Special Meeting No. 28

PRESENT: Mayor Fixell, Trustees Basher, Hoyt, McGee McGovern and Zollo; Administrator Blau; Attorney Shumejda
ABSENT: Trustee Butler
Trustee Zollo moved, seconded by Trustee Basher and unanimously carried to open the Special Meeting.
Trustee Basher read the following statement into the record:
Mr. Mayor – On the advice of outside counsel, I am recusing myself from all deliberations and discussions regarding this personnel issue. As you and the entire Board are aware, I previously recused myself Wednesday evening before the Board went into Executive Session to discuss this matter.
Trustee McGovern moved, seconded by Trustee Zollo that the following resolution be approved. Motion carried, all voting “aye”. Approved: 5-0.
RESOLUTION – APPOINTING A HEARING OFFICER WITH RESPECT TO SECTION 75 CHARGES
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorize the Mayor to appoint Peter Korn as Hearing Officer with respect to the disciplinary charges dated February 4, 2011 preferred against Scott Weaver. The Hearing Officer shall hold a hearing on the charges and cause a record to be made of the hearing. The Hearing Officer shall forward his Report and Recommendation on the charges and penalty, if any, if Mr. Weaver is recommended to be found guilty of one or all of the charges to the Mayor for final determination subject to the approval of the Board of Trustees; and
BE IT FURTHER RESOLVED that the Board of Trustees hereby authorizes the Mayor to suspend Mr. Weaver from duty immediately until the final determination of the charges; and
BE IT FURTHER RESOLVED that Peter Korn shall be paid on a per diem basis $1,050 for serving in as Hearing Officer.

Trustee Zollo moved, seconded by Trustee Hoyt and unanimously carried that the Special Meeting be adjourned. Meeting was adjourned at 12:05 p.m.
