PRESENT: Mayor Fixell presiding; Trustees Basher, Hoyt, McGee, and Zollo; Village Administrator Blau; Village Treasurer Hart; Village Attorney Shumejda; and Village Clerk Booth
ABSENT: Trustees Butler and McGovern
The meeting began with the Pledge to the Flag.
ADJOURNMENT OF GRIEVANCE DAY
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the following be approved: Approved: 5-0
WHEREAS, Grievance Day in the Village of Tarrytown commenced at 4:00 p.m. on Tuesday, February 17, 2009; and
WHEREAS, the purpose of Grievance Day is to hear tax grievance proceedings; and
WHEREAS, Grievance Day was conducted in accordance with the requirements of New York State Law.
NOW THEREFORE, BE IT RESOLVED that Grievance Day is hereby closed.
BE IT FURTHER RESOLVED that all grievances are hereby referred to the Village Assessor for a written report on the grievances filed on Grievance Day or before April 1, 2009. The Village Assessor is hereby authorized and directed to arrange for hearings with taxpayers who have requested hearings.
REPORTS
Mayor Fixell stated that this Friday is “Third Friday” in town and tours of our three art galleries are part of the evening’s festivities.

SPEAKER; THEN THREE (3) MINUTES FOR ADDITIONAL COMMENTS
John Lynch, 10 Crest Drive, stated the following:
- Does the Village Board act as the Water Board as well? Attorney Shumejda stated that they do act as the Water Board as well.
- Mr. Lynch does not intend to have a radio frequency meter device installed on top of his water meter.
- He doesn’t believe by law that you can put utility bills onto tax bills.
Felix Lantigua, 69 N. Washington Street stated the following:
- The new taxi waiting area has been working out well.
- He submitted a request to Village Administrator Blau for a waiting area in front of the train station for personal vehicles. People double park and it can be very dangerous. Mayor Fixell stated that the Tarrytown Train Station is slated to be renovated including the platforms and the overpass by Metro North. The Village also has some grant money that we will be looking to make some improvements at the train station.
Lori Semeraro, 205 Martling Avenue, stated that the Board should consider using some of the grant money for lighting by the crosswalk at the train station.
AGREEMENT FOR ARCHITECTURAL SERVICES – EASTVIEW PUMP
STATION
Trustee McGee moved, seconded by Trustee Zollo, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes the Village Administrator to execute an agreement with Earl Everett Ferguson Architect of Irvington, New York, for architectural services associated with the Eastview Pump Station in the amount of $10,000.00.
AGREEMENT FOR SALE OF OLD WASHINGTON ENGINE FIREHOUSE
Trustee Zollo moved, seconded by Trustee Basher, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes the Mayor to execute an agreement of sale for the old Washington Engine Firehouse, 26 Kaldenberg Place, Tarrytown, New York.
PARKING CHANGES ON WILDEY STREET
Trustee Zollo moved, seconded by Trustee McGee, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves parking changes on Wildey Street as follows:

Section 291-80. Schedule XV: Parking Prohibited Certain Hours

TAX LIEN
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes the expenditure for repayment of the purchase of a lien in the amount of $3,714.90 that occurred in March, 2003, as outlined in the Village Attorney’s memorandum dated January 28, 2009.
MANAGEMENT, JUDICIAL AND PART-TIME SALARIES
Trustee Zollo moved, seconded by Trustee Basher, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves a 3.5% salary increase for individuals in the following job titles: General Foreman-Public Works, Recreation & Parks Supervisor, Administrative Assistant, Village Clerk, Village Treasurer, Deputy Village Treasurer, Village Engineer, Chief of Police, Village Justice and Assistant Village Justice retroactive to June 1, 2008; and
FURTHER BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves an increase of 3.5% retroactive to June 1, 2008 in the hourly rate paid for year round part-time employees.

BE IT RESOLVED that the Board of Trustees does hereby schedule a Public Hearing for the meeting of March 2, 2009, to hear and consider an amendment to the Code of the Village of Tarrytown, Chapter 305, Zoning, Section 28, “Additional Requirements for LB, NS, RR and GB Districts Principal uses.”

BE IT RESOLVED that the Board of Trustees does hereby schedule a Public Hearing for the meeting of March 2, 2009, to hear and consider an amendment to the Code of the Village of Tarrytown, Chapter 169, “Flood Damage Prevention,” Section 3.1 Basis for Establishing the Areas of Special Flood Hazard.
APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the minutes of the regular meeting of the Board of Trustees held on February 2, 2009 as submitted by the Village Clerk.
APPROVAL OF AUDITED VOUCHERS NO. 003058 THROUGH NO. 003290
Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the following be approved: Approved: 5-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the audited vouchers No. 003058 through No. 003290 is hereby ordered paid in the following amounts as presented by the Village Treasurer:

The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 003145, 003144, 003075, 003209, 003231, 003269, 003270 and 003271, and Trustee Hoyt who abstained from Voucher Number 003132, 003133, and 003218. Motion carried. 5-0
