Executive Session No. 7
May 2, 2011

PRESENT: Mayor Fixell, Trustees Basher, Butler, Hoyt, McGee and Zollo; Administrator Blau, Treasurer Hart, Attorney Shumejda
ABSENT: Trustee McGovern
Steven Silverberg, Esq., the attorney that represented the Village is an Article 78 filed against the Village of Sleepy Hollow in regards to the previous site plan and environmental review for the development of the General Motors property discussed with the Board the status of the development project and the actions taken by the Village of Sleepy Hollow Board of Trustees in regards to the current proposal. Attorney Silverberg noted that the previous Article 78 authorized by the Board of Trustees had been placed on hold pursuant to an agreement between Tarrytown and Sleepy Hollow. Based upon a review of the current status of the project, it is the recommendation of Attorney Silverberg that the Tarrytown Board of Trustees authorize his firm to commence a new Article 78 in regards to the GM development project,
due to the fact that the issues that prompted the previous Article 78 by Tarrytown have not been addressed in the current iteration of the project.
Trustee Zollo moved, seconded by Trustee Butler that the following resolution be approved. Motion carried, all voting “aye”. Approved: 6-0.
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorize the firm of Silverberg Zalantis LLP to commence an Article 78 action against the Village of Sleepy Hollow in relation to the General Motors development project.
