PRESENT:  Deputy Mayor Basher presiding; Trustees Butler, Hoyt, McGee, McGovern and Zollo; Villagae Administrator Blau; Village Treasurer Hart; Village Attorney Shumejda; and Village Clerk Booth

ABSENT:  Mayor Fixell

The meeting began with the Pledge to the Flag.

REPORTS

Deputy Mayor Basher stated that Mayor Fixell will not be attending tonight’s Board meeting because he is attending the Presidential Inauguration in Washington, D.C.

Trustee Butler congratulated our new President of the United States, Barack Obama; the entire Board concurred.

Administrator Blau reported on the following subjects that were brought to the Board’s attention by the public at the last Board of Trustees meeting :  

Catch Basin – During rain events, water and debris are washed into a catch basin.  There is a sump, which is approximately 4 inches deep at the bottom of a catch basin and the debris gets washed into the basin and flows in the sump at the bottom of the basin.  When the water rises, it is conveyed through our storm water system into the streams and river.   If there was no sump in the catch basin, the debris would be directed into the pipes where it could get caught and create a blockage in the system.  Our catch basins are cleaned out at least once a year.   At this particular catch basin, we have drilled holes into the bottom of the catch basin, so any water that is in the sump area, gets drained into the ground slowly.   Therefore, we do not have a lot of standing water in this particular catch basin.   In addition, every year, Westchester County’s Health Department has a program in place where they put a larvicide in all our sumps to kill insects, etc.

Asphalt Mound – The mound is actually a curb that runs along the driveway leading back to the property owner who spoke at the last meeting.  Her house is located behind a house directly on Sheldon Avenue.  During heavy rains, water was sheeting across the driveway and into the neighbor’s yard.  There was a lower curb along the driveway, but it was not holding back the sheeting of the water.  In an effort to help the neighbor, the Village raised the level of the asphalt curb.  The Village should have requested permission to take any action on the driveway and a letter will be sent out to the property owner asking whether she wants the curb removed.

Towing Contractor – Administrator Blau will be meeting directly with the towing contractor to discuss the parking on Village streets and the parking tickets that have been received.  The Village is also evaluating the towing policy of the Village to determine where it can be modified to allow for additional contractors to tow for the Village and still meet the needs of the community.

PRESENTATION BY BENNETT KIELSON, STORCH AND DESANTIS REGARDING THE VILLAGE’S FINANCIAL AUDIT FOR FISCAL YEAR 2008-2009

Alan Kasay, Lead Auditor, read a paragraph from the Independent Auditors’ Report, ”In our opinion, the financial statements referred to above present fairly, in all material respects, the respective financial position of the governmental activities, each major fund and the aggregate remaining fund information of the Village of Tarrytown, New York as of May 31, 2008 and respective changes in financial position and the respective budgetary comparison for the General and Water funds for the year then ended in conformity with accounting principles generally accepted in the United States of America.”  Mr. Kasay pointed out that in the 2008-2009 budget, there are certain things that the Board should be mindful of due to the current status of the economic condition.  During the current year, the sales tax increased 3.6%.  From our review of various county budgets, his projection is that next year, sales tax will basically have zero growth.  In addition, interest and penalties on real property tax increased by 44%.  The interest earnings were up three-tenths percent and next year, they will probably stay flat as well.  The mortgage tax for the current year is down 23% compared to the prior year and that may continue to decrease as well.  Trustee Butler asked if he can get in a snap shot what this all means.  Mr. Kasay stated that during your budget process, certain revenues, of which you have no control of, are anticipated to stay flat or decrease compared to the numbers this year.  If your revenues come in lower than they were this year and your expenditures stay what they are this year, you will have a larger decrease in your fund balance next year.  The other big item that will not affect you in 2009, but will in 2010, are the rates for the retirement contributions, which are expected to go up substantially.

Opportunity for the Public to Address the Board.  Speakers have five (5) minutes before yielding to the next speaker; then three (3) minutes for additional comments

Felix Lantigua, 69 N. Washington Street stated that he had submitted a petition to the Village on September 2nd about the parking issue on North Washington Street.  He stated that it is difficult to find a place to park where there isn’t alternate side parking. He lives near Wildey Street and Storm Street, but he can’t park there because it requires a special parking permit.  He was told on December 1st, that he was approved to get a special parking permit and then just last week, he found out that he was not approved.  Deputy Mayor Basher stated that the Board will look at this at the next work session.

APPROVAL OF CHANGE ORDER FOR SUMMIT CONSTRUCTION FOR WORK PERFORMED AT WASHINGTON ENGINE AND CONSOLIDATED ENGINE FIREHOUSES

Trustee McGovern moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  6-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the change orders for work performed by Summit Construction at Washington Engine and Consolidated Firehouses totaling $83,426.22.

RESOLUTION – FIRE DEPARTMENT MEMBERSHIP

Trustee Hoyt moved, seconded by Trustee McGee, and unanimously carried that the following be approved:  Approved:  6-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown approves the following Fire Department personnel changes recommended at the December 16, 2008 Board of Fire Wardens meeting:  Membership:  Joseph Pinzel, Kevin Igwe and Catherine Hopkins were approved as active members of Riverside Hose Company; Amanda Kate Scogna was approved as active members of Consolidated Engine Company.  Drivers:  Tom Keane of Riverside Hose Company was approved as driver of Utility 61; and Miguel Valle and Paul Capello of Riverside Hose Company were approved as crew for Fireboat 5.

RESOLUTION SETTING THE DATE FOR PROPERTY TAX GRIEVANCE DAY
Trustee McGovern moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  6-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby schedules Property Tax Grievance Day for Tuesday, February 17, 2009, between the hours of 4:00 p.m. and 8:00 p.m. at Tarrytown Village Hall.

APPROVAL TO AMEND THE MASTER FEE SCHEDULE FOR TAXI CAB FARE RATES

Trustee McGovern moved, seconded by Trustee McGee, and unanimously carried that the following be approved:  Approved:  6-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby amends the Master Fee Schedule for the Village of Tarrytown pertaining to Taxi Cab Fare rates as follows:

  • Passengers who are senior citizens (age 62+) from any point having its origin with the Village of Tarrytown to any point having its destination within the Village of Tarrytown:  three dollars ($3.00)
  • Each additional passenger riding going from the same point of origin to the same point of destination within the Village as the senior citizen:  one dollar ($1.00)
APPROVAL OF STIPULATION OF AGREEMENT BETWEEN C.S.E.A. AND VILLAGE

Trustee Zollo moved, seconded by Trustee Hoyt, and unanimously carried that the following be approved:  Approved:  6-0

WHEREAS, the negotiating committees for the Village and CSEA, Local 1000, AFSCME, AFL-CIO, Westchester County, Village of Tarrytown Unit (“CSEA”) entered into a Memorandum  of Agreement dated December 29, 2008for a successor contract to the collective bargaining agreement that expired May 31, 2008; and

WHEREAS, the Village was  notified on January 14, 2009 that the membership of the CSEA voted to ratify the Memorandum of Agreement dated December 29, 2008; and

WHEREAS, the authorized salary increases associated with the four-year agreement are as follows:  Fiscal Year 2008-2009, 3.5%; Fiscal Year 2009- 2010, 3.5%; Fiscal Year 2010 – 2011, 3.85%; and Fiscal Year 2011 – 2012, 4.0%

NOW, THEREFORE, the Board of Trustees of the Village of Tarrytown hereby approves the terms of the Memorandum of Agreement dated December 29, 2008 for a successor contract to the collective bargaining agreement that expired May 31, 2008 and hereby authorizes the Village Administrator to executor the successor collective bargaining agreement developed in association therewith.

APPROVAL TAX CERTIORARI – 80 SOUTH BROADWAY (A/K/A 74 S. BROADWAY)

Trustee McGovern moved, seconded by Trustee Butler, and unanimously carried that the following be approved:  Approved:  6-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the tax certiorari settlement with 80 South Broadway (a/k/a 74 S. Broadway) as outlined in the Village Attorney’s memorandum dated December 23, 2008.

RESOLUTION – DECLARING THE DATE, POLLING HOURS, DESIGNATED POLLING PLACES AND THE PAY FOR ELECTION INSPECTORS WITH RESPECT TO THE VILLAGE ELECTIONS TO BE HELD ON MARCH 18, 2009
Trustee Butler moved, seconded by Trustee McGee, and unanimously carried that the following be approved:  Approved:  6-0

BE IT RESOLVED that the Village Election shall be held on Wednesday, March 18, 2009, between the hours of 7 a.m. and 9 p.m.

The following Polling Places have been designated:

District No. 1  - Riverside Hose Firehouse, White and Franklin Streets
District No. 2  -        Phenix Hose Firehouse, Mechanics and Central Avenues             
District No. 3          - Main Street Firehouse, 50 Main Street                            
District No. 4  -       First Baptist Church, 56 South Broadway
District No. 5  -       Temple Beth Abraham, 25 Leroy Avenue
District No. 6  -       Tappan Hill School, 50 Ichabod Lane

BE IT FURTHER RESOLVED that the pay for Election Inspectors shall be $200.00 for Election Day. The Chairman in each district shall be paid an additional $25.00 on Election Day.  The hours for which the Election Inspectors shall be paid on Election Day shall be from 6:30 a.m. to 9:30 p.m. for a total of fifteen hours.

BE IT FURTHER RESOLVED that Election Inspectors be appointed to serve on Election Day, Wednesday, March 18, 2009, in accordance with Section 15-116(1) of the Election Law.

BE IT FURTHER RESOLVED that all persons appearing on the permanent Voter
Registration List provided by the Westchester County Board of Elections shall be eligible to vote.  Pursuant to Section 15-118(3) of the Election Law, the Village no longer conducts a local Village registration day;

BE IT FURTHER RESOLVED that the Village offices to be filled on Election Day, Wednesday, March 18, 2009, and the terms of those offices are as follows:

BE IT FURTHER RESOLVED that the Board of Trustees shall hold a Special Meeting on Wednesday, March 18, 2009 at 10:00 p.m. at the Tarrytown Village Hall to canvass the vote of the 2009 Village Election.

BE IT FURTHER RESOLVED that the Board of Trustees request all Election Inspectors vote in their respective, personal designated voting districts and not by absentee vote.

2009 VILLAGE ELECTION – APPOINTMENT OF ELECTION INSPECTORS

Trustee Zollo moved, seconded by Trustee Hoyt that the following be approved. Motion carried, all voting “aye” with exception of Deputy Mayor Basher who abstained.  Approved:  5-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby appoints the following Election Inspectors to sit on Election Day, Wednesday, March 18, 2009:

Trustee Zollo moved, seconded by Trustee McGovern, and unanimously carried that the following be approved:  Approved:  6-0

BE IT RESOLVED that the Board of Trustees does hereby schedule a Public Hearing for the meeting of February 1, 2009, to hear and consider an amendment to the Code of the Village of Tarrytown, Chapter 27, Ethics.

APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD OF TRUSTEES HELD ON JANUARY 5, 2009

Trustee Butler moved, seconded by Trustee McGovern that the following be approved.  Motion carried, all voting “aye” with exception of Deputy Mayor Basher who abstained.  Approved: 5-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the minutes of the regular meeting of the Board of Trustees held on January 5, 2009 as submitted by the Village Clerk.

APPROVAL OF AUDITED VOUCHERS NO. 002760 THROUGH NO. 002913

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the audited vouchers No. 002760 through No. 002913 is hereby ordered paid in the following amounts as presented:

The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 002863 – 002869, 002801, 002853, 002890, and 002891 and Trustee Hoyt who abstained from Voucher Number 002789.   Motion carried.  6-0
