APPROVAL OF MINUTES
Mr. Tedesco moved, seconded by Mr. Birgy, that the minutes of March 30, 2010, be approved as submitted. Messrs. Friedlander and Aukland abstained. All others assented. Motion carried.
CONTINUATION OF PUBLIC HEARING – HSA-UWC – JARDIM ESTATES EAST – BROWNING LANE – SUBDIVISION
Chairman Friedlander stated this matter is being adjourned tonight at the request of the applicant. No one appeared to address the Board on this matter. The Board unanimously agreed to continue the hearing at the May meeting.

NEW PUBLIC HEARING – HUDSON HARBOR PHASE II – 41 HUDSON VIEW WAY
Chairman Friedlander read the following Notice of Public Hearing:
PLEASE TAKE NOTICE that the Planning Board of the Village of Tarrytown will hold a public hearing on Monday, April 26, 2010, at 7:00 p.m. at the Municipal Building, One Depot Plaza, Tarrytown, New York, to hear and consider an application by:

For site plan approval of Phase II of the Hudson Harbor Development located at 41 Hudson View Way (formerly 120 West Main Street), Tarrytown, New York for the construction of two 4-story over parking buildings with 52 condominium units in each; and two 2-story buildings with 14 townhouse units in each and a one acre courtyard.
The property is shown on the Tax Maps of the Village of Tarrytown as Sheet 1, Parcels 36 & 37 and is located in a WGBD (Waterfront General Business District) Zone.
Documents are available for inspection in the Planning and Zoning Office. All interested parties are invited to attend and be heard. Access to the meeting room is available to the elderly and the handicapped. Signing is available for the hearing-impaired; request must be made to the Village Clerk at least one week in advance of the meeting.
The certified mailing receipts were submitted.
Mr. John Jenkins, architect for the project, stated the applicant has appeared before the Board on numerous occasions to discuss Phase II of Hudson Harbor and tonight he would be addressing the issues that came out of those meetings and changes that have resulted.
(The applicant addressed Phase II of Hudson Harbor at the following meetings: December 17, 2009; January 26, 2010; February 2, 2010; March 1, 2010; March 29, 2010; and the minutes from those meetings are incorporated into the record of tonight’s hearing.)
Mr. Jenkins stated there have been some changes to the building elevations. The proposed second phase shifts the density of the site forward to create two four-story residential buildings (Buildings 1A and 2A) over one level of parking at a height of 52 ft. from grade. Buildings 2B and 2C will have a total of 28 two-story townhouses that surround a one-acre landscaped court. They have been exploring the nature of the glass in Buildings 1A and 2A and have gone through some energy calculations. These buildings will be 80% glass. Previously they had shown some brick but decided that the brick felt out of place. They are taking the stone up and creating something that feels like a ruin of a previous building. They are keeping the pre-cast parapet and glass is introduced at the third and fourth level to
create a lightness of the building. Previously they had a metal cable rail balcony. That will now be a glass rail. They are studying the porte cochere at the entry to the building. They would like a heavy timber element.
Mr. Jenkins submitted glass samples for the windows in Buildings 1A and 2A stating the glass will be as light as possible, although it will need to be tinted. They are still reviewing energy calculations. Upon inquiry from Mr. Birgy, Mr. Jenkins stated in the winter, the air or argon gas in between the glass panels provides the barrier which keeps the heat in. Mr. Jenkins stated as they move forward with the energy calculations, they will share that information with the Board. Upon inquiry from Ms. Raiselis, Mr. Jenkins stated the windows are operable.
Mr. Jenkins submitted an additional street elevation which had been requested by the Board.
Upon inquiry from Chairman Friedlander, Mr. Jenkins stated they are preserving all accesses to the RiverWalk.
Mr. John Imbiano of IQ Landscape Architect, stated for Buildings 1A and 2A they are proposing a tiered wall. The lower tier (about 1 ft.) could have perennials or ornamental grasses. Then there would be a taller wall (about 3 ft.) with evergreens. For the space between those buildings there will be a 3 ft. high wall with a bluestone cap and a hedge on top. That will prevent seeing cars in the courtyard. They will create an archway that will go back to the clubhouse and out to the river. It would be stone work. Inside there will be a gravel walk and they are considering eco stone which is permeable. That would give a sense of a courtyard. Plantings will be flowering trees that can tolerate the waterfront. Chairman Friedlander stated you should be able to see through the center
portion - maybe creating a garden. A row of trees would just block the views.
Mr. Imbiano stated for the one-acre courtyard in the center of the townhouses there would be walkways and low trees. It will be a nice gathering space for the townhouses.
Mr. Birgy questioned whether they had considered an irrigation system for the plantings. Mr. Imbiano stated they will be using drought tolerant trees and plantings. Mr. Birgy questioned whether they had considered a water collection system off the roofs of the buildings to have an underground cistern system which could provide water for the plantings. Mr. Joe Cotter of Hudson Harbor stated they have restrictions because of the brownfields. Mr. McGarvey stated they have a retention system, but they were exempt from Phase II storm water management.
Mr. Imbiano noted a detailed landscaping plan will be submitted at a later date.
Chairman Friedlander stated the applicant had previously mentioned there would be variation in height for the two-story townhouse buildings. He stated the Board should see that and the variations should be more than just 1 ft. or 2 ft. to make it attractive. Mr. Jenkins stated they will push up some of the roofs and they are also looking at some rooftop terraces for these buildings as well. Ms. Raiselis stated there needs to be interaction between balconies and stoops. This is a little Village; it is an entirely different neighborhood from the rest of the project. Mr. Tedesco stated a concern of the Board had always been getting people to the center of the site and this does that.
Ms. Raiselis expressed concern that Buildings 1A and 2A may look a little industrial. Mr. Cotter stated that was one reason the brick was eliminated and they went with stone and timber. Board members felt there could be ways to address this concern. Mr. Jenkins stated he could look at that further.
Chairman Friedlander questioned whether anyone wished to address the Board on this matter. No one appeared.
Board members stated there should be a joint meeting of the Planning Board and the Architectural Review Board to review the architectural details. They requested the Secretary attempt to arrange that sometime next week.
Mr. Tedesco moved, seconded by Mr. Aukland, and unanimously carried, that the hearing be closed.
Mr. Tedesco moved, seconded by Mr. Aukland, and unanimously carried, that the Board determines there will be no significant adverse environmental impact as a result of the proposed site plan for Phase II at Hudson Harbor.
Mr. Tedesco moved, seconded by Mr. Aukland, and unanimously carried, that the Planning Board approves the site plan for Phase II of Hudson Harbor. Phase II is to consist of two condominium buildings, 1A and 2A, each at a maximum height of 52 feet, 4 stories over parking, and each to consist of 52 units. In addition there will be two townhouse buildings, 2B and 2C, each two stories with 14 units, and there will be an approximately one acre courtyard between those buildings. This approval is subject to:
1. Approval by the Building Inspector/Village Engineer
2. Approval by the Village Landscape Consultant of a landscaping and screening plan for the entire Phase II site
3. Plantings are to be native species or non-invasive ornamentals. Any deviation from this must be approved by the Village Landscape Consultant
4. If during the implementation of the approved landscaping plan any amendment or changes are desired, such changes must be approved by the Planning Board
5. The provision of sidewalks to connect Buildings 1A and 2A to other streets on the site so pedestrians can walk to the riverfront park
6. Provision of elevation drawings and streetscape
7. Use of permeable pavers (eco pavers) for the parking spaces between Buildings 1A and 2A
8. Approval by the Architectural Review Board and the Planning Board for Buildings in Phase II
9. Adherence to all conditions in the amendment to the Findings Statement for Hudson Harbor adopted at the February 22, 2010, meeting of the Planning Board except for the condition of moving Buildings 1A and 2A an additional 5 ft. back from the waterfront. In place of that, there shall be appropriate landscaping approved by the Village Landscape Consultant to serve as a buffer between the waterfront park and the private space
10. Payment of any outstanding escrow and recreation fees prior to the issuance of a building permit
11. Signing of the site plan by the Planning Board Chair.
PIERSON PARK DESIGN ELEMENTS
Mr. Tedesco, who is a member of the Pierson Park Design Committee, reviewed with the Board the design elements the Committee is reviewing: kayak launch; children’s playground areas; games area; pleasure boats, tour boats and future ferries; restored wetlands; fishing pier; bathrooms; moveable tables; trees; Andre Brook; triangular green area near Andre Brook; parking.
