PRESENT:  Mayor Fixell presiding; Trustees Basher, Butler, Hoyt, McGee, McGovern and Zollo; Village Administrator Blau; Village Treasurer Hart; Village Attorney Shumejda; and Village Clerk Booth

Mayor Fixell introduced John Tomlin, a representative from State Senator Stewart-Cousins Office.

John Tomlin, a representative from State Senator Stewart-Cousins Office, stated that as a community liaison for Senator Stewart-Cousins, he plans to attend as many Tarrytown board meetings as he can and announced that the Senator will be hosting a Town Hall forum on Saturday, April 25th, at 10 a.m. about the federal stimulus package and its effects on local communities.  It is being held at the Greenburgh Public Library at 300 Tarrytown Road.

REPORT

Mayor Fixell reported on the following:

  • The Village’s Third Friday event celebrated “the Environment.”  It was a glorious night with hundreds of people who filled the streets and restaurants.  
  • The Village-wide clean-up was held on Saturday and was sponsored by the Tarrytown Environmental Advisory Council (TEAC).  This was a successful event with at least one hundred volunteers.  They cleaned areas at the Tarrytown Lakes, the aqueduct, downtown, and at the Tarrytown train station.
  • A few hours later, the TNT Parade kicked off from Neperan Road with great participation; children, coaches and parents.  It was a great weekend whereby the community came out in so many ways.
  • On Sunday, Westchester County celebrated an Earth Day event at the Kensico Dam Plaza in which Tarrytown received an award for the greatest improvement in recycling.  Scott Weaver, General Foreman was there to accept the award.
This is a true testament from the residents of the Village, Scott Weaver and the staff of the Department of Public Works.  The Mayor believes that recycling increased by 50% in the Village in the past year.
  • The Village of Tarrytown will be planting trees at Patriots Park in celebration of Arbor Day at a rescheduled date to be held this Thursday at 11 a.m.    Everyone is welcome to join in on the celebration!
Trustee McGovern wished her son a Happy 16th Birthday.

Trustee McGee stated that this Saturday and Sunday from 10 a.m. to 5 p.m., the Friends of Warner Library are sponsoring their Spring Book Sale.   She urged everyone to come
out and support our library.

Trustee Hoyt stated that the residents should have received the Recreation Spring/Summer brochure.   There are many spring and summer fun activities and he hopes the residents will
participate.

Trustee Basher stated that this Saturday, the YMCA is sponsoring its annual family Fun and Health Day at Patriot’s Park in conjunction with the Rotary’s Duck Derby, which will start at
12 noon.

Lori Semeraro, 205 Martling Avenue, commented on a few budget items.

ARBOR DAY PROCLAMATION

Trustee McGovern moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  7-0

WHEREAS, In 1872 J. Sterling Morton proposed to the Nebraska Board of Agriculture that a special day be set aside for the planting of trees, and

WHEREAS, This holiday, called Arbor Day, was first observed with the planting of more than a million trees in Nebraska, and

WHEREAS, Arbor Day is observed throughout the nation and the world, and

WHEREAS, Trees can reduce the erosion of our precious topsoil by wind and water, cut heating and cooling costs, moderate the temperature, clean the air, produce oxygen and provide habitat for wildlife, and

WHEREAS, Trees are renewable resources giving us paper, wood for our homes, fuel for our fires and countless other wood products, and

WHEREAS, Trees in our city increase property values, enhance the economic vitality of business areas, and beautify our community, and

WHEREAS, Trees are a source of joy and spiritual renewal, and

WHEREAS, The Village of Tarrytown has been recognized as a Tree City USA by the National Arbor Day Foundation and desires to continue its tree-planting ways, and

NOW THEREFORE, I, Mayor Drew Fixell, Village of Tarrytown, do hereby proclaim April 23, 2009  as “ARBOR DAY” in the Village of Tarrytown, and I urge all citizens to support efforts to care for our trees and woodlands and to support our community forestry program, and

FURTHER, I urge all citizens to plant trees to gladden the hearts and promote the well being of present and future generations.

BUDGET ADOPTION RESOLUTION FISCAL YEAR  2009-2010  

Trustee Butler stated that the Board worked very hard on the Village budget and was pleased to propose a tax increase of 2.9%.
Trustee Zollo moved, seconded by Trustee Hoyt, and unanimously carried that the following be approved:  Approved:  7-0

A Resolution Adopting a Budget for the Fiscal Year commencing June 1, 2009 and ending May 31, 2010; and

WHEREAS, the Board of Trustees has met at the time and place specified in the notice of public hearing on the tentative budget and heard all persons desiring to be heard thereon.

NOW THEREFORE BE IT RESOLVED, that the tentative budget as amended and revised and as hereinafter set forth is hereby adopted and that there be and is hereby appropriated for the objects and purposes specified, including the amounts set forth required for the payment of principal and interest on indebtedness, the following amounts:

FISCAL YEAR 2009-2010 TAX LEVY AND WARRANT

WHEREAS, the budget for the fiscal year commencing June 1, 2009, has been duly adopted and filed with the Village Clerk; and

WHEREAS, it has been thereby determined that the sum of $19,728,226 will be necessary to meet the obligations of the Village; and

WHEREAS, there has been duly credited as against said sum estimated revenues and appropriated fund balance aggregating $5,328,000 leaving $14,400,226 to be raised by the levying of taxes; and

WHEREAS, it appears from the Assessment Roll of the year 2009 for taxes for the fiscal year June 1, 2009 that the total assessed valuation of real property in the Village is $59,504,827.

NOW THEREFORE BE IT RESOLVED, that the tax rate for the Village of Tarrytown for the fiscal year commencing June 1, 2009 be and the same hereby is fixed at the rate of $242.00 on each $1,000 of assessed valuation for properties in the Village of Tarrytown.

BE IT FURTHER RESOLVED, that the sum of $14,400,226, the same being taxes for the fiscal year commencing June 1, 2009 be, and the same hereby is, levied upon the taxable property in the Village of Tarrytown and that the Village Treasurer be and he hereby is authorized and directed to extend and carry out upon the roll the amount to be collected from each of the persons named thereon, and the respective amounts of said tax roll against each such parcel of taxable property set forth thereon be and the same hereby are levied upon each parcel of taxable property respectively which said levy includes items shown on the budget for the fiscal year commencing June 1, 2009.   

APPOINTMENT OF ASSISTANT VILLAGE ENGINEER – DONATO PENNELLA

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby appoints Donato Pennella to the position of Assistant Village Engineer from the Westchester County Eligible List No. 68-941 at an annual salary of $90,000.

BE IT FURTHER RESOLVED that the appointment shall be effective on April 10, 2009 and that said appointment is subject to a probationary period and to all applicable civil service rules and regulations.

ACKNOWLEDGEMENT OF RECEIPT OF THE 2008 TARRYTOWN
VOLUNTEER AMBULANCE CORPS SERVICE AWARD (PENSION) PROGRAM
ANNUALREPORT REGARDING QUALIFYING POINTS RECEIVED

Trustee Butler moved, seconded by Trustee Zollo, that the following be approved.  Motion carried, all voting “aye” with the exception of Trustee Hoyt who abstained.  Approved 6-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby acknowledge receipt of the Tarrytown Volunteer Ambulance Corps 2008 annual report of
pointsachieved by respective members of the Ambulance Corps for qualification for Village contribution to the Ambulance Corps members service award program, which report shall be
posted for public inspection and comment for 30 days prior to Board of Trustees’ consideration of approving submission of the report to the pension fund underwriter, subject to final
sign-off by the Mayor.

ACKNOWLEDGEMENT OF RECEIPT OF THE 2008 TARRYTOWN VOLUNTEER FIRE DEPARTMENT SERVICE AWARD (PENSION) PROGRAM ANNUAL REPORT  REGARDING QUALIFYING POINTS RECEIVED

Trustee Basher moved, seconded by Trustee Zollo, that the following be approved.  Motion carried, all voting “aye” with the exception of Trustee Hoyt who abstained.  Approved 6-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby acknowledge receipt of the Tarrytown Volunteer Fire Department 2008 annual report of points achieved by respective members of the Fire Department for qualification for Village contribution to the Fire Department members service award program, which report shall be posted for public inspection and comment for 30 days prior to Board of Trustees’ consideration of approving submission of the report to the pension fund underwriter, subject to final sign-off by the Mayor.

RESOLUTION APPROVING SALARY SCHEDULE – TARRYTOWN MUNICIPAL HOUSING AUTHORITY

Trustee Zollo moved, seconded by Trustee Hoyt, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the following salary schedule effective October 1, 2009 for designated members of the Tarrytown Municipal Housing Authority in accordance with Section 32 of the New York State Housing Law:

RESOLUTION – FIRE DEPARTMENT PERSONNEL CHANGES

Trustee Butler moved, seconded by Trustee Zollo, that the following be approved.  Motion carried, all voting “aye” with the exception of Trustee Hoyt who abstained.  Approved 6-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the following Fire Department personnel changes recommended at the March 17, 2009 Board of Fire Wardens meeting:  Drivers:  David J. Jacoby and Robert A. Hoyt III passed as drivers for Consolidated Engine Co. and Kevin Grubbs passed as driver for Washington Engine Co.

TAX CERTIORARI – AMERICAN INDEPENDENT PAPER

Village Attorney Shumejda recommended that the Board table this resolution until
Further  notice.  (No Vote)

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby table the tax certiorari settlement with American Independent Paper as outlined in the Village Attorney’s memorandum dated April 12, 2009.

AGREEMENT BETWEEN THE VILLAGE OF TARRYTOWN AND THE  TARRYTOWN LIEUTENANTS BARGAINING UNIT, LOCAL 588

Trustee Basher moved, seconded by Trustee McGovern, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves a four-year memorandum of agreement between the Village of Tarrytown and the Tarrytown Lieutenants Bargaining Unit, Local 588 effective from June 1, 2008 through May 31, 2012.  The authorized salary increases associated with the four-year agreement are as follows:  Fiscal Year 2008-2009, 3.5%; Fiscal Year 2009- 2010, 3.5%; Fiscal Year 2010 – 2011, 3.85%; and Fiscal Year 2011 – 2012, 4.0%

LEAD AGENCY STATUS FOR THE WESTCHESTER COUNTY FLOOD MITIGATION PROJECT – LOH PARK

Trustee McGee moved, seconded by Trustee Hoyt, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby
declares itself  Lead Agency for the Loh Park Flood Mitigation Project to be partially
funded from a Westchester County Flood Mitigation Project.

NEGATIVE DECLARATION FOR THE WESTCHESTER COUNTY FLOOD MITIGATION PROJECT – LOH PARK

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Board of Trustees for purposes of Article 8 of the Environmental Conservation Law hereby adopts a Negative Declaration with respect to the Westchester County Flood Mitigation Project for Loh Park.

WESTCHESTER COUNTY FLOOD MITIGATION PROJECT – LOH PARK

Trustee Zollo moved, seconded by Trustee McGee, and unanimously carried that the following be approved:  Approved:  7-0

WHEREAS, in 2007 Westchester County Executive Andrew Spano established the Westchester County Flood Mitigation Project and formed the Westchester County Flood Action Task Force to address flooding within the County; and

WHEREAS, the Flood Mitigation Project enables Westchester County to partner with municipalities and other government agencies to provide funding for flood control or flood damage reduction projects where there is also a County purpose to be served; and

WHEREAS, the Village of Tarrytown wishes to participate in the Westchester County Flood Mitigation Project  and has submitted an application to the County of Westchester for financial assistance to address flooding within their municipality; and

WHEREAS, the Village of Tarrytown has passed a resolution on March 11, 2009, authorizing the approval of the Loh Park Flood Mitigation Project; and

WHEREAS, the Village of Tarrytown will adopt the “Development and Planning Standards” of the Westchester County Flood Action Task Force into applicable municipal regulations, guidelines and policies prior to its receipt of any payments from the County of Westchester for the Loh Park Flood Mitigation Project; now, therefore, be it

RESOLVED, the Village of Tarrytown will conduct a SEQR identifying the County of Westchester as an involved agency in accordance with the New York State Environmental Quality Review Act; and be it further

RESOLVED, the Village of Tarrytown will commit $833,500 as the local share of the cost of the Loh Park Flood Mitigation Project, such funds to be provided from various non-County sources; and be it further

RESOLVED, that the Board of Trustees of the Village of Tarrytown does hereby commit to working cooperatively with Westchester County and other municipalities in Westchester County within the watersheds that include land within the Village of Tarrytown to reduce flooding and flood damages; and be it further

RESOLVED that the Board of Trustees of the Village of Tarrytown authorizes Mayor Fixell or his duly authorized representative to enter into negotiations with the County of Westchester to prepare an Intermunicipal Agreement to accomplish the objectives of the aforementioned project.

INTER-MUNICIPAL AGREEMENT (IMA) REGARDING THE ROUTE 9 (BROADWAY) BEAUTIFICATION PROJECT

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Village Administrator is hereby authorized and directed to execute an Inter-municipal Agreement (IMA) between the Village of Tarrytown and Sleepy Hollow regarding the Route 9 (Broadway) Beautification Project.

GREEN ZONES PROGRAM AGREEMENT

Trustee Hoyt moved, seconded by Trustee McGovern, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Village Administrator is hereby authorized and directed to execute an agreement between the Village of Tarrytown and the New York Power Authority regarding the Green Zone Program to enable the Village to participate in a grant program for the purchase of electric vehicles.

AGREEMENT FOR FINANCIAL SUPPORT BETWEEN THE VILLAGE OF  TARRYTOWN AND THE COMMUNITY OPPORTUNITY CENTER OF THE  TARRYTOWNS

Trustee McGee moved, seconded by Trustee McGovern, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Village Administrator is hereby authorized and directed to execute an agreement between the Village of Tarrytown and the Community Opportunity Center to provide for funding totaling $34,000 in fiscal year 2009-2010 for operations, services and/or programs that benefit the residents of the Village of Tarrytown.

AGREEMENT FOR FINANCIAL SUPPORT BETWEEN THE VILLAGE OF TARRYTOWN AND THE TARRYTOWN HISTORICAL SOCIETY, INC.

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Village Administrator is hereby authorized and directed to execute an agreement between the Village of Tarrytown and the Tarrytown Historical Society, Inc. to provide for funding totaling $5,000 in fiscal year 2009-2010 for operations, services and/or programs that benefit the residents of the Village of Tarrytown.

AGREEMENT FOR FINANCIAL SUPPORT BETWEEN THE VILLAGE OF TARRYTOWN AND THE JAZZ FORUM ARTS

Trustee Hoyt moved, seconded by Trustee Butler, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Village Administrator is hereby authorized and directed to execute an agreement between the Village of Tarrytown and the Jazz Forum Arts to provide for funding totaling $2,000 in fiscal year 2009-2010 for operations, services and/or programs that benefit the residents of the Village of Tarrytown.

AGREEMENT FOR FINANCIAL SUPPORT BETWEEN THE VILLAGE OF TARRYTOWN AND THE ST. ELMO COUNCIL KNIGHTS OF COLUMBUS

Trustee Butler moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Village Administrator is hereby authorized and directed to execute an agreement between the Village of Tarrytown and the St. Elmo Council Knights of Columbus to provide for funding totaling $3,600 in fiscal year 2009-2010 for operations, services and/or programs that benefit the residents of the Village of Tarrytown.

AGREEMENT FOR FINANCIAL SUPPORT BETWEEN THE VILLAGE OF TARRYTOWN AND THE NEIGHBORHOOD HOUSE, INC.

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Village Administrator is hereby authorized and directed to execute an agreement between the Village of Tarrytown and the Neighborhood House, Inc. to provide for funding totaling $8,000 in fiscal year 2009-2010 for operations, services and/or programs that benefit the residents of the Village of Tarrytown.

AGREEMENT FOR FINANCIAL SUPPORT BETWEEN THE VILLAGE OF TARRYTOWN AND THE TARRYTOWN/SLEEPY HOLLOW WOLFPACK FOOTBALL AND
CHEERLEADING

Trustee Butler moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Village Administrator is hereby authorized and directed to execute an agreement between the Village of Tarrytown and the Tarrytown/Sleepy
Hollow Wolfpack Football and Cheerleading to provide for funding totaling $5,000 in fiscal year 2009-2010 for operations, services and/or programs that benefit the residents
of the Village of Tarrytown.

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown does hereby schedule a Public Hearing for the regular meeting of May 4, 2009, to hear and consider
a proposal to acquire for public use part of the vacant land owned by Solomon’s Lodge #196 for the purpose of constructing public parking.

APPROVAL OF THE MINUTES OF THE ORGANIZATIONAL MEETING OF THE BOARD OF TRUSTEES HELD ON APRIL 6, 2009

APPROVAL OF AUDITED VOUCHERS NO. 003886 THROUGH NO. 004044

Trustee Zollo moved, seconded by Trustee McGovern, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the Audited Vouchers No. 003886 through No. 004044 is hereby ordered paid in the following amounts as presented by the Village Treasurer:
