PRESENT: Mayor Fixell presiding; Trustees Basher, Hoyt, McGee, and Zollo; Administrator Blau; Treasurer Hart; Village Attorney Shumejda; Village Clerk Booth
ABSENT: Trustees Butler and McGovern
The meeting began with the Pledge to the Flag.
MOMENT OF SILENCE – ANTHONY RUGGIERO JR. AND JOHN KELLY
Mayor Fixell stated that this meeting is coming under the most trying circumstances, a terrible tragedy occurred in Tarrytown yesterday, where two of our local citizens, Anthony Ruggiero Jr. and John Kelly died. Anthony Ruggiero died while he was performing his job for the people of Tarrytown. He worked for the Department of Public Works for 30 years and a long-time member of our Fire Department with Hope Hose Fire Company. John Kelly was a long-time member of our Fire Department, recently with Conqueror Hook & Ladder. Anthony Ruggiero was working on a clogged sewer main, went into a manhole, collapsed and fell to the bottom. John Kelly, in an attempt to rescue him, also went into the manhole and fell to the bottom as well. The details are still unknown and are under
investigation. These men are heroes of the Village and we are very thankful for their devoted service and our hearts and prayers go out to their families. It is a terrible loss for them and our entire community. Mayor Fixell requested a moment of silence in memory of Anthony Ruggiero Jr. and John Kelly.
Mayor Fixell stated that as a show of support throughout the County, Villages and Towns have lowered their flags at half staff in honor and memory of Anthony Ruggiero Jr. and John Kelly.
Administrator Blau stated that the visitation and funeral arrangements for Anthony Ruggiero Jr. and John Kelly will be posted on our website.
Mayor Fixell stated that yesterday and last night our Fire Department, Police Department and our Ambulance Corp did a remarkable job under the most terrifying circumstances. There were many heroes and an outpouring of support for Anthony and John. The first two firemen who went into the manhole equipped with oxygen to rescue Anthony and John were 2nd Assistant Gene Gasparre and fireman, Felix Sartaria. We also want to thank all our neighboring communities who supported us and provided Mutual Aid to our Village.
The Fire Department will be having a 9-11 Ceremony on Saturday, September 11th at Patriot’s Park at 8:45 a.m.
The Board has abbreviated the agenda for tonight’s meeting.

AGREEMENT WITH WESTCHESTER COUNTY – TARRYTOWN/SLEEPY HOLLOW SUMMER DAY CAMP
Trustee Hoyt moved, seconded by Trustee McGee, and unanimously carried, that the following resolution be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes and directs the Village Administrator to execute an agreement between Westchester County and the Village of Tarrytown to provide
additional funding for the 2009 Tarrytown/Sleepy Hollow Summer Day Camp program.
AGREEMENTS WITH NEW YORK STATE ENERGY RESEARCH AND DEVELOPMENT AUTHORITY (NYSERDA)
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes and directs the Village Administrator to execute two agreements between New York State Energy Research and Development Authority (NYSERDA) and the Village of Tarrytown for the purpose of providing partial funding for the installation of solar panels on Village Hall and replacing the existing lighting in the traffic signals and traffic warning devices that are the responsibility of the Village with LED lighting.

RESOLUTION – FIRE DEPARTMENT MEMBERSHIP CHANGES
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the following Fire Department membership change recommended at the July 20, 2010 Board of Fire Wardens meeting: Membership: Christopher Garcia was approved for active membership in Riverside Hose Company; and
BE IT FURTHER RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the following Fire Department membership change recommended at the August 17, 2010 Board of Fire Wardens meeting: Membership: Kevin Maloy was approved for active membership in Phenix Hose Company.
SCHEDULE A PUBLIC HEARING - CHAPTER 125, DOGS AND OTHER ANIMALS
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby schedule a Public Hearing for the regular meeting of September 20, 2010 to hear and discuss a proposed amendment to the Code of the Village of Tarrytown, Chapter 125, Dogs and Other Animals, Section 125-2 Restrictions by removing the term “domestic animal” in the Chapter and to eliminate other inconsistencies between this Chapter and the Master Fee Schedule.

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby schedule a Public Hearing for the regular meeting of September 20, 2010 to hear and discuss a proposed amendment to the Code of the Village of Tarrytown, Chapter 205, Landscaping, Section 205-3.1 Seasonal ban on gas-powered leaf blowers to clarify language that the use of Gasoline-powered leaf blowers during the period of June 15 through September 15 would not be permissible by anyone other than residents and homeowners at their residence.

BE IT RESOLVED the Board of Trustees hereby approves the Audited Vouchers No. 000819 through No. 001013 is hereby ordered paid in the following amounts as amended:

The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 000924, 000980, 000981, and 000982 and Trustee Hoyt who abstained from Voucher Numbers 000959, 000920, 000922, 000872 and 000931. Motion carried. 5-0
