Regular Meeting No. 16
November 5, 2007  8:00 p.m.

PRESENT:  Mayor Fixell presiding; Trustees Basher, Butler, Hoyt, McGee, McGovern, and Zollo; Village Administrator McCabe; Village Treasurer Hart; Recreation Supervisor Arduino; Village Attorney Shumejda; Village Clerk Booth

The meeting began with the Pledge to the Flag.

REPORTS

Mayor Fixell reported on the following:
-       Tomorrow, November 6th is Election Day.
-       Monday, November 12th, the Village will be closed in observance of Veteran’s Day.  There will be no garbage pick up.

Trustee McGee stated that the Warner Library will be closing at 5 p.m. for the next few days until the new heating system is up and working.

Trustee Hoyt reported on the following:
-       The Annual 4-mile Pilgrim Run will take place this Sunday, November 11th at 12 noon at Hackley School.  The fee is $12.00 which includes a t-shirt, refreshments and prizes.
-       The Village Halloween Parade that was held on Saturday, October 27th was a great success.  He thanked everyone who helped to set it up.

Trustee Butler stated that the Tarrytown Lakes Committee Chair, Kathy Knight, has been working with our grant writer, Martin Schneider, to look for grant money to benefit the Tarrytown Lakes.

Michael McGarvey, Village Engineer gave an update on the following construction projects:

Consolidated Engine Firehouse – In the next two weeks, they will be working on finishing the interior wall boards.  This week the windows and overhead door will be installed.  The stucco on the building will start next Monday.

Washington Engine Firehouse – We are looking for completion on this firehouse this month.  The exterior steel stairs and the back patio wall will be finished this week.  The wall taping will be finished this week.  Windows will be installed starting tomorrow.  The underground utilities will be worked on this week.  We will be working on the easement this Wednesday to bring in the water and sewer next to the firehouse. The asphalt and the parking lot will begin this week as well.  The acoustical ceiling will also be done this week.  The elevator which has been delivered will be installed in the next two weeks.  

Village Hall/Police/Court - The brick on the exterior is currently being done.  They are currently forming all the interior walls and are putting in the interior studs for the individual offices.  The electrical, plumbing and HVAC are working expeditiously together.  Trustee Butler asked if the buildings will have an exterior stone marker.  Engineer McGarvey stated that the two firehouses will have an exterior stone marker that reads “2007.”  The Village Hall does not have an exterior marker, but will have a plaque inside the building.

PUBLIC HEARING REGARDING A PROPOSAL TO INCREASE THE QUALIFYING INCOME LEVELS FOR SENIOR CITIZENS PROPTERY TAX EXEMPTIONS, AS AUTHORIZED BY NEW YORK STATE LAW

Trustee Basher moved, seconded by Trustee Hoyt and unanimously carried that the public hearing be opened.
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Tarrytown will hold a public hearing on the 5th day of November, 2007 at 8 p.m. in the Municipal Building, 21 Wildey Street, Tarrytown, New York, to hear and consider the adoption of a resolution to exempt certain real property in the Village of Tarrytown from taxation:

IT IS HEREBY RESOLVED AS FOLLOWS:

1.      Any real property located in the Village of Tarrytown shall be exempt from taxation by the Village to the extent of fifty (50) percent of the assessed valuation thereof, pursuant to Section 467 of the Real Property Tax Law, provided that:

a.  All of the owners of said real property are sixty-five (65) years of age or over,  or where the owners are husband and wife, either the husband or the wife must be sixty-five (65) years of age or over.
7b.  The income of the owner or the combined incomes of all the owners of the property does not exceed the sum of Twenty Seven Thousand Dollars ($27,000) for the twelve consecutive months immediately preceding the date of the application for exemptions.  Where title to the property is vested in either the husband or wife, their combined income may not exceed such sum.  Such income shall include Social Security and retirement benefits, interest dividends, rental income, salary or earnings and income from self-employment, but shall not include gifts of inheritances.  In connection with any application for exemption, applicant shall furnish the Board of Assessors such evidence of the income or combined income as the Board of Assessors may require.

c.  In the event the income exceeds $27,000, the following income schedule shall apply:

d.  The title to the property shall have been vested in the owner or all of the owners of the property for at least twelve (12) consecutive months prior to the date of making application for exemption.

e.  The property is used exclusively for residential purposes.

The real property is the legal residence of and is occupied in whole or in part by the owners or by all of the owners of said property.

2.      Application for such exemption must be made by the owner or all of the owners of the property on forms to be furnished by the Board of Assessors of the Village.  Said applicant shall furnish all the information and shall be executed in the manner required or described in such forms and shall be filed with the Board of Assessors no later than December~17, 2007.

3.      The resolution shall apply only to real estate taxes for the fiscal year commencing June~1, 2008.

4.      This resolution shall allow provisions enacted under Chapter 395 of the laws of 1989 relative to the information provided by applicants that have had an Over 65 Exemption for a minimum of five consecutive years.

All interested parties are invited to attend and be heard.  Access to the meeting room is available to the elderly and the handicapped.  Signing is available for the hearing impaired; request must be made to the Village Clerk at least one week in advance of meeting.

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the public hearing be closed.

Trustee Basher moved, seconded by Trustee Butler, and unanimously carried that the following local law be adopted:   Approved: 7-0

WHEREAS, the Board of Trustees of the Village of Tarrytown hereby adopts the amendment to Article III entitled Citizens Exemption, Section 269-9, authorized by the New York State Section 467 of the Real Property Tax Law that amends the income of the owner or the combined incomes of all the owners of the property does not exceed the sum of Twenty-seven Thousand Dollars ($27,000).  In the event the income exceeds $27,000, the following income schedule shall apply:

WHEREAS, a public hearing was held for the proposed action on November 5, 2007; and

WHEREAS, a notice of public hearing was published in the Journal News on October 19, 2007; and

NOW, THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby adopts Local Law No. 12 of 2007.

Mayor Fixell questioned whether anyone wished to address the Board on any matter.  No one appeared.  

RESOLUTION DESIGNATING OFFICES TO BE FILLED AND TERMS AT THE MARCH 18, 2008 VILLAGE ELECTION

Trustee McGovern moved, seconded by Trustee Butler, and unanimously carried that the following be approved:  Approved:  7-0

WHEREAS,        the next general Village election for officers will be held on Tuesday, March 18, 2008, and

WHEREAS,        the Board of Trustees shall designate by resolution as well as have published the offices which are to be filled at the Village election and the terms thereof.

NOW, THEREFORE BE IT RESOLVED, that the Board of Trustees of the Village of Tarrytown hereby designates the following offices as vacant at the end of the current official year to be filled at the Village election on Tuesday, March 18, 2008,  for the following terms:

BE IT FURTHER RESOLVED that the Village Clerk is hereby directed to publish this information in the official newspaper of the Village.

RESOLUTION – FIRE DEPARTMENT PERSONNEL CHANGES

Trustee McGee moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown approves the following Fire Department personnel changes recommended at the October 16, 2007 Board of Fire Wardens meeting:  Memberships:  Anthony Martin was approved to Active membership in Washington Engine Company; David M. Cappello Jr. was approved to Active membership in Consolidated Engine Company; Bryan Duggan transferred to Consolidated Engine Company.   Preston Goldsmith was dropped from rolls of Consolidated Engine Company and Jay Herighty Jr. resigned as an active member of Consolidated Engine Company.   New Drivers:  Eugene Arduino and Nick Morabito have passed the driver road test for Phenix Hose Company and Craig Allan has passed the driver road test for Conqueror Hook and Ladder Company.

RESOLUTION TO AWARD BID FOR NEW 12” DIAMETER CAPACITY CHIPPER

Trustee Basher moved, seconded by Trustee Hoyt, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the award of a contract to the low bidder, Westchester Tractor, Inc. of Brewster, New York, in the amount of $39,520 for the purchase of a new Bandit Industries with hydraulic winch Model 250 Disc Style, 12” Diameter Capacity Chipper.

RESOLUTION AUTHORIZING VILLAGE ENGINEER MICHAEL J. MCGARVEY, P.E. TO SIGN WESTCHESTER COUNTY HEALTH DEPARTMENT SUBMISSIONS

Trustee Zollo moved, seconded by Trustee McGee, and unanimously carried that the following be approved:  Approved:  7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes Village Engineer Michael J. McGarvey, P.E. to sign all permits, applications, transmittals, and submissions required by Westchester County Department of Health on behalf of the Village of Tarrytown.

APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD OF TRUSTEES HELD ON OCTOBER 15, 2007

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried that the following be approved:   Approved: 7-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the minutes of the regular meeting of the Board of Trustees held on October 15, 2007 as submitted by the Village Clerk.

APPROVAL OF THE MINUTES OF A SPECIAL MEETING OF THE BOARD OF TRUSTEES HELD ON OCTOBER 19, 2007

Trustee Zollo moved, seconded by Trustee McGovern, that the following be approved.  Motion carried, all voting “aye” with exception of Trustees Basher and Butler who abstained.   Approved: 5-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the minutes of the special meeting of the Board of Trustees held on October 19, 2007 as submitted by the Village Clerk.

APPROVAL OF AUDITED VOUCHERS #8

Trustee Basher moved, seconded by Trustee McGovern, and unanimously carried that the following resolution be approved:   

RESOLVED:  The following Abstract bearing No. 8, dated November 5, 2007 containing Vouchers No. 001664 through No. 001884 is hereby ordered paid in the
following amounts as presented:

The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 001800 and 001870 and Trustee Hoyt who abstained from Voucher Numbers 001744, 001768, 001776, 001778, and 001838.  Motion carried 7-0.
