Special Joint Meeting  No. 30

PRESENT:  Board of Trustees:  Mayor Fixell; Trustees Butler, Hoyt, McGee, McGovern, Basher and Zollo
                Planning Board:  Chairman Friedlander; Members Birgy, Raiselis and Tedesco

HUDSON HARBOR (FERRY LANDINGS) – 41 HUDSON VIEW WAY – AMENDMENT TO SEQR FINDINGS

Mayor Fixell stated the Boards held a public hearing on January 26, 2010, which was continued on February 2, 2010, to consider an amendment to the Findings Statement to allow for site plan changes in Phase II at Hudson Harbor.  

Ms. Melissa Kaplan-Macey of BFJ Planning, the Village’s Consultant, reviewed with the Board the proposed Findings amendments and the reason for the amendments, as was discussed during the public hearing.  She noted following the public hearings, one area which the Boards felt should have some modification was with Buildings 2B and 2C (center courtyard buildings.)  The applicant had requested the height for these buildings be 25 ft. but in discussion, the Boards felt 50% of the buildings should have a maximum height of 25 ft. but the remaining 50% should be allowed flexibility in height up to 30 ft. This would allow for some variation in roof lines which could provide a better architectural product.   Ms. Kaplan-Macey stated Phase II will still need site plan approval and architectural review and approval.

Mr. Tedesco moved, seconded by Ms. Raiselis, and unanimously carried, that the following resolution be adopted:

WHEREAS,  Tarrytown Waterfront I, LLC, aka National RE/sources, the developer of the project known as Hudson Harbor, previously known as Ferry Landings, filed an application with proposed changes to the project; and
        WHEREAS, it has been determined that the proposed changes as requested by Tarrytown Waterfront I, LLC require an amendment to the Findings Statement for Ferry Landings approved at a Joint Board of Trustees/Planning Board meeting held on February 6, 2006; and
        WHEREAS, Public Hearings were held for the proposed action on January 26, 2010 and February 2, 2010; and
        WHEREAS, it is the belief of the Board of Trustees and the Planning Board that the proposed changes at the Hudson Harbor project associated with the amendments to the February 6, 2006 Findings Statement for Ferry Landings will enhance the viewsheds
through the Waterfront General Business District (WGBD) Zoning District, will decrease the amount of impervious surface in the WGBD Zoning District and will increase the amount of open space in the WGBD Zoning District; and
        WHEREAS, it is the belief of the Board of Trustees and the Planning Board that the proposed changes at the Hudson Harbor project associated with the amendments to the February 6, 2006 Findings Statement for Ferry Landings will promote environmentally friendly development on the Tarrytown Waterfront and enhance and insure beneficial development of this resource for all the citizens of the Village of Tarrytown.
        NOW THEREFORE, BE IT RESOLVED that the Planning Board of the Village of Tarrytown does hereby amend the February 6, 2006 Findings Statement for Ferry Landings as included in the Amendment to Findings Statement for Hudson Harbor (Ferry Landings) and attached diagrams.  

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be adopted:
