.

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby schedule a Public Hearing for the regular meeting of September 6, 2011, at 8 p.m., at Village Hall, One Depot Plaza, Tarrytown, New York 10591, to hear, discuss and act upon a proposed amendment to the Code of the Village of Tarrytown, Chapter 291-48, Vehicles and Traffic, Non-resident business permit, to allow one business parking permit holder up to four (4) vehicles per parking permit, but the permit may not be used for more than one vehicle at a time.

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the regular meeting of the Board of Trustees held on July 18, 2011 as submitted by the Village Clerk.
APPROVAL OF AUDITED VOUCHERS NO. 504 THROUGH NO. 838
Trustee McGovern moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved: Approved: 6-0
BE IT RESOLVED the Board of Trustees hereby approves the Audited Vouchers No. 504 through No. 838 is hereby ordered paid in the following amounts:

Library 11,215.21
Trust & Agency 52,636.39
Total $ 1,469,402.47
The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 541, 553, 699, 700, 769, 571, 611, 655, 686, 687 and 827 and Trustee Hoyt who abstained from Voucher Number 613. Motion carried. 6-0

Trustee Zollo moved, seconded by Trustee Hoyt, and unanimously carried that the meeting be adjourned at 10:15 p.m.
