PRESENT:  Mayor Fixell; Trustees Basher, Butler, Hoyt, McGee, McGovern and Zollo; Village Administrator Blau; Village Treasurer Hart; Village Attorney Shumejda

Trustee Basher moved, seconded by Trustee Butler to open the Special Meeting.  Motion carried, all voting “aye”.  Approved: 7-0

RESOLUTION TO HOLD A PUBLIC HEARING FOR THE PURPOSE OF MAKING DETERMINATION AND FINDINGS UNDER THE EMINENT DOMAIN PROCEDURE LAW REGARDING PROPOSED ACQUISITION OF REAL PROPERTY FOR DEVELOPMENT OF A PARKING LOT AT 17-19 SOUTH WASHINGTON STREET

Trustee Butler moved, seconded by Trustee Zollo, that the following resolution be approved.  Motion carried.  6 Ayes; 0 Nays; Trustee Basher Abstained.  

WHEREAS, in order to allow for the construction of a public parking, it will be necessary the Village of Tarrytown ("Village") to acquire two tax lots  known as 17-19 South Washington Street, designated on the tax map of the Village of Tarrytown as Sheet 10, Block 34, Lots 19 and 22 from its present owner, Solomon’s Lodge 196, B. Mattson, R. Sasso, J. Beers; and

WHEREAS, the Village proposes to hold a public hearing to hear, discuss and to act on a proposal to initiate condemnation procedures to acquire such real property, in order to implement and allow processes for the orderly acquisition, clearance, disposition and development of a parking lot at 17-19 South Washington Street; and

WHEREAS, the Village pursuant to the provisions of the New York State Eminent Domain Procedure Law ("Law"), the Board of Trustees of the Village of Tarrytown on May 18, 2009, at 8 PM, in the Municipal Building, One Depot Plaza, Tarrytown, New York will conduct, upon due public notice, a public hearing at which there will be outlined the purpose and proposed location of the public project for which the acquisition of property is proposed;

NOW, THEREFORE, BE IT RESOLVED, that in accordance with the Law, that, on May 18, 2009, at 8 PM, in the Municipal Building, One Depot Plaza, Tarrytown, New York, pursuant to the Law respecting the proposed acquisition of the property by the Village, the Board of Trustees of the Village of Tarrytown, will hold a public hearing to hear, discuss and to act on a proposal to initiate condemnation procedures to acquire two tax lots designated on the Tax Map of the Village of Tarrytown as Sheet 10, Block 34, Lots 19 and 22, from its present owner, Solomon’s Lodge 196, B. Mattson, R. Sasso, J. Beers and  together with any and all rights, easements and hereditaments appurtenant to such lands, buildings and improvements; and

RESOLVED, that the Board of Trustees of the Village of Tarrytown hereby authorizes the Mayor to direct the Village Clerk to publish notice of the foregoing hearing in accordance with said Eminent Domain Procedure Law.

RESOLUTION CONCERNING INTENT FOR SEQRA LEAD AGENCY DESIGNATION BY THE BOARD OF TRUSTEES

Trustee Hoyt moved, seconded by Trustee Butler, that the following resolution be approved.  Motion carried.  6 Ayes; 0 Nays; Trustee Basher Abstained.  

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby declare its intent to be Lead Agency for the purposes of Article 8 (State Environmental Review Act) of the Environmental Conservation Law for the following proposed actions:

Condemnation of two tax lots designated on the Tax Map of the Village of Tarrytown as Sheet 10, Block 34, Lots 19 and 22, from its present owner, Solomon’s Lodge 196, B. Mattson, R. Sasso, J. Beers for public use. The subject property is commonly known as the Masons’ property. It is located on 17-19 South Washington Street in the Village of Tarrytown, Westchester County, New York. The 10,360 square feet of land (approx. 0.24 acre) includes two buildings: one five bay garage building and one three bay garage/retail building. The public use for said property is the demolition of the existing structures and the construction of public parking in the business district of Tarrytown and an application for site development plan approval pursuant to Section 305-52 of the Zoning Code of the Village of Tarrytown.

Trustee Zollo moved, seconded by Trustee Basher and unanimously carried that the Special Meeting be adjourned at 6:20 p.m.
