Special Meeting No. 27
February 27, 2008  6:30 p.m.

PRESENT:  Mayor Fixell presiding; Trustees Basher, Butler, Hoyt, McGee, and McGovern; Village Administrator McCabe; Village Engineer McGarvey; and Village Attorney Shumejda

ABSENT:  Trustee Zollo

CONTINUATION OF A PUBLIC HEARING REGARDING THE APPLICATION OF EF EDUCATION FIRST, CONTRACTOR VENDEE FOR THE ACQUISITON OF THE MARYMOUNT/FORDHAM CAMPUS, FOR A COMPATIBLE USE PERMIT (adopted)

Trustee Basher moved, seconded by Trustee Hoyt and unanimously carried that the public hearing be opened.

Mayor Fixell questioned whether anyone wished to address the Board on this matter.  No one appeared.  

Trustee Basher moved, seconded by Trustee McGee, and unanimously carried to close the public hearing.

Trustee Basher moved, seconded by Trustee Butler, and unanimously carried that the following resolution be adopted:  Approved:  6-0

WHEREAS, the Proposed Action is an Unlisted action pursuant to the State Environmental Quality Review Law, and
WHEREAS, an Environmental Assessment Form [EAF] was filed, and
WHEREAS, the application for the Compatible Use Permit was referred to the Planning Board on January 22, 2008, and

WHEREAS, the Planning Board reviewed the application and made a positive recommendation to the Board of Trustees on January 28, 2008

WHEREAS, a notice of public hearing to be held before the Board of Trustees was published in the Journal News on February 1, 2008, and

WHEREAS, public hearings were held for the proposed action on February 4, 19 and 27, 2008, and

WHEREAS, the Board of Trustees of the Village of Tarrytown is the only agency which has approval authority over the Proposed Action, and is therefore the Lead Agency for the Proposed Action, and

WHEREAS, EF Schools, Inc. stipulates that the number of resident students and staff with automobiles shall be limited to the number of available parking spaces on the campus, and

WHEREAS, EF Schools, Inc. stipulates that enrollment will not exceed the maximum allowable pursuant to the New York State Fire Prevention and Building Code, and

WHEREAS, EF Schools, Inc., as a committed member of the Village of Tarrytown community, is desirous of protecting and enhancing the environment and therefore, will contribute $75,000.00 upon the transfer of title to EF Schools, Inc. of the campus, to improve the drainage into the Tarrytown Lakes or for other remediation measures to be determined by the Board of Trustees. EF Schools, Inc., will be informed of project or projects selected by the Board of Trustees, and
        
WHEREAS, EF Schools, Inc. does not have plans for new buildings on the campus, and

WHEREAS, EF Schools, Inc. intends to renovate the buildings on the campus, and

WHEREAS, EF Schools, Inc. intends to restore the landscaping on the campus, and

WHEREAS, EF Schools, Inc. intends to operate a shuttle bus to the downtown and railroad station for students, and

WHEREAS, EF Schools, Inc. will provide around the clock security officers on the campus and the security will have a liaison with the police department, and

WHEREAS, the Compatible Use Permit is subject to the following conditions:

1.      EF Schools, Inc. agrees to the historic designation of  Butler Hall, Gerard Hall and the Science Building pursuant to Chapter 191 of the Village of Tarrytown Code;

2.      EF Schools, Inc. agrees to participate in a Village of Tarrytown citizens review committee to periodically review traffic, parking, security, environmental and other issues at the campus;

3       The Compatible Use Permit is issued to EF Schools, Inc., the property will be used for educational purposes only, the property will be taxed by the Village of Tarrytown as non exempt property pursuant to the New York State Real Property Tax Law, the Compatible Use Permit is non transferable and it will be effective upon the transfer of title to the property to EF Schools, Inc., and

        NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

        1.      In accordance with Article 8 of the State Environmental Conservation Law and 6NYCRR Part 617, including without limitations the criteria set forth in 6 NYCRR Part 617.7(c) and based upon review of the Environmental Assessment Form and all other materials that were prepared for the Proposed Action, the Village Board of Trustees hereby determines that Proposed Action will not have a significant adverse impact on the environment, and hereby adopts a Negative Declaration.

        NOW THEREFORE BE IT FURTHER RESOLVED that the Board of Trustees of the Village of Tarrytown hereby grants a Compatible Use permit for 25 years to EF Schools, Inc. This Compatible Use permit will automatically renew after said period of time unless the Village of Tarrytown finds that EF Schools, Inc. has failed to substantially comply with the requirements of the Tarrytown Zoning Code and the conditions noted herein.

ADJOURNMENT

Trustee Basher moved, seconded by Trustee Hoyt and unanimously carried, that the meeting be adjourned at 7:00 p.m.
