APPROVAL OF THE MINTUES – November 14, 2011 Joint Board of Trustees/Planning Board Meeting and November 28, 2011 Planning Board Meeting

Mr. Aukland moved, seconded by Mr. Birgy, and unanimously carried, that the minutes of the November 14, 2011 joint Board of Trustees/Planning Board meeting be approved as submitted.  Motion carried.

Mr. Aukland moved, seconded by Mr. Birgy, and unanimously carried, that the minutes of the November 28, 2011 meeting be approved as submitted.  Motion carried.

CONTINUATION OF PUBLIC HEARING – HAS-UWC – Jardim Estates East - Subdivision – Browning Lane

No one appeared to address the Board on this matter.  The Board unanimously agreed to continue the hearing at their January 2012 meeting.

NEW PUBLIC HEARING – Toll Brothers – Wilson Park Drive

The certified mailings receipts were received and the sign was posted.

The Chairman read the following Notice of Public Hearing:

To consider a site plan amendment to extend dry-stacked walls with matching stone pillars along County House Road, and to construct a parking area and potential future mailbox station area across from Lot 9 of the Wilson Park Subdivision in the Village of Tarrytown.

The property is shown on the Tax Maps of the Village of Tarrytown as Sheet 001.010, Block 001, Lots 030.009 and 030.018.C and is located in an R-80 (Residential) Zone.

Documents are available for inspection in the Planning and Zoning Office.  All interested parties are invited to attend and be heard.  Access to the meeting room is available to the elderly and the handicapped.  Signing is available for the hearing-impaired; request must be made to the Village Clerk at least one week in advance of the meeting.

Mr. Shumejda stated that there was a problem with the public hearing notice and suggested that the meeting proceed as scheduled and that it be re-noticed and rescheduled for the January 23, 2012 meeting.

Chris Badger of Toll Brother provided a modified plan.  He reported that that the post office has agreed to curbside mail delivery to each home so there is no need for a gang box.  He also presented a plan for a temporary parking area as suggested at the last Planning Board meeting.  They are now proposing a temporary gravel parking area with 5 spaces in the open space across from the model home to accommodate overflow parking for the model home.

They have also revised the plan to eliminate the continuation of the stone wall along Lot 9 portion of Tower Hill Road because it would encroach on the sightline triangle.  Mr. Friedlander asked how high the wall was.  Mr. Badger said it's about 32" high.  Mr. Aukland asked if they could lower the wall so that it would not interfere with the sightline.  Mr. Badger said they were dead ending it at a pillar which is 48" tall which is too high for the sightline.  They are continuing the wall along the open space area.  It will appear to be a dry-stacked stone wall but there will be mortar involved to ensure that it will not fall into disrepair.

Mr. Friedlander asked the length of the wall and Mr. Badger responded that it is 51' long with a radius of 21’. Mr. Friedlander asked what is at the end of the wall. Mr. Badger said there is an existing stone wall.  Mr. Birgy asked if that wall is in good condition. Mr. Badger said they would probably want restack a lot of the stones to make it level with the new wall.  Mr. Birgy asked if it would also be mortared; Mr. Badger said yes, it would be.  
Mr. Birgy asked if he thought it would look like something was missing along the Lot 9.  Mr. Badger said the landscaping on the model home will tie it all together.
   
Mr. Tedesco asked what the signage on the pillar will say.  Mr. Badger said it will just say Wilson Park Drive on a bronze plaque.  Mr. Birgy stated that some of the residents did not like the idea of the bronze plaque.

Mr. Tedesco asked about the easement in the open space.  Mr. Badger said there is no easement in that space.  The Lakes Committee has not provided them with a plan yet; so what is shown is only conceptual.  Mr. Tedesco stated that it would be wise to consider the possible placement of the easement to be sure that the parking is off the trail area.

Mr. Birgy asked if they will be making it a permanent parking area as discussed earlier.  Mr. Badger said once they are provided a layout of the trail, the can build upon the temporary parking area and make it permanent with Belgium Blocks or whatever surface they would like; but right now they are requesting a temporary parking area.

Mr. Friedlander asked why they chose that spot right in the middle, why didn't they move it closer to the wall to conceal it some.  Mr. Badger stated that based upon the comprehensive trail plan, they conceptually showed the trail coming through the back of this space.  They also wanted to keep it as far away from the intersection of Tower Hill Road for safety reasons and to make it more accessible from Tower Hill Road.  He also stated that there is a large tree which they wanted to preserve.

Mr. Friedlander said he thought that they would prefer the parking tucked in behind the wall because it will be more appealing when they go to sell the model home.  Mr. Badger said they are open to that plan.  Mr. Friedlander asked if they would be amenable to making it permanent parking for the Village.  Mr. Badger said they would.  
Mr. Friedlander said he would like to see choices for the parking area presented to the public.

Mr. Aukland asked if the connection to the trail could be shown on the plan.  Mr. Badger said it could be drawn up.

Mr. McGarvey asked how long they planned on having the house on lot 9 as the model home.  Mr. Badger said it’s hard to tell because it depends upon the sales, which are going very well right now.  He thought probably a year.  

Mr. McGarvey asked if their contractor could relocate the existing wall, which is presently on the west side of Parcel C, onto the Village property line and make it look similar to the new wall.  Mr. Badger said he thought it was built by the property owner next to that parcel.  Mr. McGarvey stated that according to the Agreement, this piece of property was to be turned over to the Village six months after the start of the utility project, which has now been completed and that six months has been exceeded.  Therefore you will actually be using Village property for your project.  Mr. McGarvey said what he is asking is in lieu of rent for the use of Village property (the parking lot), can Toll Brothers rebuild that wall and make it look similar to the other wall for the Village.  Mr. Badger said he will take a look at it and get back to him.

Mr. Friedlander stated that during the field trip he was concerned about the field and the soil testing.  The approvals said the field would be done as part of the infrastructure improvements, which are complete.  The field is a disaster waiting to happen because of issues regarding the drainage, grading, soils, and positioning of the field.  To date they have not even provided us with the soil testing.  It is a very important public amenity, especially for the children of this community.  Mr. Badger said they are aware that there is more work to be done and they are not representing this field as a finished product.  They would like to revisit it in the spring and finish the work properly.  Mr. Friedlander said it is important that this be done properly.

Mr. Birgy stated that there is a water problem on the field, coming from many different directions, which has not been addressed. This is a very large concern and we need to hear specifics as to how you plan to correct that field to make it usable.  Mr. Badger said he understands their concerns; and they do want to prevent water from getting on that field, but they are asking for the time to evaluate it and do it in the spring.
 
Mr. Friedlander said we did not have to give you permission to build the model house until the field was done because the field is part of the infrastructure.  We were expecting a similar due diligence on this field, which you did not do.  If the field is not done properly, this project will not be moving forward.  Mr. Badger said they understand how important this field is to the Village and he would like the opportunity to do it right and finish it up in the spring.

Mr. Birgy stated that they did not test the soil they brought onto that field.  Mr. Badger said all of the soil brought onto the field was on-site soil.  Mr. Birgy questioned that they did not truck in any soil.  Mr. Badger stated, and Mr. McGarvey confirmed, that no soil was trucked in; that all of the soil was brought over to the field from other locations on the Wilson Park site.

Mr. Friedlander stated that all we are saying is why didn’t you test the soil.  You would have tested it for any other site.  Without testing the soil you do not know what you put on that field.  He stated that 24 hours after a rain fall, the field should be able to be used and that is what we expect.  If that does not happen, the project will not be moving forward.  Mr. Badger said he understands that the project will not move forward in the absence of a good drainage plan for the field.

Mr. Birgy stated that they would not be having this conversation now if, in June, they did what was expected of them.  Mr. Badger apologized and said in the spring they will get on it, address the drainage issues, and complete the field.

Mr. Friedlander said we are questioning your credibility because when we asked for the soil testing to be done last month, it was not done.  We want your project to succeed but not at the expense of the residents.

Mr. McGarvey asked Mr. Badger to briefly tell us what the engineers who looked at the field said.  Mr. Badger said they were concerned with the water coming onto the field and on the high side coming onto the field.

Mr. McGarvey stated that the longer that water sits there the more that soil will absorb it. It will takes months to dry it out.  If you can get some laborers down there, no heavy machinery, to get the water to run so that it is not sitting there all winter, you will get a head start in the spring.

Mr. Birgy read a note from the preliminary findings that states that the trails must be kept safe and clear of debris.  Mr. Badger asked where that refers to.  Mr. Birgy said the property that you purchased (4 parcels) which contain trails; those trails have not been cleared.  Mr. Badger stated that they will take care of that in the next few weeks.

Mr. Tedesco stated that they must become more proactive on things other than the sale of the individual homes.  He is going to hold them responsible for the following three things:  All subdivision conditions, findings conditions, Lakes Committee concerns.

Mr. Friedlander allowed the public to speak briefly on their concerns.

Yoram Gelman, 91 Cobb Lane, stated his concern is when exiting Wilson Park Drive onto Tower Hill Road you cannot see the traffic from Sleepy Hollow.  The wall and shrubby will add to the problem.

Mr. McGarvey said the Village speed limit is 30 mph and the National Traffic recommendation is 200' site distance.

Mr. Gelman, said that that is not happening.  The cars are going faster than 30 mph and it is extremely difficult to exit onto Tower Hill Road.

Mr. Badger said the wall is entirely out of the site line.

Jerome Fine, 25 Highland Avenue, stated that ground water stays relative constant and it's clean.  Rain water starts out then gets high and moves everything with it.  He was out to the site a few times and the upper right hand corner of the field has a 15" pipe which is running about 1/3 full constantly - no question it is ground water coming through.  The size of the pond was designed so that the bigger the flow the larger the pond has to be; and if that pond was not designed with ground water calculations included, then it’s inappropriate.  We are looking to upgrade the quality of the water eventually; and it should be a consideration to take the ground water, without mixing it with the storm water, and getting it into the lake.

Francesca Spinner, Wilson Park Drive, stated that the landscapers have just recently added shrubby on top of the existing wall on the lake side which adds to the problem of exiting onto Tower Hill Road.  She does not have a problem with a very low wall, but even just the couple of boulders that are there now affect the site/distance to exit onto Tower Hill Road.  She has no objection to a pillar, but suggested that the pillar be away from the intersection.  She said they should look at the site line from a car, which is different from a truck.

Joseph Queenan, 206 Wilson Park Drive, stated that nobody goes 30 mph because it is a very steep hill and you are already accelerating to get up the hill.  It's not policed.  People in cars, who sit low, have a greater problem than those in trucks or vans.  He suggested that the board go up and look at it in a car.

Kathy Ruland, 17 Walden Road, stated the she is a Tarrytown resident, Chair of the Lakes Committee; Coach for the AYSO Association; and with the EF students, that field could be used 24 hours a day.  It will be used a lot and it has to be a turf field.  Also, the people moving into the beautiful new homes will want a nice field.

Mark Fry, Sleepy Hollow, stated that the Village Board of Trustees hired Dvirak Bartilucci for a stormwater plan, and those plans were not carried out which were required to be carried out as part of the findings.  He walked the site with 3-4 engineers regarding the drainage of the field.  Mr. DiGiorgio, Dvirak Bartilucci's engineer, said the field has to be completely designed from the ground up (soil tests) and re-engineered by a third party.  Mr. Shumejda asked if we have funding.  Yes, we do; in your Code, Section 263 in the Zoning Code it states that whenever you have drainage or erosion projects, we can hire engineers.  He spoke with Stephen Yarabek who said we have received the trail grant.  Mr. Yarabek took a look at the site and has agreed to meet with the Village Engineer and the Toll Brothers Engineer.  He sees no reason why we have to wait until the spring to get the re-design of that field.

CONTINUATION OF A PRELIMINARY PRESENTATION - Greystone-on-Hudson - 612 South Broadway

Mr. Todd spoke about the exiting eastern-most road which runs by the Coppola property and down to the Roundabend cul-de-sac.  This road is the Coppola’s main roadway from South Broadway to their house.  It is also used by the Village of Tarrytown to access their water tower and by the Tarrytown Police for access to their repeater tower at the water tower.  It is used for an emergency access for the Nigerian Embassy and for the 109 homes in Tarryhill through the Roundabend cul-de-sac, as well as for access to the Coppola carriage house.  Currently it is a one-way road that is 12' wide in some places and 10' wide in others.  There is two-way traffic traveling on the road all the time with two very dangerous blind spots.  Mr. Todd read a letter from John Canning, traffic engineer (copy attached) which spelled out the deficiencies and dangers of the existing road.

Mr. Todd explained the reasons they felt it is right for the Greystone development to use the road.

•       They are bringing the road along the northerly side and miss all of the houses down along Tarryhill road except for the Radlauer and Weidler houses because of the topography in the area.  
•       They will be able to minimize the amount of steep slopes by building a 5' high wall which allows them to take the roadway away from the Weidler's house, giving them more of a buffer, and it allows for a 22'          wide road.  There will be a swale on the opposite side of the wall which will keep the water from coming onto the road.  It will allow for a 35' right-a-way and reduce the steep slopes by about 500', down to about   2,200' of disturbance.  The wall allows the road to be a straight shoot which makes it safer.  Mr. Todd showed several other sites in the Village with similar walls with 25% slope going up.

Mr. McGarvey asked how the wall helps the steep slopes.  Mr. Todd said it will allow them to put a swale on the opposite side of the wall which will keep the water off the road.

Benefits for the Village of Tarrytown

•       On Page 2-14 under the heading "Taxter Ridge Park and Esposito Parcel" the Comprehensive Plan states the following:  "...Tarrytown is concerned with the development of a parcel located in the Town of                 Greenburgh, which is enclosed by the Taxter Ridge property. This parcel, known as the Esposito parcel, comprises approximately 55 acres. It is currently zoned as CD R-40 -Conservation District R-40. This     property could potentially yield a maximum of 60 dwellings, under its current zoning. In the interests of conserving environmentally sensitive land, Tarrytown will continue to petition the Town of Greenburgh to      upzone this property to a lower density zone, such as an R-60 zone.  Within the Village, there are two properties located near the Taxter Ridge Preserve which the Village wishes to acquire; the Esposito and     Unification Church properties. The Village will continue to pursue the acquisition of these parcels.”  Greenburgh only 12 homes are being built where 60 can be built - up-zoning the property to R80.  Twenty-two      acres are being donated rather than the Village buying property.  Fifteen houses are allowed on the Tarrytown property where only 8 are being built; where 75 parcels are allowed to be developed, only 20 are          being developed.
•       They are going to improve a very dangerous road which is used by the Village trucks and Village police.
•       If the Greenburgh section is not built because they have no access, they will not donate the 22 acres of parkland and they would be forced to fence off their property because of the potential liability.  This                fencing would cut off the access to Taxter Ridge Park from Tarrytown.
•       The development will bring in about $300,000 worth of tax revenue to Tarrytown; however, without the Greenburgh development, Tarrytown would get about ½ that amount of revenue because the development         would not be as great a development.
•       The present rate of stormwater runoff down to Gracemere will be reduced by approximately 27% and the volume by 6%.  This is a great benefit to the Gracemere residents.
•       The Irvington School District will received 1.7 million dollars worth of tax benefit from both developments.  Approximately 25% of Tarrytown children (426 students) attend the Irvington School District.
•       They are preserving the scenic tree lined road, as well as creating another access into the Taxter Ridge Park.
•       We have agreed to put a deed restriction on the Greenburgh Subdivision stating no further subdivision of property.
•       Tarryhill residents seem pleased with what they plan to do with the road by making it a safer road.
•       They are using many of the Village of Tarrytown's businesses, professionals and services.

Mr. Tedesco stated for clarification that water course and wetland buffer waivers have already been granted and asked if waivers will be required for the intrusion into the 150' wetland's buffer for construction on lots 1, 5, 6 & 7.

Mr. McGarvey said the houses have been moved out of the buffer and are no longer a problem.

Mr. McGarvey asked when we will get a plan for the water condition on South Broadway.  Mr. Tedesco said they are working on it, but first he had to get the full capacity of the watershed and now he is in the process of designing it.

Mr. Friedlander asked if anyone wanted to speak briefly.

Mark Weidler, 94 Roundabend, asked if the well will extend past his house. Mr. Todd said, yes, but there will be significant screening and he should not be able to see the wall.

Randy Ecker, 53 Tarryhill Road, because his house backs-up to the Coppola driveway and there is no fencing, it is very dangerous especially for the many small children.  Cars fly along the road and it is very dangerous.  They are very pleased with Mr. Todd and Mr. Pateman's plan for this road.

Jean Claude, 71 Tarryhill Road, said he is very happy with what they will do for the neighborhood.  Asked what kind of screening will be done.  Mr. Todd said they plan on demolishing Coppola's driveway and will provide complete screening for the Tarryhill neighborhood.  They will be submitting a screening plan.

Mr. Aukland stated that they made great strides and he feels very comfortable with the deeding arrangements.  He asked about their plan for the trail system.

Mr. Todd said they are doing two things in Taxter Ridge Park:  building a parking lot on Taxter Road; and secondly, in the donated part, they are going to build a trail system with access on Gracemere up to the different parts of Taxter Ridge Park.

The board spoke about the Village's intent to be lead agency.  Mr. Shumejda said that we have started the process and the responses are due by January 10, 2012.

Mr. Todd said they will be submitting to Greenburgh shortly.

Mr. Aukland stated that since the mailbox issue has not been resolved with the post office yet, its possible that once it is, they may have to redesign the entrance.  If so, he asked that they bring that redesign to the public hearing.  

Mr. Aukland also mentioned the issue of Affordable Housing.  Mr. Todd said they will comply with it.

Mr. Tedesco moved, seconded by Mr. Aukland, to set a public hearing for January 23, 2012; all in favor.  Motion carried.

PRELIMINARY PRESENTATION – The Castle - 400 Benedict Avenue

Mike Flynn, Architect with KTGY Group Architects representing the Castle, explained the project. They would like to upgrade the existing facility with an enhanced entry road, a small addition to the main building, the addition of a new spa building and a free-standing parking structure.

At the entrance they would like to swing the wall back a bit to improve the entry and to improve the site/distance when exiting.  They want to improve the entrance to the building by emphasizing the road leading to the building.  Gates will be installed; however, they will not be used.  The roadway will be lined with trees with parking moved to one side of the road between the trees.  At the top of the roadway, it will be leveled off to emphasizing the entrance to the building.  There will also be a portico at the hotel entry and at the banquet entry.  There will also be a covered wheelchair lift installed for the banquet entry.  Presently, the wheelchair entry is in the hotel, which means guests in wheelchairs must enter through the hotel first in order to access the banquet room.

Mr. McGarvey asked if there is a retaining wall in the front courtyard.  Mr. Flynn said no there is lawn which drops off 3-4' where they are going to extend the staircase out.

They proposed a small (400 s.f.)  addition in the rear of the building near the lobby for an elevator which will run from grade, with a stop about 4' up, and then it will go up to the second floor.  There is one suite on the top floor which will not have elevator access.

They want to add a new building for a spa.  Originally a spa was approved in the basement of the guest wing, but it was never built.  In order to put the spa in the location it would require shoring up the entire building which was not practical and accessing it was a problem.  The proposed spa will be 8,000 s.f. and will also house the fitness center with showers, locker rooms, treatment room, steam room, sauna, hot pool and a men's and women's beauty salon.  It will be built in an area which is now an asphalt parking lot.  The area of the parking lot which is not used will be restored to a permeable surface with landscaping.

Mr. Friedlander asked where they would replace the parking that they are losing.

Mr. Flynn said they are proposing the construction of a new parking structure where there is now an existing on-grade gravel paving stone parking area which is used for employee parking and overflow parking.  Mr. Flynn said all parking on the site is being valeted.

Mr. Friedlander asked, what is the footprint of the current parking area, how many levels would the new structure have, and how many spaces would it provide.  Mr. Flynn said it will be about 80' x 200' and the new structure would have one level on grade and one elevated level with approximately 102 spaces, which is the number needed.  Currently they have 129 spaces; they will be adding 18 to cover the additional function of the spa, for a total of 147 spaces.

Mr. Friedlander asked the total number of rooms and how many people the banquet room holds.  Mr. Flynn said there are 34 rooms; and the banquet rooms hold a maximum of 100 people.  Mr. Flynn said there are two levels to the banquet room, but they do not run them simultaneously.

Mr. Friedlander ask the height of the spa building.  Mr. Flynn said 24'.  Mr. Flynn said the materials will be similar to the Castle building.  It will have a courtyard entry and screening to all activities away from Carrollwood.  It will have a vegetative roof.  They want to make it as green a project a possible. They hope to make it a LEED Silver building.  The building will be very energy efficient. They are planning on improving the impervious areas wherever possible.

Mr. Friedlander said since that area is significantly below the grade of the Castle and asked how the people will go to all functions.  Mr. Flynn said it will all be valet.

Mr. McGarvey asked how far the parking garage is away from the property line.  Mr. Flynn said it is 10' away and it is one of the variances they will be asking for.

Mr. Aukland asked if the parking structure could be seen from Carrollwood.  Mr. Flynn said from Carrollwood you can see the cars that are now parked in that area.  When the structure is built, it will be seen by about 3 or 4 residences, but they are planning on extensive screening with vine growing all the way up the entire structure.  The structure will be built so that no headlights will be seen shining into Carrollwood at all.  Since it will be all valet, the light level will be low.  Mr. Flynn said there will not be a roof on the second floor and cars will not be seen.  They will keep the profile as low as possible.

Mr. McGarvey asked if there are two different entrances for the first and second levels.  Mr. Flynn said there would be two different entrances.  The upper level will only be used when they have a banquet.

Mr. Friedlander said his one concern is the parking along the entrance road.  He asked if they thought of putting another level onto the parking structure to replace the parking along the road.  Mr. Flynn said they felt it would be an intrusion for Carrollwood, but they would look into it.  Mr. Friedlander said it might be worth looking into and asked how many spaces they would have to provide if they took the parking off the road.  Mr. Flynn said probably about 20 spaces, which would be a half a deck.  Mr. Friedlander said leaving the road open and making it as grand as possible adds character to the entire site.

Mr. Friedlander asked if there were sitting areas near the pool.  Mr. Flynn said they plan on making a sitting garden in area behind the hotel.  Mr. Flynn said there are areas on the site that are not developed at all and they have tried to keep all of development on areas that are already developed or used in some way.

Mr. Friedlander asked where the delivery trucks go.  Mr. Flynn said they either come up the main entrance road to the service road which leads to the back of the building; or they can come up the road to the left of the entrance along the Carrollwood edge.  There is a fire department access along the road which is chained off.  Carrollwood's recreation building is right below that access road; and from the door of that recreation building, you cannot see the parking structure, spa or even the Castle itself.

Mr. Friedlander asked how many level the spa will have. Mr. Flynn said one level.

Mr. Tedesco asked that the following items be addressed at the Public hearing:

•       A more readable and detailed landscape plan.  Mr. Flynn said they are working on that now.
•       A diagram showing where the asphalt will be removed and how much; where the permeable surfaces will be added and how much; and where impermeable surfaces will be added and how much.  Mr. Flynn said   they have that information which will be submitted.
•       Looking at the stormwater drainage plan to see where any of it can be captured on site.
•       Mr. Tedesco asked if there are any variances they expect besides the setback for the parking structure.
•       Mr. Tedesco asked if there are any steep slope problems.  Mr. Flynn said no.
•       Are you planning on any energy upgrades for the existing building while it is shut down?  Mr. Flynn said the mechanical engineering firm will be doing an energy audit on the building.  They do plan to replace        existing lighting with energy efficient lighting; they plan to replace the windows and to use a more efficient hot water system.

Mr. Birgy asked them to look into where the present roof water goes and to retaining water onsite for irrigation.  Mr. Flynn said it will be addressed at the public hearing.

Mr. Friedlander asked why they decided to build a spa instead of making more room.  Mr. Flynn said they wanted to make it a "boutique" hotel with many amenities.

Mr. Aukland asked in regard to the energy audit if they could give them a before and an after per sq. ft. /per annum and for the spa per sq. ft. /per annum.  Mr. Flynn said yes but it would take at least 60 days.

Mr. Tedesco moved, seconded by Mr. Aukland, to declare the Planning Board's intent to be lead agency; all in favor.  Motion carried.

Mr. Tedesco moved, seconded by Mr. Aukland, to set an Escrow for $5,000; all in favor.  Motion carried.

Mr. Tedesco moved, seconded by Mr. Aukland to set a Public Hearing for January 23, 2012; all in favor.  Motion carried.
