The meeting began with the Pledge to the Flag.
REPORTS
Mayor Fixell stated that the Westchester County Mobile Shredder is coming to Tarrytown again on Saturday, August 13th from 10 a.m. to 2 p.m. at the Village Hall parking lot.
VILLAGE ADMINISTRATOR’S REPORT
H-Bridge Sidewalk Replacement – The bids for the replacement of the sidewalks on the H-Bridge are due on August 1. The funding for this project and other improvement projects that will be forthcoming are from a multi-modal grant administered by the Department of Transportation and Capital Budget funds previously approved by the Board.
Patriots Park – The work to erect a fence that will enclose the play area began today. The split rail fence from the boundary with the library to the first pathway will be removed and a new fence with a historical look will be erected. The fence will extend along the pathway and along the roadway and connect with the existing chain link fence by the basketball court. A 10 foot gate is being installed so that maintenance equipment or an ambulance can enter the fenced in area. The new playground equipment was ordered and as soon as it arrives, that project will begin.
Pierson Park/Andre Brook – The Pierson Park rehabilitation and Andre Brook restoration projects are scheduled to go out to bid on August 2, with a return date of August 30. Based upon the return date, I would anticipate that the project will begin at the beginning of October and should take approximately 1 year to complete.
Installation of Televising Equipment – The majority of the equipment has been received and much of the equipment has been installed on the equipment rack and placed in the videographer’s room. The cameras are expected to be delivered before the end of this month and the person hired to install is ready to complete the project as soon as the cameras are delivered.
Wilson Park Drive - The timeline for the Wilson Park Drive project is scheduled to start on July 18 and should be completed by August 24. The first component is the sewer, followed by the drainage and then the paving. The sewer and drainage should be completed by August 4. Paving will begin on August 15 and be completed by August 24.Work on Warner Lane is scheduled to begin on July 19 with the installation of the water and sewer lines, which should be completed by August 18. The paving on Warner Lane will run concurrent with the paving on Wilson Park Drive. Trustee Zollo asked how far on Wilson Park Drive will the paving go to. Engineer McGarvey stated to Beech Lane. Trustee Zollo stated that the road to Warren Avenue is also a mess and to see what we can
do to have that paved as well.
PUBLIC INFORMATION MEETING TO REVIEW THE PLANS FOR THE PARKING LOT TO BE DEVELOPED AT 17 SOUTH WASHINGTON STREET
Michael J. McGarvey, Village Engineer presented the plans for the new parking lot being developed at 17 South Washington Street. The plan is to provide 24-25 parking spaces, including regular and compact parking spaces, 8 LED parking lot lights (13’ high), drainage improvements and add privacy fencing along the north and south face of the parking lot. Trustee Basher asked if we can extend the privacy fence to allow privacy to a residence’s backyard. Engineer McGarvey stated that he will definitely look into wrapping the privacy fence southeast. Engineer McGarvey also stated that there will be a pedestrian walkway from the new parking lot to the YMCA parking lot and one pay meter will be installed in the front of the new parking lot. Engineer
McGarvey stated that this project is expected to begin in September and should be complete by November of this year. Administrator Blau stated that he has to speak to the Masons with respect to the wall in the parking lot and then construction can begin.
PUBLIC HEARING – PERMIT PARKING FOR COMMERCIAL VEHICLES (adopted)
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Tarrytown will hold a public hearing on the 18th day of July, 2011, at 8 PM, in the Municipal Building, One Depot Plaza, Tarrytown, New York 10591, to hear, discuss and to act upon a proposed amendment to Chapter 291 entitled “Vehicles and Traffic” of the Code of the Village of Tarrytown. A summary of the legislation is available at Village Hall. The complete text of this legislation follows:
A LOCAL LAW to amend §291, Permit Parking, Article VI of the Code of the Village of Tarrytown to create permit parking for certain types of commercial vehicles.
SECTION 1. LEGISLATIVE INTENT AND FINDINGS OF FACT.
A. Findings of Fact.
The Board of Trustees of the Village of Tarrytown has determined that there is a need within the Village to establish a parking permit system for certain types of commercial vehicles in the Village and to designate what parking lots in the Village where vehicles with commercial parking permits may be parked.
B. Legislative Intent.
It is the intent of the Board of Trustees of the Village of Tarrytown to amend the language of §291 entitled "Vehicles and Traffic” of the Code of the Village of Tarrytown, Article VI “Permit Parking” to establish a new parking permit system for certain types of commercial vehicles and designating specific parking lots within the Village where the parking permits may be utilized by permit holders.

SECTION 2. Amendment to §291, Article VI “Permit Parking” of Chapter 291 entitled “Vehicle and Traffic” of the Code of the Village of Tarrytown by creating a new Section 49.A.
§291-49.A. Commercial Vehicle permits.
A. Upon submitting to the Village Treasurer a properly completed signed application and upon payment of a fee as set by resolution of the Board of Trustees, the Village Treasurer shall consider said application as valid and complete for the issuance of a commercial vehicle parking permit, subject to applicable parking limitations and pursuant to the conditions set forth herein. A Commercial Parking Permit shall not be issued to a commercial vehicle, as defined in Section 291-1, should the commercial vehicle exceed the following standards:
(1) Weigh more than 10,000 pounds
(2) Be more than 20 feet in length
(3) Be more than 10 feet in width
A parking permit shall not be issued for any trailer, semitrailer or tractor. Commercial vehicles that obtain a parking permit may park in the Resident Commuter Parking Lot on Depot Plaza and the Non-Resident Commuter Parking Lot on Green Street between the hours of 6:00 p.m. and 6:00 a.m., Monday through Friday and all day on Saturday or Sunday. Commercial parking permits shall not be valid in any other parking lot in the Village of Tarrytown.
B. Commercial vehicles larger than the restrictions noted in Subsection A hereinabove, may, upon submitting to the Village Treasurer a properly completed signed application and upon payment of a fee as set by resolution of the Board of Trustees, obtain a Commercial Vehicle Parking Permit for Oversized Vehicles. A commercial vehicle with this permit may take up to two (2) full parking spaces for the parking of the vehicle for which the permit is issued. Commercial vehicles that obtain a parking permit pursuant to this sub-section may park in the Non-Resident Commuter Parking Lot on Green Street between the hours of 6:00 p.m. and 6:00 a.m., Monday through Friday and all day on Saturday or Sunday. Commercial parking permits shall not be valid in any other parking lot in the Village of Tarrytown. A parking permit shall not be issued for any trailer, semitrailer or tractor.
SECTION 3. EFFECTIVE DATE
This local law shall take effect immediately, as provided by law.
All interested parties are invited to attend and be heard. Access to the meeting room is available to the elderly and the handicapped. Signing is available for the hearing-impaired; a request must be made to the Village Clerk at least five days in advance of the meeting.

WHEREAS, a public hearing was held for the proposed action on July 18, 2011; and
WHEREAS, a notice of public hearing was published in the Journal News on June 25, 2011; and
WHEREAS, the Board of Trustees of the Village of Tarrytown is the only agency which has approval authority over the Proposed Action, and is therefore the Lead Agency for the Proposed Action.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
In accordance with Article 8 of the State Environmental Conservation Law and 6NYCRR Part 617, including without limitations the criteria set forth in 6 NYCRR Part 617.7(c) and based upon review of the Environmental Assessment Form and all other materials that were prepared for the Proposed Action, the Village Board of Trustees hereby determines that Proposed Action will not have a significant adverse impact on the environment, and hereby adopts a Negative Declaration.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Board of Trustees of the Village of Tarrytown hereby adopts Local Law No. 5 of 2011.
PUBLIC HEARING – RECYCLING (adopted)
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Tarrytown will hold a public hearing on the 18th day of July, 2011, at 8 PM, in the Municipal Building, One Depot Plaza,
Tarrytown, New York 10591, to hear, discuss and to act upon a proposed amendment to Chapter 237 entitled “Recycling” of the Code of the Village of Tarrytown. A summary of the legislation is available at Village Hall. The complete text of this legislation follows:
A LOCAL LAW to amend §37-1 Legislative Intent; purpose and §237-2 Preparation of materials for collection of Chapter 237 entitled "Recycling” of the Code of the Village of Tarrytown.
SECTION 1. LEGISLATIVE INTENT AND FINDINGS OF FACT.
A. Findings of Fact.
The Village of Tarrytown has previously executed an Inter-Municipal Agreement with Westchester County for the delivery of recyclables to the Material Recovery Facility. The materials that can be recycled at the Material Recovery Facility are determined by Westchester County and the Village collects those recyclables that can be recycled. Westchester County has provided notice to the Village that the plastics that can now be recycled have expanded and the amendment to this Chapter will reflect this expansion of plastics that can be recycled.
B. Legislative Intent.
It is the intent of the Board of Trustees of the Village of Tarrytown to amend the language of §237 entitled "Recycling” of the Code of the Village of Tarrytown to reflect the additional plastics that can be recycled and delivered to the Westchester County Material Recovery Facility.

SECTION 2. Amendment to §~237-1 “Legislative intent; findings” of Chapter 225 entitled “Recycling” of the Code of the Village of Tarrytown.
§ 237-1. Legislative intent; purpose.
The Board of Trustees of the Village of Tarrytown believes that the recycling of newspapers, cardboard boxes, glass, metal containers and plastic containers (PETE and HDPE) will prevent wasteful incineration, lower the village's charges for refuse disposal, provide an additional revenue stream to the village and will help to conserve natural resources. Mandatory recycling of newspapers, cardboard boxes, glass, metal containers and [(PETE AND HDPE)] plastic containers (1-PETE; 2-HDPE; 3-V; 4-LDPE; 5-PP; 6-PS; and 7-OTHER) will remove a significant tonnage of material from the solid waste stream and divert it to a recyclable use. It is the purpose of this chapter to institute a program of mandatory recycling for specific recyclable materials in an attempt to derive maximum environmental and economic
benefit with minimum inconvenience to residents and property owners.
SECTION 3. Amendment to §~237-2 “Preparation of materials for collection” of Chapter 237 entitled “Recycling” of the Code of the Village of Tarrytown.
A. The owners, lessees or occupants of all structures within the village who receive refuse collection services from the Village of Tarrytown shall package newspapers, cardboard boxes, food and beverage containers made of glass, metals (tin, aluminum and other metals) and plastic~~No. 1 through plastic No. 7 [polyethylene terephthalate (herein referred to as “PETE” and plastic No. 2, high density polyethylene (herein referred to as “HDPE”)]for collection and recycling by the Department of Public Works or its duly authorized agent.
D. Glass containers shall be cleaned on both the inside and the outside of the container. Metal [(C)]caps, tops or lids and the metal [(or plastic)] ring at the top of the glass container must be removed. Plastic caps and the plastic ring at the top of the glass container shall be placed in the recycling container. Glass containers shall be placed in blue boxes or other nondisposable containers, not exceeding 50 pounds in weight per bag, box or container. Glass containers may be commingled with plastic containers and metal containers.
E. Plastic containers No. 1 through 7 [(PETE and HDPE)] shall be cleaned on both the inside and the outside of the container. OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD. SPEAKERS HAVE FIVE (5) MINUTES BEFORE YIELDING TO THE NEXT SPEAKER; THEN THREE (3) MINUTES FOR ADDITIONAL COMMENTS
Joe Queenan, 206 Wilson Park Drive, asked the following:
- There is a hole in the road in front of his house when they hit the water main; who is going to fix that? Engineer McGarvey stated that the contractor will fix it. Mr. Queenan asked if the daily fuel delivery person could get the message not to drive on Wilson Park Drive and go the County House road route instead. The dirt road has become a big problem with dirt getting into our homes and the air quality is horrible. Engineer McGarvey stated that he has requested that the contractor spray the roads down with water.
- Could we have the road closed at night? Administrator Blau asked if he wants the road closed all day and night or just at night. Mr. Queenan stated that either way is fine because during the day while they are working, the road is closed.
- Are the trucks and tractors going to be removed soon from the site? Engineer McGarvey stated that once the road work is complete, all the excavating trucks and tractors will be removed. The contractor will also grade, seed and place hay on all the disturbed areas.
John Chebetar, Sleepy Hollow resident, commented on the following:
- It’s been 10 months since the deaths of John Kelly and Anthony Ruggiero and there is still many questions unanswered as to the conduct of the Village Administrator before and after the incident pertaining to the Village’s Confined Space policy.
- He asked for the status of Mr. Weaver’s hearing. Attorney Shumejda stated that the lawyers’ briefs have been submitted to the hearing officer and the hearing officer will be rendering his decision.
Steve Wilgermein, 330 S. Broadway, asked the following questions:
- How many DPW employees are being trained in confined space entry? Engineer McGarvey stated that all DPW Highway employees are being trained in confined space entry. However, we are planning for only 6 to 8 DPW Highway employees to actually go into confined spaces. Mr. Wilgermein asked what other safety training has been done. Engineer McGarvey stated that safety training has been complete. They have had lock out tag out; blood borne pathogens; and a 10-hour OSHA class given by CSEA and other safety training. He stated that he has a list of all the safety training that has been taken. Mr. Wilgermein asked for a copy of the list.
Lori Semeraro, 205 Martling Avenue, asked the following:
- Did the employee who went into a confined space go in because he didn’t know it was a confined space or did management tell him to go in. Engineer McGarvey stated that management did not tell him to go in and the individual did know it was a confined space. He did not believe given the nature of the catch basin that there was any harm. Since that incident, we reviewed all confined space entry training with all DPW employees.
- Now that the Riverside Hose fire truck fits into the firehouse, what was done to the truck?
Administrator Blau stated that the configuration of the roadway was changed to the front reducing the angle. In addition, there were some leaves (springs) taken off the truck to lower the level of the truck. They are now working with Riverside, the manufacturer and the rep from the manufacturer of the truck to discuss the springs that were removed to make sure that everything is done appropriately for the Riverside Hose and the Village.
Ms. Semeraro asked if the removal of the springs would void the warrantee from the manufacturer. Administrator Blau stated that he is going get it in writing that the manufacturer’s warrantee is not voided.
- What were the waivers for with respect to the Fire Chiefs? Administrator Blau stated that it had to do with a section of our Code whereby if you have a family member who works for a company involved with business with the Village, you have to get a waiver in order to hold that particular office.
- She has concerns with how the tattoo law is being designed. It seemed to her that this law is being designed specific for this one vendor. She would like the Board to take into account the entire Village and not just this one vendor when drafting the law. Mayor Fixell and Trustee Butler stated that the law is not being designed around one vendor. We are making a law that will apply for the entire downtown district. We are looking to adopt a law that has come from the City of New Rochelle with changes that make sense to our Village.
Chuck Hognell, the prospective tattoo parlor owner, stated that he does not have an exact location yet for his tattoo shop and that New York State law requires an individual to be 18 years of age to get a tattoo.
SEQR – 17 SOUTH WASHINGTON STREET PARKING LOT

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby declare itself Lead Agency for the purposes of Article 8 (State Environmental Review Act) of the Environmental Conservation Law for the
development of an improved parking lot at 17 South Washington Street; and
BE IT FURTHER RESOLVED that in accordance with Article 8 of the State Environmental Conservation Law and 6NYCRR Part 617, including without limitations the criteria set forth in 6 NYCRR Part 617.7(c) and based upon review of
the Environmental Assessment Form and all other materials that were prepared for the Proposed Action, the Village Board of Trustees hereby determines that the Proposed Action will not have a significant adverse impact on the
environment, and hereby adopts a Negative Declaration.
DECLARE INTENT TO BE LEAD AGENCY – RIVERFRONT PARKING LOT

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby declare its intent to be Lead Agency for the purposes of Article 8 (State Environmental Review Act) of the Environmental Conservation Law for the
development of a new parking lot on the riverfront in the area commonly known as the Fire Training Center.
AGREEMENT WESTCHESTER COUNTY – PRISONER TRANSPORTATION
Trustee Hoyt moved, seconded by Trustee Butler, and unanimously carried, that the following resolution be approved: Approved: 7-0
BE IT RESOLVED that the Village Administrator is hereby authorized and directed to execute an Inter-municipal Agreement (IMA) between the Village and Westchester County regarding reimbursement to the Village of Tarrytown
Police Department for prisoner transportation to County jail facilities for the period January 1, 2011 to December 31, 2012.

APPOINTMENT OF MARRIAGE OFFICER
Trustee Butler moved, seconded by Trustee McGee, and unanimously carried, that the following resolution be approved: Approved: 7-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby appoint the Village Clerk as a Marriage Officer of the Village of Tarrytown for a term to expire in April of 2012.

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby schedule a Public Hearing for the regular meeting of August 15, 2011, at 8 p.m., at Village Hall, One Depot Plaza, Tarrytown, New York 10591, to hear, discuss and to act upon a proposed compatible use permit for Tarrytown House Estate and Conference Center (“Tarrytown House”), at East Sunnyside Lane, Tarrytown, New York for the purpose that it may be designated as a conference center as defined under the Zoning Code of the Village of Tarrytown.

hear, discuss and act upon a proposed amendment to the Code of the Village of Tarrytown, Chapter 268, Tattoo Parlors, to rescind the existing Chapter 268 entitled “Tattoo Parlors,” which Chapter prohibited tattoo parlors in the
Village and to adopt a new Chapter 268 to permit tattoo parlors subject to certain restrictions.

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby schedule a Public Hearing for the regular meeting of August 15, 2011, at 8 p.m., at Village Hall, One Depot Plaza, Tarrytown, New York 10591, to
hear, discuss and act upon a proposed amendment to the Code of the Village of Tarrytown, Chapter 273, Taxicabs and Liveries, to turn over the responsibility for the issuance of drivers’ licenses to the Westchester County Taxi and
Limousine Commission.

Trustee Basher moved, seconded by Trustee Zollo, that the following be approved. Motion carried, all voting “aye” with the exception of Trustee McGovern who abstained. Approved: 6-0-1
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the regular meeting of the Board of Trustees held on June 20, 2011 as submitted by the Village Clerk.
APPROVAL OF THE MINUTES OF THE SPECIAL MEETING OF THE BOARD OF TRUSTEES HELD ON JUNE 28, 2011
Trustee Zollo moved, seconded by Trustee Basher, that the following be approved. Motion carried, all voting “aye” with the exception of Trustee McGovern who abstained. Approved: 6-0-1
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby approve the minutes of the Special Meeting of the Board of Trustees held on June 28, 2011 as submitted by the Village Administrator.
APPROVAL OF AUDITED VOUCHERS NO. 000237 THROUGH NO. 000503
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved: Approved: 7-0
BE IT RESOLVED the Board of Trustees hereby approves the Audited Vouchers No. 000237 through No. 000503 is hereby ordered paid in the following amounts:

The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 000300, 000365, 000366, 000419, 000420, 000421, 000422, and 000481 and Trustee Hoyt who abstained from Voucher Numbers 000272 and 000265. Motion carried. 7-0
