PRESENT:  Mayor Fixell presiding; Trustees Basher, Hoyt, McGee, and Zollo; Administrator Blau; Village Treasurer Hart; Village Attorney Shumejda; Village Clerk Booth

ABSENT:  Trustees Butler and McGovern

The meeting began with the Pledge to the Flag.

REPORTS

Mayor Fixell stated the following:
  • Tomorrow is Election Day – The polls will be open from 6 a.m. – 9 p.m.
  • Thursday, November 11th is Veteran’s Day.  In observance of Veterans Day, the Village Hall will be closed and there will be no garbage pickup on that day.  A Veteran’s Day Service will be held on Thursday, November 11th at 10:30 a.m. at Patriots Park.
  • Friday, November 19th is Third Friday, Main Street & Broadway 5:00-9:00 pm. – It is the last Third Friday of the season and will start up again in April of 2011.
Trustee Hoyt stated the following:
  • Sunday, November 14th is the Annual “Pilgrim Run,” a four-mile road race will be held at the Hackley School, beginning at 12 noon.  All runners should be registered by 11:30 a.m. on the morning of the race.  For more information, contact the Recreation Department at 631-8347.
ADMINISTRATOR’S REPORT

Streetscape on Route 9

The Village of Sleepy Hollow, in collaboration with the Village of Tarrytown, applied for a grant to upgrade the streetscape on Route 9 from Wildey Street, including the C-Town supermarket, north to Gordon Avenue.  The project also includes new wayfaring signage on Route 9 from Route 119 to Route 117.  Westchester County Department of Planning is completing the design for the work.  A joint public information meeting is scheduled for Monday, November 8, 2010 at 7 pm in the Sleepy Hollow Boardroom, 28 Beekman Avenue.  Design plans will be available for inspection and staff will be on hand to answer questions at 6 pm.

Safety Protective Equipment (DPW and Recreation)

The Village has purchased new safety personal protective equipment to all Public Works and Recreation staff members.  The new protective equipment includes:
CLASS II vests
CLASS III vests
CLASS III rain gear – jacket and pants
Work Gloves
Eye protection
Ear protection
Hard hat with winter liners

Sidewalk Replacement Program

At the last meeting, a question was posed regarding the 50-50 sidewalk program and the usage of the program.  During the years 2007 through September 2010, 15 different properties have used the program and slightly over 2,800 square feet of sidewalk has been replaced.  In some instances where the sidewalk has heaved, the Village staff can perform repair work that does not require the replacement of sidewalks.  The program is available to owners of 1 to 3 family residences.  The property owner pays for the material and the Village pays for the labor associated with the new sidewalk.  Anyone interested in participating in the program should contact the Village Engineer’s
Office at 631-3668.  They have a form to complete which starts the process.  The form will be available on our web site.

PESH Investigation

Also at a previous meeting a question was posed regarding the possibility of members of the public participating in the investigation by PESH of the tragic deaths on Labor Day.  I asked the question of the PESH investigator who noted that he does not normally interview anyone other than employers and employees and possibly, should he so decide the family members of employees.  He is permitted to speak to members of the public but he noted that he has no plans to interview members of the public as part of his PESH investigation.

Leaf Collection Process

It is once again leaf season and the Village crews have been out picking up leaves.  The Village law states that “No person shall throw, deposit, sweep or cause the accumulation of leaves upon any streets or sidewalk area”.  The Village is requesting the cooperation of the public to abide by the law regarding the placement of the leaves for collection purposes.  The leaves should remain on your property right next to the curb, but not in the street along the curb.  Leaves placed in the roadway next to the curb hinder the flow of water into the catch basins during the rain.  It also makes for a slippery road surface when it rains.  In addition, the leaves take up needed parking spaces.  Mayor Fixell stated that you can mow mulch your leaves right into your lawn in the fall and by spring the leaves are gone.  Saves a lot of work, saves the Village money and it will improve your lawn.

Water Improvement Projects

The water line replacement in East Sunnyside Lane is complete; however, there are a number of connections that are still required.  The connection of this new water line to the water line on Broadway is being coordinated with the New York State Department of Transportation and should be complete by the end of next week.  This last part of the water line project for East Sunnyside Lane is approximately 50 feet of water line.  Last Thursday the Village received the approval from the Westchester County Department of Health to proceed with the water line replacement on Wilson Park.  The Engineer will be meeting with the contractor performing the water line upgrades throughout the Village to start this part of the project.  According to the engineer, once the project begins, it should take a few weeks to complete.   

PUBLIC HEARING – CHAPTER 225, PEDDLING AND SOLICITING (adopted)

PLEASE TAKE NOTICE that the Board of Trustees of the Village of Tarrytown will hold a public hearing on the 1st day of November, 2010, at 8 PM, in the Municipal Building, One Depot Plaza, Tarrytown, New York 10591, to hear, discuss and to act upon a proposed amendments to Chapter 225 entitled “Peddling and Soliciting” of the Code of the Village of Tarrytown. A summary of the legislation is available at Village Hall. The complete text of this legislation follows:

A LOCAL LAW to amend §225-5 Application for certificate, §225-6 Revocation of certificate and § 225-11 Signs to exclude peddlers and solicitors of Chapter 225 entitled "Peddling and Soliciting” of the Code of the Village of Tarrytown.

SECTION 1.  LEGISLATIVE INTENT AND FINDINGS OF FACT.

A.      Findings of Fact.
The Board of Trustees of the Village of Tarrytown has determined that there are clarifications needed in certain sections of the Chapter to make the law clearer for peddlers and solicitors as well as providing additional protections for residents in regards to peddling and soliciting in the Village.    
B.      Legislative Intent.

It is the intent of the Board of Trustees of the Village of Tarrytown to amend the   language of §225 entitled "Peddlers and Solicitors” of the Code of the Village of Tarrytown by establishing new regulatory language that will assure that the Police Department and residents are aware of who is soliciting in the Village as well clarifying language relating to the revocation of registrations.

SECTION 2. Amendment to §~225-5 Application for certificate of Chapter 225 entitled “Peddlers and Solicitors” of the Code of the Village of Tarrytown.

E.      On or before the date that the person(s) with the certificate of registration commences door to door peddling and/or soliciting in the Village, that person(s) shall first appear at the Village of Tarrytown Police Department and provide a valid photo identification issued by a governmental agency.  The Police Department shall perform identification verification through the New York State Police Information Network.  Should the identification verification provide information to the Police Department that past actions of the person(s) seeking to peddle and/or solicit door to door in the Village pose a concern to the Police Department, that person(s) shall not be permitted to peddle and/or solicit door to door in the Village.  There shall be no appeal of the decision of the Police Department.  Should the person(s) seeking to peddle and/or solicit door to door in the Village not have a valid photo identification issued by a governmental agency, that person(s) shall not be permitted to peddle or solicit door to door.  Should the person(s) seeking to peddle and/or solicit door to door be approved for such peddling and/or soliciting by the Police Department, the photo identification shall be copied onto a license form to be supplied by the Police Department.  This form shall be carried by the peddler or solicitor and used as identification and evidence that the person(s) may peddle and/or solicit in the Village should the peddler and solicitor be questioned by a resident.  The peddler and solicitor shall inform the Police Department of the day(s) that the peddler and solicitor intend to peddle and solicit in the Village.      

F.      The following list of information shall be provided to the Police Department for all vehicles to be used by the peddler and solicitor:

SECTION 3. Amendment to §~225-6 Revocation of certificate of Chapter 225 entitled “Peddlers and Solicitors” of the Code of the Village of Tarrytown.

A.      Any certificate of registration issued hereunder shall be revoked by the Village Clerk if the holder of the certificate is convicted of a violation of any of the provisions of this chapter or has made a false material statement in the application or otherwise becomes disqualified for the issuance of a certificate of registration under the terms of this chapter.  Any certificate of registration issued hereunder shall be revoked by the Village Clerk if the Village receives three (3) verified complaints regarding improper actions of the holder of the certificate.  In the case of a door to door solicitor or peddler, a verified complaint shall include a complaint from a resident that the solicitor or peddler contacted a household with a sign excluding peddlers and solicitors, as included in Section 11 hereinbelow.   Immediately upon such revocation, written notice thereof shall be given by the Village Clerk to the holder of the certificate in person or by certified United States mail addressed to his or her residence set forth in the application.  

SECTION 4. Amendment to §~225-11 Signs to exclude peddlers and solicitors of Chapter 225 entitled “Peddlers and Solicitors” of the Code of the Village of Tarrytown.

D.      The Village Clerk shall maintain a listing of premises where a sign to exclude peddlers and solicitors has been placed.  The list shall be provided to all persons obtaining a certificate of registration.         

SECTION 5.  Amendment to §~225-16, Revocation of registration of Chapter 225 entitled “Peddlers and Solicitors” of the Code of the Village of Tarrytown.

B.      A notice of hearing for revocation of a registration shall be given, in writing, setting forth specifically the grounds of the complaint and the time and place of the hearing. Such notice shall be mailed to the registered person at his last known address at least five days prior to the date set for the hearing.  The revocation of registration shall only extend to the end of the fiscal year in which the registration was issued.    

SECTION 6. Amendment to §~225-17, Appeals from denial or revocation of certificate of Chapter 225 entitled “Peddlers and Solicitors” of the Code of the Village of Tarrytown.

Any person aggrieved by the action of the Village Clerk in the denial or revocation of a certificate shall have the right of appeal to the Police Committee (Board of Trustees). Such appeal shall be taken by filing with the Board, within 10 days after the notice of revocation or denial is mailed or served, whichever is shorter, a written statement setting forth fully the grounds for appeal. The Police Committee (Board of Trustees) shall set a time and place for a hearing of such appeal, and notice of such hearing shall be forwarded to said person at his last known residence, as indicated in his application, by mailing such notice by first class mail at least five days prior to the hearing. The decision of the Police Committee (Board) shall be final and conclusive.    

SECTION 7.  EFFECTIVE DATE

This local law shall take effect immediately, as provided by law.

All interested parties are invited to attend and be heard.  Access to the meeting room is available to the elderly and the handicapped.  Signing is available for the hearing-impaired; a request must be made to the Village Clerk at least five days in advance of the meeting.

Trustee Basher moved, seconded by Trustee McGee, and unanimously carried, that the hearing be opened.

Lori Semeraro, 205 Martling Avenue, stated that applicants would be run through the NCIC system for any open warrants or missing persons, but it won’t say if they were convicted of a felony.  Attorney Shumejda stated that the Police Department cannot ask for fingerprint or do research on everyone and is limited by the law of the State of New York.  Mayor Fixell stated that we will move forward with this amendment, but we will ask our attorney and the Chief of Police to respond to Ms. Semeraro’s specific question and we can re-address it.

Alison Boldyrev, 63 Embree Street, stated that if someone was convicted of a crime, she assumes that if they are out soliciting, they have done their time and paid their dues to society.  It isn’t fair to restrict people who are trying to get ahead and making a living.  If she is worried about something, she can choose not to answer her door.  Mayor Fixell stated that residents can be put on the Village’s “Do Not Solicit” list as well.  

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the hearing be closed.

Trustee Zollo moved, seconded by Trustee Basher, and unanimously carried, that the following resolution be approved:  Approved: 5-0

WHEREAS, the Board of Trustees of the Village of Tarrytown does hereby amend the Code of the Village of Tarrytown, Chapter 225, Peddling and Soliciting to establish new regulatory language that will assure that the Police Department and residents are aware of who is soliciting in the Village as well as clarifying language relating to the revocation of registrations.

WHEREAS, a public hearing was held for the proposed action on November 1, 2010; and

WHEREAS, a notice of public hearing was published in the Journal News on October 22, 2010; and

WHEREAS, the Board of Trustees of the Village of Tarrytown is the only agency which has approval authority over the Proposed Action, and is therefore the Lead Agency for the Proposed Action

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

In accordance with Article 8 of the State Environmental Conservation Law and 6NYCRR Part 617, including without limitations the criteria set forth in 6 NYCRR Part 617.7(c) and based upon review of the Environmental Assessment Form and all other materials that were prepared for the Proposed Action, the Village Board of Trustees hereby determines that Proposed Action will not have a significant adverse impact on the environment, and hereby adopts a Negative Declaration.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Board of Trustees of the Village of Tarrytown hereby adopts Local Law No. 17 of 2010.

OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE BOARD.  SPEAKERS HAVE FIVE (5) MINUTES BEFORE YIELDING TO THE NEXT SPEAKER; THEN THREE (3) MINUTES FOR ADDITIONAL COMMENTS

Emilia Kelly, Church Street, stated the following:
  • What is the Village’s policy about putting signs on people’s lawn?  Mayor Fixell stated that a resident can put a sign on his/her lawn, but people cannot put signs on private or public property.
  • At the last Board meeting, she asked why it wasn’t mentioned that the trees in the park were donated and are memorial trees.  She noticed that all the tree plaques were removed, but found out later that they were removed to be cleaned.  She stated that she was not informed about any of this.  Administrator Blau stated that once the RiverWalk and Pierson Park are complete, we will be reaching out to all the people who donated memorial trees to pick a new tree and we will reset the plaques and rededicate all the memorial trees.
  • She is not in favor of fencing around the playground at Pierson Park; she likes the feel of an open park.  Mayor Fixell stated that they are still discussing this with the Park Design Committee and the Recreation Council.  
Steve Wilgermein, 330 S. Broadway stated the following:
  • He is glad that the Village purchased all the safety equipment.  He asked if there is any new training for DPW scheduled with the CSEA?  Administrator Blau stated that we received the Pro Safety contract in the mail today.  The training will include confined space entry, hazards and general safety.  The CSEA will also be conducting general safety programs.  We are planning on additional training on backhoes and front-end loaders.  
  • He asked if the Police Department and TVAC will be included in this training contract.  Administrator Blau stated that DPW, Recreation and the Fire Department were included in the original contract.  We told Pro Safety that we want to include the Police and TVAC and asked for a price to include both; we have not received that yet.  We will ask TVAC if they
want to participate in this training.
  • Is the Village interested in ISO Certification for DPW?   It’s a terrific environmental management tool.  It regulates all waste and recyclables.  The First Environment is the company who ran the program for the County.  Administrator Blau stated that he will check this out and get the information for the Board.
  • He stated that he has been critical of Administrator’s Blau’s action that night, it is nothing personal, his is not upset with Administrator Blau; it is what he said that night.
Sharon Callahan, Tarrytown resident, stated that she has been running the Boot Camp program for two years without a complaint or a problem.  Two years ago, she brought the idea to the Recreation Supervisor and received approval
by the Recreation Council.  It is an hour exercise program that starts at 5:30 a.m. at Patriot’s Park.   She pays a monthly rent to the Village and she has insurance.  She heard that the boot camp program was brought up at the last
meeting and was again discussed at the last work session by the Patch web site and would have appreciated it if someone had reached out to her.  Mayor Fixell stated that it was brought to our attention that the park lights were going
on very early in the morning and that a Boot Camp program was being held at 5:30 a.m.; which wasn’t designed with neighbors in mind because there weren’t neighbors two years ago.  Since it has been raised, it is something that we
are looking at.  No decisions have been made.  Trustee Zollo stated that the Board is in favor of exercise and boot camp, but has to figure out how it should be structured in terms of the relationship with the Village.   For example, in
our Village Code, our parks open at sunrise and close at sunset.  Trustee Basher stated that we could structure the program as a Recreation Program, whereby the Village hires you and the fees would go to the Recreation Department.  
Then it would be a recreation program, and we would then be allowed to have the lights on outside the parameter of the law.  Mayor Fixell stated that we will look into this, not necessary to change anything, but maybe change the
structure or perhaps change the Village law to allow a program like this.

Mary E Kohrherr, 48 Benedict Avenue and member of the Boot Camp program, stated that as a tax payer, it is really nice to use those facilities.  As a working mother, 5:30 a.m. is the only time we can fit it in our schedule.  She hopes the
Board will consider this when you do make a decision.

Melissa Campbell, 13 Storm Street, stated she is in support of the Boot Camp program.

Jeanne Cancro, 18 Short Street, stated that the boot camp program has been going on for two years with no problems and all of a sudden it is being questioned.  Trustee Zollo stated that it has been brought to the board’s attention
that it may be disturbing residents who live there and we have to look at it.  We didn’t say that we were against it, we didn’t ask you not to do it and we are going to find a way to make it work.  Ms. Cancro stated that it was poorly
handled.  When it was brought up, someone should have contacted Sharon Callahan, who runs the program.  Administrator Blau stated that when it was brought up, he went to the Recreation Supervisor to find out about the
program.  He received the information today and has not discussed it with the Board yet.  Ms. Cancro stated that at the end of the day she hopes that it all can be worked out with the residents of Hudson Harbor and with the Boot
Camp members.  It’s a great program.

Susan Vacca, 300 S. Broadway, stated that she is in support of the boot camp.  As a busy working mom, this is a great program early in the morning that she can participate in.  She believes that we should be promoting women’s
health.  She feels that the board should be more diplomatic at work sessions.  She thought the comments on Patch were accusatory.  Mayor Fixell stated that Ms. Vacca makes a very good point and that work sessions are open to the
public and the media is there taking notes and reports are summarized and can be taken out of context.  

Trustee Basher stated that this past weekend the Fire Department had a dedication of the Tarrytown Fire Boat in honor of John Kelly, which is a wonderful honor.  Unfortunately, the Mayor, the Board and the Administrator were not
made aware of it and, therefore, did not know that it was being done.  Fire Chief Saracelli stated that the Fire Department renamed the Fire Boat 5 to Chief John Kelly.  The Fire Department wanted a very private ceremony between the
Fire Department and the families.  Nobody was invited outside of the Fire Department.  It was a very small, solemn ceremony to honor John Kelly, who was instrumental in getting the fire boat up and running back in 1986 - 1987.  
Trustee Basher wanted to make sure the record was straight so members of the Fire Department and the public know that the Board was not invited.

Mary Brady, 97 Sunnyside Avenue, stated that she read on Patch that the Board wanted to eliminate the parking between Irving and Marymount Avenue, opposite the Fordham building.  Ms. Brady stated that these parking spaces
are utilized daily.  She appreciates the Board to look at it again.  Trustee Zollo stated that they were under the impression that those parking spots were underutilized, but we can certainly look at it again.

Trustee Zollo commented that the Board’s work sessions have always been open to the public, but only for the past six months, the media has been recording them.  Work sessions is where the Board sits down and does the business
of 12,000 people.  This is a new phenomenon whereby the Board’s casual conversations are now being recorded.

Lori Semeraro, 205 Martling Avenue, asked the following:
  • Why the Board did not know about the Boot Camp program.  Mayor Fixell stated that the Recreation Council has autonomy to approve recreation programs that need not go before the Board of Trustees.
  • Is it true that the Village owns the sidewalks, but we designate the residents to maintain them?  Administrator Blau stated that the State allows local municipalities the right to make the responsibility for maintaining and repairing sidewalks to the local property owners, even though the Village owns them.
  • Is there a line item in the budget for the 50/50 sidewalk program.  Treasurer Hart stated that there is a line item in the budget for when the concrete is bought and it is appropriated every year.
  • Was her grant folder given to the grant writer?  Administrator Blau stated that it was given to the grant writer and he is working on it and shortly Administrator Blau will be able to provide a response.
  • Have we received the information from George regarding the video equipment?  Administrator Blau stated that he has to have another meeting with Mike and George.
  • While the Transportation Council is going around seeing what needs to be pruned away from sidewalks, can’t they make note of defects in the sidewalk?  Trustee Basher stated that the Transportation Council are volunteers who drive around to make sure that street and traffic signs are not blocked by trees or shrubs, parking situations and traffic lights; they are not looking at sidewalks.   Administrator Blau stated that the Transportation Council looks at locations where shrubberies and/or trees are blocking signs and creating sight-line problems.
  • Do we have an update on the gap analysis program?  Administrator Blau stated that he gave the departments to the middle of the month.
Emilia Kelly, Church Street, stated the following:
  • In February, 2010, Church Street had a sewage line break that caused sewage to go onto her driveway and garage.   She learned from her neighbor that someone had replaced the tiles on her walkway.  Ms. Kelly just had her driveway repaved and wanted to know who she can contact.  Administrator Blau stated that he can give her a contact at the Westchester County Department of Environmental Facililities.
  • About a month ago, there was a helicopter flying very low with a spot light shining down in her neighborhood.  Police Officers were there and it was very scary.   Sean Roach from Patch stated that they were looking for a mugger wearing a gorilla mask.
Patrick Derivan, Franklin Courts, asked the following:
  • Have the OSHA and PESH reports come back yet.  Administrator Blau stated that when the PESH report is complete, it has to go to Albany to be reviewed.   It is the intent of the Village to make it public when we receive it.  However, they have not told us when that would be.  
  • Does the Board have any plans to honor Anthony Ruggiero, a long time Village Foreman in DPW, possibly renaming the DPW center, “the Anthony Ruggiero Jr. DPW Center?”  Mayor Fixell stated that it is a good suggestion and the Board will discuss it.
  • He asked if there was any reason why work sessions are held upstairs where it is a little small and not much seating and not held in the board room.  Mayor Fixell stated that it would be difficult to conduct the work session sitting in a line as opposed to sitting around a table.  Work sessions are open to the public and there is seating available.  If there are too many people, we can move the meeting downstairs, as we have in the past.
  • In 2008, the Village was interested in hiring a Fire Inspector, what became of that part-time position.  Mayor Fixell stated that due to budget issues, we have not hired a separate Fire Inspector.  That position is being conducted by the Village Engineer and the Assistant Village Engineer.  If, in fact, the job can’t be done, it will be looked at.  Trustee Zollo stated that it will be a year in December and we will review the records to see if the Building Department has fulfilled their obligation.  If not, we will hire a part-time Fire
Inspector.

Michael Coffey, 100 MacArthur Lane, asked for an update on fencing at Patriot’s Park.  Mayor Fixell stated that the Board is looking into fencing around the play area.  We are looking at different fencing options and the cost
involved.  Mr. Coffey stated that there is a law that says you need to have it.  Mayor Fixell stated that in fact, there isn’t a law.  Administrator Blau stated that he downloaded two large books on safety recommendations for parks and
there is nothing in there on fencing.  If somebody has it in writing, he will be happy to research it further.  Mr. Coffey stated that the Board said that it would be done last spring. Mayor Fixell stated that we did not say it would be
done last spring.   We have had meetings and made changes to stop the traffic in the park and we have fenced in from Broadway. The answer is that we have not yet made a decision, we are leaning toward doing so and we are
exploring options for fencing in that park.  Mr. Coffey asked if the Village just spent over $600,000 on open space at Wilson Park.  Mayor Fixell stated as we had planned on doing 4 or 5 years ago, as part of the Wilson Park
Development, we are purchasing the 14 acres in Wilson Park to provide open space for Village residents and available park land.  

Steve Wilgermein, 330 S. Broadway, stated about a month ago, he brought up the idea of a task force, has that been considered.  Mayor Fixell stated that it has been discussed, but a decision has not been made yet. The Board wants
the staff to meet with the consultants first and discuss the task force idea with them and see how we can structure it and, if it makes sense, put it into place.

AGREEMENT WITH WESTCHESTER COUNTY – CONNECTION TO DELAWARE AQUEDUCT

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 5-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes and directs the Village Administrator to execute an agreement with Westchester County associated with the development of a connection to the Delaware Aqueduct to serve as a backup potable water source to the Catskill Aqueduct.

AMENDMENT TO PIERSON PARK REHABILITATION PROJECT

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 5-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes and directs the Village Administrator to execute an amendment to the agreement between the New York State Department of State and the Village of Tarrytown relating to the Pierson Park Rehabilitation Project, which will allow grant funds to be used in Losee Park in association with the creation of a kayak launch.

PROFESSIONAL SERVICES FOR ANDRE BROOK RESTORATION

Trustee Zollo moved, seconded by Trustee Hoyt, and unanimously carried, that the following resolution be approved:  Approved: 5-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes and directs the Village Administrator to execute an agreement with RGR Landscape, PLLC to provide professional design services for the restoration project for that portion of Andre Brook located between Pierson Park and the commuter parking lot.

RESOLUTION DESIGNATING OFFICES TO BE FILLED AND TERMS AT THE MARCH 15,  2011 VILLAGE ELECTION

Trustee Basher moved, seconded by Trustee McGee, and unanimously carried, that the following resolution be approved:  Approved: 5-0

WHEREAS, the next general Village election for officers will be held on Tuesday, March 15, 2011, and

WHEREAS, the Board of Trustees shall designate by resolution as well as have published the offices which are to be filled at the Village election and the terms thereof.

NOW, THEREFORE BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby designates the following offices as vacant at the end of the current official year to be filled at the Village election on Tuesday,
March 15, 2011, for the following terms:

                Mayor                   Two-year term
                Trustees (3)                    Two-year term each
                Village Justice         Four-year term
                        
BE IT FURTHER RESOLVED that the Village Clerk is hereby directed to publish this information in the official newspaper of the Village.

APPOINTMENT TO THE PARKS AND RECREATION ADVISORY COUNCIL – ALISON BOLDYREV

Trustee Hoyt moved, seconded by Trustee Basher, and unanimously carried, that the following resolution be approved:  Approved: 5-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby appoints Alison Boldyrev as a member of Parks and Recreation Advisory Council for a term to expire in April of 2015.

RESOLUTION – FIRE DEPARTMENT MEMBERSHIP CHANGES

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 5-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the following Fire Department membership changes recommended at the October 19, 2010 Board of Fire Wardens meeting:   Membership:  Jimmy Bender was approved for active membership in Riverside Engine Company.

APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD OF TRUSTEES HELD ON OCTOBER 18, 2010

Trustee McGee moved, seconded by Trustee Zollo, that the following be approved.  Motion carried, all voting “aye” with the exception of Trustee Basher who abstained. Approved: 4-0-1

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the minutes of the regular meeting of the Board of Trustees held on October 18, 2010 as submitted by the Village Clerk.

APPROVAL OF THE MINUTES OF THE SPECIAL MEETING OF THE BOARD OF TRUSTEES HELD ON OCTOBER 27, 2010

Trustee Basher moved, seconded by Trustee McGee, and unanimously carried, that the following resolution be approved:  Approved: 5-0

BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the minutes of the special meeting of the Board of Trustees held on October 27, 2010 as submitted by the Village Administrator.

APPROVAL OF AUDITED VOUCHERS NO. 001485 THROUGH NO. 001642

Trustee Basher moved, seconded by Trustee Zollo, and unanimously carried, that the following resolution be approved:  Approved: 5-0

BE IT RESOLVED the Board of Trustees hereby approves the Audited Vouchers No. 001485 through No. 001642 is hereby ordered paid in the following amounts as amended:

        The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 001610 and 001611 and Trustee Hoyt who abstained from Voucher Number 001493.  Motion carried.  5-0
